Upon Application of ROBERT E. BIDWELL for a Special Exception
under Article III. Section 100-31B13 of the Zoning Ordinance for
approval of winery uses in existing building and proposed building.
The site plan shows that the property is situated along the south side
of C,R. u,8. Cutchogue. NY. is zoned A-C Agricultural-Conservation
and is identified on the Suffolk County Tax Maps as District 1000.

WHEREAS, a public hearing was held on May q, 199q and December
8. 1993, at which times those persons who desired to be heard were
heard and their testimony recorded {see separate verbatim transcripts
of hearings); and
WHEREAS. the Board has carefully considered ali testimony and
documentation submitted concerning this application; and
WHEREAS. Board Members have personally viewed and are familiar
with the premises in question, its present zoning, and the surrounding
areas; and
WHEREAS. the Board made the following Findings of Fact:
1. By this application, applicant requests the issuance of a
Special Exception pursuant to Article III. Section 100-31 for a Winery
in conjunction with existing grape vineyards on this 1u~.955 acre-parcel
located in the Agricultural-Conservation iA-C) Zone District.
2. Article III, Section 100-31 of the Zoning Code authorizes by
approval of the Board of Appeals (and subject to site plan approval by
the Planning Board):
"...Wineries for the production and sale of wine
produced from grapes primarily grown in the vineyards
on which such winery is located .... "
3. The applicant, Robert E. Bidwell, the owner of the subject
premises, acquired the premises in December 23. 1982, with Edward J.
Hallstein who conveyed his share to the applicant (Bidwell) on

November 30. 1983 (see Deed at Liber 9493 cp 386). The entire
premises consists of a total area of 14.955 acres with street frontage
along the southerly side of County Road 48 of 711.53 feet. The subject
premises commences at a point 285+- feet westerly of the intersection
of Depot Lane and C.R. 48, Cutchogue, and is identified on the Suffolk
County Tax Maps as District 1000, Section 96 Block 4, Lot 4.3.
4. The applicant has submitted as amended site plan dated April
14, 1994, which was .amended to show revisions and recommendations of
the Planning Board (see previous letters from the Planning Board
requesting specific modifications~to the original map).
5. The April 14, 1994 plan shows a proposed 1456 sq. ft. pavilion
located 113+- feet from the northerly front property line along C.R. 48
and 194+- feet from the easterly side property line. This building is
proposed at one-story, will be heated by oil, and will be utilized for
a retail sales and wine-tasting area related to the existing grape
vineyard and production of wine for the existing Winery operations.
Also shown on the April 14th map are an existing metal building and
concrete block building (with breezeway) which is proposed as the
production and work area of the winery in its processing of grapes
grown on this parcel and for the production of wine. The metal and
concrete block buildings which exist were constructed under a "farm
building" permit rather than a permit for winery operations, and
pursuant to a temporary Special Exception granted by the Board of
Appeals February 15, 1990 under Appl. No. 3882, the owners were to
return in 1993 for an updated inspection and review as to compliance
with State Fire and Building Codes and well as local Health Department
regulations pertaining to the production of wine.
6. As part of the special exception and site plan reviews, the
applicant has assured the Board of their intentions to comply with all
provisions of the Zoning, State Fire and Building Code, and other
regulations pertaining to the operation of the Winery buildings.
7, In considering this application, the Board also finds and
determines: (1) the proposed use will not prevent the orderly and
reasonable use of adjacent properties or of properties in adjacent use
districts; (2) the use will not adversely affect the safety, welfare.
comfort, convenience, or order of the Town; (3) the use is in
harmony with and will promote the general purposes and intent of
zoning. The Board has also considered subsections (a) through (I) of
Article XXVI. Section 100-263 A through F I"standards"). applicable to
special exception reviews. The Board agrees that the use of the
buildings, as proposed herein, meet all the standards and conditions
prescribed in the Southold Town Zoning Code for such land use.

wait, get the model first. We're here to seek a final approval on this
Special Exception to operate a winery in an existing building which is
here and operate the retail sales and public place in a new pavilion
which is here which as you see is in the front yard of the building.
The highway ..... runs right in front and surrounding the complex is
vintage, about 15 acres total and over the last 3 or u~ months we have
been talking steadily although not fairly regularly with the Planning
Board over the matter of details and items such as site drainage,
objects on the site. There's been a number of request at the Planning
Board this May and to the best of our knowledge we're now at a point
after having made 'many minor changes, actually most of them are fairly
minor to the site plan we're now at the point where therems a question
about the color, the intensity of the blue on the color of the roof of
the new pavilion. So, except for that item why we're now in an
essential site plan agreement with the Planning Board. Some of the
things just to refresh your memory although it should show up in the
site plan, some of the changes that have taken place in the last 3
monl[hs as a result of this inter action between the Bidwells, myself
and the architects is to remove the pylons which as we found out we're
technically speaking accessory buildings and rather than try to make
further appeal to retain those' it was agreed to remove them as well as
an entry tower here that's also being removed. The building itself
· although there hasn't been any change to the shape or the location of
the building the material that at one time let light into the building
was Plexiglas~s is now glas~ and the architects will have shortly
redrawn the building plans and details to reflect that change. That's a

fairly major change to the point of view the Bidwells and from point of
view of time and effort to accommodate that change. The other change
is that the parking area and the access to the site has been modified
at the request of the Planning Board to give more room in front of the
building. A handicapped face has been moved closer to the building.
There is now a passage through an existing piece this being the office
space. Passage through here to connect outdoor space to the inner
courtyard which would be very helpful with regard to handicapped
people, and then there's additional trellising in the front of the
building and additional landscaping in the side of the building. Again,
at the request of the Planning Board in order to make the eastern
approach to the building more bucolic, more rural, less abrupt. Right
now as everybody knows there's a building here with a rather severe
front of the road and that has now been altered to soften that front to
the road. I frankly think it's an improvement.
MR. CHAIRMAN: The majority you're talking is going to be on that
easterly side, right?
MR. BAYLEY: The majority of the parking is on this side of the site,
yes and some in the front and there's also overflow in the back.
There's quite a bit of overflow .space to the rear of the winery
building which should be back here, so we feel pretty good about
where we're at right now, although it's taking a long time. Frankly,
we're surprised at how long, in fact, it has taken to arrive at this
structure but we feel very comfortable about the fact that the Planning
Board is now with the current plan as you have it and we hope you
feel the same way.

MR. BAYLEY: Oh!, one other thing here. It's pretty hard to see that
this rendering was prepared on behalf of the or for the Planning Board
in order to show at eye level from the east which was by everyone's
opinion to be the weaker side of this project to show what the effect
would be of introducing landscaping which has been agreed to changing
the glazing in the new pavilion to glass rather than corrugated
Plexiglas and in addition of trellising around the hard edge of the
existing building so this is now a slightly different view of what
you've all seen before.
MR. CHAIRMAN: Very beautiful actually.
MR. BAYLEY: So, do you have any questions or can the Bidwells
answer any questions about .... ?
MR. WILTON: What is your time frame to get to this state?
MR. BIDWELL: We're hoping not to phase it we're hoping just to do it
one phase.
MR. CHAIRMAN: Well, let's go on from that point and when do you
think you'll have final approval from the Planning Board?
MR. BAYLEY: Well I would expect that as soon as a in fact I was just
told by Carrie and Jim tonight that the sample color which the Planning
Board has requested to see on the building has been done so actually
all we have to do now I think, is to invite the Planning Board to come
look at the color of a, it's a pale blue, blue gray on this building
which will then hopefully show them what it will llke so that they can
approve of that question and I, I don~t know how Ion§ that will take, I
see a week or two at most, s6 if all goes as we expect why within the
next ten days or so we'll have formal site plan approval. We still have

to get Board of Health approval, but we now have again hopefully a
site plan that is acceptable and there have been some modifications to
that that would affect the Health Department. There has been additional
site drainage added to the site plan, additional spot grading
information added to the site plan so hopefully that's as far as we'll
have to go. That is I don't think there'll be any other changes to the
site plan.
MR. CHAIRMAN: Bob, do you have any questions of Mr. Bayley?
MEMBER VILLA: Yeah, what is this 7 foot high concrete block wall
back here? It looks like to the west of this metal building.
MR. BAYLEY: It's a walk to shield a service ......
MR. BIDWELL: That's correct, it's on the model behind the trees. You
just barely see it. It's to delineate the garden area from the back
overlooking ....... .
MEMBER VILLA: I couldn't see an area .... I was looking at it ....
MR. BIDWELL: Basically, what we'ke doing is, using it for us to focus
views across most of the back of our property. This is the wall over
here.
MEMBER VILLA: This is not standard block, is it?
MR. BAYLEY: I believe it is the same ...... .
MR. CHAIRMAN: So we won't be seeing the pickup sitting over there
on that side of the building?
MR. BIDWELL: No, you won't see it. I don~t think that's standard
concrete block either. I think it's a, it's a rough face terrazzo type
of concrete blocking, it's a very nice looking standard texture.

MR. BAYLEY: It's what's called in construction, this is split face
block. Itms really a block made like ordinary concrete block but with
different coloring agents and then it's split so that the split
services is rough and rustic and more stone like than what you would
normally see in concrete block which is a smooth finish.
MEMBER VILLA: So it's an esthetic thing? That's what I was looking
for,
So you're not having a pagodas out by the road or anything else then
that~ll ..... ? So, you're just going to have some signs out there?
MR. BAYLEY: Well right now there's an existing sign which will stay as
the existing sign which is on the left side of the drawing and that
meets the current sign statute for the town and it will be the only
sign. Am I right?
MR. BIDWELL: That's it.
MEMBER VILLA: You know, I think by doing what you're doing you're
drawing up attention ......
MR. BIDWELL: I hope so.

No. 1~237. This is a request for an amendment to Special Exception of
~t065 rendered January 23, 1992 for the processing of grapes grown at
the premises and sales of grape wine. A copy of a survey site plan
basically produced by Robert Van Tuyl amended October 21, 1991, and
most recently to April 13, 1993, indicating the building as it is
completed in its finish form and a site plan by Thomas C. Samuels
dated April 15, 1994, indicating the entire area that this rather
magnificent building (It is a magnificent building) encompasses and I
have a copy of the Suffolk County Tax Map indicating this and
surrounding properties in the area.
TOM SAMUELS: ..... Mr. Pellegrinl here this evening. At the time the
original application for Special Exception was filed and granted by the
ZBA we had intended and the Pellegrlnis had intended to put a bottling
llne for bottling of the wine in the area that this ..... . Since that
point and since the building was built and operating they've joined the
co-op which bottles wine on,a, as a flat bed so they didn't need a
bottling llne so the space was in a sense left over. They've used it

which wilt continue to be utilized. These two buildings consist of a 2,996
square foot grape processing building and a 2,008 square foot
office/laboratory building.

Reasons Supporting This Determination:
This project involves a proposed wine tasting pavilion of 2,032
square feet on an existing fifteen acre parcel. The applicant has
obtained a special exception for a winery from the Board of
Appeals. The site and area are zoned for Agricultural-Conservation
(A-C) by the Town of Southold, thus the proposed action is consistent
with zoning.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.

The Planning Board has received your letter of December 19,
1994, concerning the the Health Department's correction to the
Negative Declaration issued by this Board on July 11, 1994.
The Health Department correction shows the new building as 2,032
square feet, yet the site plan dated April 14, 1994, which was
used in the coordinated SEQRA with the Health Department shows
the building, as indicated on the Negative Declaration, to be
1,456 square feet. A call to the Health Department could not
resolve where they obtained the 2,032 square feet they showed as
a correction to the Negative Declaration. Please forward a
.revised site plan showing the correct square footage of the new
building.

Ordinance, Article III, Section 100-33, for permission to set up
a temporary tent for cultural events. Proposed tent does not
address this condition in A-C Zone District. Property Location:

WHEREAS, a public hearing was held and concluded on May 15,
1990 in the matter of the Application of BIDWELL WINERIES, under
Appeal No. 3945; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of Route 48, Hamlet of Cutchogue, and is identified on the
Suffolk County Tax Maps as District 1000 Section 96, Block 04,
Lot 4.3.
2. This is an application for Variance from the Zoning
Code Article III, Section 100-30, for approval of a temporary
tent for cultural events, proposed tent does not address this
condition in A-C Zone District.

3. Article III, Section 100-30 - The purpose of the
Agricultural-Conservation (A-C) District and the Low-Density
Residential R-80, R-120, R-200 and R-400 Districts is to
reasonably control, to the extent possible, prevent the
unnecessary loss of those currently open lands within the town
containing large and contiguous areas of prime agricultural
soils which are the basis for significant portion of the town's
economy and those areas with sensitive environmental features,
including aquifer recharge areas and bluffs. In addition, these
areas provide the open rural environment so highly valued by
year-round residents and those persons who support the Town of
Southold's recreation, resort and second-home economy. The
economic, social and aesthetic benefits which can be obtained
for all citizens by limiting loss of such areas are well
documented and have inspired a host of governmental programs
designed, with varying degrees of success, to achieve this
result. For its part, the town is expending large sums of money
to protect existing farm acreage. At the same time, the town
has an obligation to exercise its authority to reasonably
regulate the subdivision and development of this land to further
the same purposes while honoring the legitimate interest of
farmers and other farmland owners.
4. Also noted for the record under Appeal No. 3732 for a
Winery for the Production and Retail Sale of Wine. In this
Decision rendered July 14, 1988 it states:
(a) The area proposed for retail sales is to be not more
than 400 sq. ft. as marked in "red" on the Proposed sketch
Drawing prepared by Guili & Showers dated May 31, 1988 under
Drawing No. A-1.
Also noted for the record under Appeal No. 38~2 for
approval of consumer tasting and retail sales from the Winery.
In this decision rendered February 15, 1990 it states:
(a) That the Winery sell their wine product in the 20 X 20
building presently located in the front of the building,
conditionally for three (3) years from date of this decision.
lb) That this decision is subject to Site Plan Approval by
the Southold Town Planning Board.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Doyen, it was

5. In considering this application,the Board finds and
determines:
(a) that the use will not prevent the orderly and
reasonable use of adjacent properties or of properties in
adjacent districts;
(b) that there is no other method for appellants to
pursue; and placing the proposed temporary tent in any other
location on the premises will require other variance relief;
(c) that the area chosen for the temporary tent is not
unreasonably located;
(d) that the Variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the Variance, as Applied conditionally noted below.
RESOLVED, to GRANT a Variance in the matter of the
application of BIDWELL VINEYARDS as applied under Appeal no.
3945, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the temporary tent only be used as a secondary
and an incidental use for the production and sale of Bidwell
Wines and for the purpose of advertising or for the tasting of
Bidwell wines and not for the sale of non-wine products such as
posters, paintings or any other objects/products that have not
been grown or produced on the premises.
2. That the temporary tent only be granted for a maximum
period of ninety-five (95) days from the date of this decision,
this tent must be dismantled and removed by September 15, 1990.
3. That this approval is expressly contingent upon the
applicant providing forty (40) on site parking spaces, the
applicant must provide enough stone blend surface to provide
adequate parking.
4. That the existence of any off premises parking is a
direct violation of this temporary permit and renders this
decision null and void.

5. That the tent meet any and all fire code regulations
and is to be inspected by a Southold Town Building Inspector.
6. That this decision is also expressly contingent on the
applicant's representation that it will vigorously and
continuously pursue site plan approval from the Southold Town
Planning Board for the subject winery. In the event that this
Board is advised that the above stated condition has been
violated, this permit shall, upon notice to the applicant,
become null and void.
Vote of the Board: Ayes: Messrs. Goehringer, Sawicki,
Dinizio and Doyen (Absent Charles Grigonis). This Resolution
was duly adopted.

reasonably control, to the extent possible, prevent the
unnecessary loss of those currently open lands within the town
containing large and contiguous areas of prime agricultural
soils which are the basis for a significant portion of the
town's economy and those areas with sensitive environmental
features, including aquifer recharge areas and bluffs. In
addition, these areas provide the open rural environment so
highly valued by year-round residents and those persons who
support the Town of Southold's recreation, resort and second-
home economy. The economic, social and aesthetic benefits which
can be obtained for all citizens by limiting loss of such areas
are well documented and have inspired a host of governmental
programs designed, with varying degrees of success, to achieve
this result. For its part, the town is expending large sums of
money to protect existing farm acreage. At the same time, the
town has an obligation to exercise its authority to reasonably
regulate the subdivision and development of this land to further
the same purposes while honoring the legitimate interests of
farmers and other farmland owners.

WHEREAS, a public hearing was held on June 2, 1988, in the
Matter of the Application of ROBERT E. BIDWELL under Appl. No.
3732; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted considered this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:

1. The property in question is identified on the Suffolk
County Tax Maps as District 1000, Section 96, Block 4, Lot 4.3
(part of 4.1).
2. The subject premises is presently improved with an
agricultural structure presently under construction pursuant to
Building Permit 15622Z issued January 12, 1987, and agricultural
buildings constructed under Building Permit numbers 13780 issued
March 22, 1985, and under 12617Z issued September 17, 1983. Town
records shows that no on-site physical inspections of the
buildings have been made to date under the N.Y.S. Construction
Code by the Town Building Inspectors (since the buildings were
apparently permitted only for agricultural storage).
3. By this application, applicant requests a Special
Exception to the Zoning Ordinance under Article III, Section
100-30B, Subsection 14 for permission to establish a Winery for
the production and retail sales of wine produced from grapes
primarily grown on the vineyard on which such winery is located.
4. The premises in question contains a total acreage in
excess of 14 acres having a frontage of 679.42 feet along the
south side of County Road 48 (Middle Road) in the Hamlet of
Cutchogue, Town of Southold.
5. The subject premises is located in the A-Residential and
Agricultural Zoning District and is improved with a prin-
cipal agricultural barn building containing a total floor area of
approximately 4765 sq. ft. An addition made of prefabricated
steel is proposed of a size 90 ft. x 54 feet, which would
increase the floor area of the building to a total of 9625 sq.
ft. ~"
6. The area proposed for retail sales is to be not more
than 4819 sq. ft. as marked in "red" on the Proposed Sketch
Drawing prepared b~ Guldi & Showers dated May 31, 1988 under
Drawing No. A-1. The remaining floor area is proposed for
storage, production, utility rooms, wholesale sales areas,
bathrooms, hallways, file room. Sufficient information has not,
however, been presented to confirm whether the proposed retail
sales area of the subject winery establishment will be occupied
entirely or partly in the newly proposed addition or the existing
agricultural barn structures, or whether the wholesale and
production areas are to be within the existing, or proposed,
addition.
7. The setbacks of the winery building in question is shown
on the February 11, 1988 final location survey prepared by
Williams R. Simmons, Jr., L.C. to be at 155.7 feet from the
northerly property line along the County Road. The parking areas
are shown to be a minimum of 36 spaces, 18 at the west side and
18 at the east side of the building. ~It is noted for the record
that an application for site plan approval by the Planning Board
is pending review at this time as required by Article III,
Section 100-30B(14) and Article XIII of the Zoning Code.
8. In considering this application, the Board determines:
(a) that the buildings within which the proposed winery
uses are to be located must first be inspected and approved as to
meeting all the requirements of the N.Y.S. Construction Codes and
all other applicable codes;

(b) that the use will not prevent the orderly and
reasonable use of adjacent properties or of properties in
adjacent use districts;
(c) that the safety, health, welfare, comfort, convenience
and order of the Town will not be adversely affected by the
proposed use and its location;
(d) the use will be in harmony with and will promote
general purposes and intent of zoning since this is a use
permitted by legislative action and will meet all other
requirements of the zoning code.

9. The Board has also considered Items (a) through (1) of
Article XII of the Zoning Code in making this determination.
10. It is the position of this Board that in making this
determination, the occupancies for the uses permitted hereunder
shall exclude the retail sales, and that applicant will be
required to submit a separate application, in complete detail and
form, for consideration of same, together with all other areas
(wholesale areas, file room, production rooms, storage areas,
etc.). Additional information is needed before an approval can
be given for the use of retail sales and occupancy by the public
for the same.

This letter will confirm our discussion on March 15, 1994,
regarding the above referenced project:
Bidwell will substitute glass for fiberglass in the
proposed pavilion.
Height of tower to be reduced to eighteen feet and moved
to the rear yard.
· No internal lighting in the tower.
Ail lighting, including pylons, to be shielded to
premises.
· The new pavilion intrudes into the parking area. The
building should be rotated to keep a clean site line.
We are in receipt of the Appeals Board letter to you of March
18, 1994, that indicates that the "pavillion" may be
considered as part of the Special Exception use upon further
consideration by the Appeals Board.
When the above changes to the site plan are made Bidwell has
agreed to proceed with Health, Curb Cut, and Building Department
permits.
Any possible final approval by this Board cannot be granted
until all permits and the Special Exception are obtained.

This letter will confirm our discussion on March 15, 1994,
regarding the above referenced project:
· Bidwell will substitute glass for fiberglass in the
proposed pavilion.
· Height of tower to be reduced to eighteen feet and moved
to the rear yard.
· No internal lighting in the tower.
· Ail lighting, including pylons, to be shielded to
premises.
The new pavilion intrudes into the parking area. The
building should be rotated to keep a clean site line.
We are in receipt of the Appeals Board letter to you of March
18, 1994, that indicates that the "pavilion" may be considered
as part of the Special Exception use upon further consideration
by the Appeals Board.
When the above changes to the site plan are made Bidwell has
agreed to proceed with Health, Curb Cut, and Building Department
permits.
Any possible final approval by this Board cannot be granted
until all permits and the Special Exception are obtained.

We are today in receipt of your letter confirming that the "pavillion"
building is to be used for retail sales and. tasting of wine,produced
from grapes at the subject promises, rather than an accessory use -
which would, be subordinate to a main use and normally for inactive uses
such as storage. In my point of view. this.building maybe included as
part of the Specia~ Exception for use in the winery operations; however.
it has not as yet been discussed at; a meeting of, all the members. Our
next meeting is-set for April 6. 199q. and it will be considered either
at that time or at the public hearing (expected May.q. 199~).
Enclosed is a copy-of, communications-received from the Planning Board
for your information. Upon receiving the memorandum, we further
inquired as to the nature of, other requests to be made on the site plan.
· by the Planning Board. and we were advised that a change is to be
made concerning the tower -- which will be relocated.
Please provide us with seven (7) prints of the site plan map. showing
current changes and other areas., such as the location of- curb cut
locations or any other elements of the site plan at this time. as

3/17 Bob Bayley, agent for Bidwell Wineries stopped in to say that
he will be able to prove that the so-called "pavillion" building is
more than an accessory structure since it is to sell wine and wine

to the existing winery building, and as such, they must be

The applicant has been informed of this and will have to resolve
the location of the tower and pavilion before this Board can
proceed with its review of the site plan.

Dear Mr. Bayley:
As requested, following are the Board's preliminary comments in
response to the presentation of the above referenced project at
Bidwell Vineyards on Saturday December 4, 1993.
The construction materials, (glass block &
corrugated fiberglass), that are proposed for the new
building and structures are not in keeping with other
farm buildings in the area and the materials used
in all other wineries on the North Fork.
The corrugated fiberglass proposed for the new
sales and tasting building will permit light to shine off
site. All lighting must be shielded to the property.
Town Code 100-205 B. permits a maximum height of ground
signs of fifteen (15') feet. Your ground sign tower is
twenty feet six inches (20' 6") high.
Only one free standing ground sign is permitted for eaoh
frontage of a property on a public street. Your plan
shows two ground signs.
The internally lighted entry pylons and sign tower must
be shielded to the property.
A convection oven and steamer are shown on the plan. Is
food to be prepared or served in the retail pavilion?
· The new pavilion building intrudes into the
parking area. The building should be rotated to keep a
clean sight line.
· Grades and drainage details are missing for court
yard development.
Approval from the Suffolk County Health Services and a curb cut
permit from the Suffolk County Department of Public Works must
be obtained before any possible final approval can be given to
this project.
As previously mentioned, the above items are preliminary, the
result of our technical review of the plan will be discussed
with you and your clients at our planned meeting on January 10,
1994.

THE CHAIRMAN: We have copy of a site plan, which I
will pull out du~ing the hearing, and I have a copy of the
Suffolk County Tax map indicating this and surrounding
properties in the area. The nature of the application is a
wine-tasting room and some enhancement to the grounds of the
property itself. And I guess we will ask you, Bob, if you want
to start the presentation or--
ROBERT BAILEY: Okay. What I would like to do is to
introduce to the members of the Board the Bidwell family. This
is Kerry Bidwell on the aisle, Jim Bidwell, and they are going
to talk a little bit about what they want to do; and a little
bit about the history of their business.

MR. BIDWELL: Just. very briefly, we need to bring the
existing buildings into the proper sea of open uses (sic) that
we are using them for. Right now, there has been some (inaudible
brief phrase) in the past. And we definitely need to enhance
the grounds, make it more appealing. Make At so that it ks an
enhancement to the Town of Southold, and for our business as
well. We are ten years growing grapes, seven years making
wine. The wine sells extremely well across Long Island, and we
feel that we lack a tasting room that has the correct ambiance
to reflect the quality of the wine that we are producing there.
THE CHAIRMAN: Great. Just let me have your first
name.
SPEAKER: Donald.
THE CHAIRMAN: Not yours, his.
VOICE: Kerry.
THE CHAIRMAN: I have to have that for the record
because Linda is not here tonight. I apologize. All right.
Who is speaking next?
JIM BIDWELL: I would just like to add to that. My
name is Jim Bidwell, and we have been doing this now for some
years out here, and I guess we are all aware that the building
we have been working out of ks not the most attractive building
on Route 48, and we would like to change that. Most of the
thrust of what we are tryinq to acccmplish now is to beautify
what we have so that the business can continue to go in the

direction it really needs to go, and we accomplished every other
aspect of this business and that has allowed us to fund this and
it is really what we need and what we need as soon as possible
in order to capitalize on next summer's tourism season, to keep
ourselves going, and the timeliness of the project is also of
great concern to us because we are trying to have ourselves set
up so that next summer we are ready to do business there.
THE CHAIRMAN: What do you expect the total cost of
the enhancement including the tasting room, at this point?
JIM BIDWELL: We haven't got it out or any prices back
yet on the plans, so it is conjecture at this point, but we are
hoping it will be something around $250,000, maybe $300,000.
THE CHAIRMAN: That is a sizeable investment.
MR. BIDWELL: Yes, it is; and it is about as much as
we can do; but we are taking all the resources that we have to
try to beautify this place for our sake and for the sake of the
Town, just get it where it should be.
THE CHAIRMAN: Very good. Thank you. Who is next?
MR. BAILEY: I would'like to introduce the architect,
Don Currie, who will talk with you about the design and what the
intentions are, and the significance of the design, because it
is considerable. In this case, as the owners mentioned, you are
dealing with a building which is probably among the homeliest of
all the wineries if not all the buildings you see on Route 48,
so what is proposed will definitely make a dramatic change in

that aspect, and at the same time give the business a very
important place to meet the public, sell wine, and a new face on
the world, so Don Currie will talk about that.
THE CHAIRMAN: While they are moving that model in, I
just want to restate for the record that, for everybody in the
audience that we did have the pleasure of meeting these
gentlemen on Saturday. They were very gracious in presenting a
tour of the facility --you can put those on the chairs if you
want-- excuse me-- We did meet with the Planning Board, and we
did meet with one member of the Building Department, and as I
said, we have seen this plan, and we --How could anybody
disagree with it, quite honestly? You are on, Don.
DON CURRIE: My name is Donald Currie. I am an
architect, and Drew Renter is my colleague from the office; and
we have actually been working on this for about a year. We met
with Bidwells last January and (phrase indistinguishable) what
they could do for the modest sums of money they had; and what
they really wanted to do was make an inviting place, to find out
what wine is about on the North Fork, and I have had a weekend
place out here since 1980 so I certainly know something about
the North Fork and I don't know if any of you have seen the
existing buildings, but they are very "plain-Jane" buildingcs,
and the idea was to build a tast~.ng room and place it in a place
that would encourage us not to spend a lot of money on the
existing building. What we are reall~. doing is --the real work

of making the wine occurs in the existing buildings. We are
painting those buildings. We are putting a lot ot planting and
pergolas, and so forth, in front of those buildings; and then
--I think I can turn this up so that everybody can see-- what we
are really doing, these are the existing buildings, and we are
building about a forty-foot-square 1,600 to 1,800 square-foot
tasting room and little ancillary space. That is a big tasting
room. We can go into one big room with a horizontal surface --a
bar if you will-- where you can taste the wine, and then in
these four corners we have restrooms and storage room for the
wines that (two words inaudible) for a couple days, and then,
what you do: I think you all know the North Road; there is a
sign out there now for Bidwell
can come in off the North Road;
and for the public along here,
and the existing building. You

of the building. We built a little structure here, a garden
structure that is kind of a landmark to catch your eye; but you
can see it is lower than the existing, barnlike building; and we
turned the entrance of the tasting room into a new space. A
courtyard is created by the existing buildings and the tasting
room; so you come into the courtyard and then go into the
tasting room, so you are in like a little special world there
away from the traffic ef the North Road. We are adding a
pergola; that is, a wood and metal ~tructure with vines growing
on it to kind of mask and scale down the exlstipg building; and

we are adding a box of trees that people can sit out under the
trees and look out into the vineyard, and it is all a part of
not only tasting the wine, but there is also an education going
on here, finding out about how wine grapes are grown and wine is
made; so tours will begin in this courtyard. People will get an
introduction to how wine is made in the tasting room, and then
be taken around to the process of crushing and there is a
crush-pad in the back here (indicating) and they will be able to
see how the wine is made in the big building and then out into
the courtyard where it is put into focus. What it really is is
a tasting room and place to find out about wines. That is
pretty much it. Is there any question? We have a color drawing
that shows something about the colors and materials that we are
using. As you can see, the new building is a little bit lower
than the barn-like building at the back.' We are using --We
brought some of the materials with us. There is the board.
THE CHAIRMAN: Don, the only gentleman who was not
there was Mr. Doyen from Fishers Island, so you might want to
show him a couple of those samples you have there.
MR. CURRIE: Okay. There are really three major
materials associated with the new building; that is, a concrete
block on the four corners, which are the restrooms and storage
spaces, and then a corrugated translucent material which I will
explain in just a moment, which spans between each of the four
corners; and a corrugated metal group which is a blue color

which is a similar material to the material that is already on
the roof. The concrete block is not your standard concrete
block that you normally see in our basement family rooms or
whatever. It has a stone in it and is polished, and it is kind
of an enhanced concrete block.

of the four corners is a sandwich-like material that is
translucent and is not too dissimilar to this --and this is
pretty difficult to tell you what it is-- It meets energy codes
but if I were to hold it out --and there is not enough light in
this room-- but it is translucent. In other words, light can go
through this material, and it still meets (word
indistinguishable) codes because it has insulation on the inside
and in this plastic-like material, fibreglass material, on the
two faces; so what it will do is, when you are in the tasting
room during the day, it is going to seem like you are still sort
of like being outdoors. It is, are you in or are you out? At
night, with just a single light on, and the place is closed, it
will kind of have a glow to this, and will be like a lighted
pavilion; and we thought that the building --this is a
quasi-public building, let's make the contribution --This
bu±lding needs to make a contribution to Southold. And it is a
building that is seen from the road. Most of us pass on the
North Road quite frequently, and i~ w~IL be an enhancement, not

only to what the Bidwells are doing here, but to the sense of
what is happening in the community because this will be a
nice-looking building, whether it is night or day. And the only
other material is a blue color that we are using on the roof,
that is a kind of roof color also, so it is not a building that
say jumps out at you such as a red barn would, or whatever. But
has this kind of subtle material. Is there anything any of you
might add to it? What I have said. Any questions about what we
are doing or proposing?
MEMBER DINIZIO: Are the existing buildings going to
be. painted to match?
MR. CUR~RIE: They are not painted to match. We felt
that, you know, these buildings have been built over a period of
years. They are of different scale, so we are painting them in
three kind of earth colors. We are painting them in a sepia
brown and a gray color,

are going to sort of sit back in the landscape. There is a

part of this application-- but certainly we applaud all the
wineries out here. They have done a phenomenal job. The last
one that came before us was Pellegrini, which is a magnificent
building in Cutchogue, and this property also happens to be in
Cutchogue, but it appears that in time there will be additional
buildings needed, assuming that and hopefully that everybody
will be successful and that this will continue. Is there any
plan on wh~re you would put additional barn-storage on this
property, assuming that that was to happen?

MR. CURRIE: The public image for now will remain with
this building. If they need to expand production, that will
happen behind the existing barnlike building, and they intend to
go back, and underground.

their plans for expansion would be another building probably of
similar footprint size, behind the building, and they intend to

you very much. Let's just talk briefly in general what we are
going to do here. We are going to continue with the site plan
with the Planning Board; is that what the story is? We are
going to hold this in abeyance until the parking plan is to
their liking? And then we are going to come back with any minor
revisions that may exist on this, is that right?
MR. BAILEY: That's right. Right now we are waiting
for the site plan review guidance of Robert Kassner to give us
something s~ecific. He has already mentioned a few things to me
about labeling, which is easy to accomplish; but I don't have
any specific objections as of yet from the Planning Board. As

absolutely no problem with that. I don't mean to take your
words out of your mouth.
MR. BAILEY: All I can say is the Bidwells are anxious
to shoot for an early ground-breaking; so whatever has to be
done with the Town, why, will have to be done. We need to get
some information back now; that is what I am waiting for.
THE CHAIRMAN: Why don't we do this: Why don't we--
MR. BAILEY (interposing): Can you give conditional
approval?
THE CHAIRMAN: We can't. What we can do is, we can
hold it over until the January meeting; and if you have not
received anything, we will close the hearing at that point. I
don't think it is necessary to bring these two gentlemen from
the city out here, you know. We loved your presentation on
Saturday, and I love it today, to be honest with you. In no way
do we want to stagnate a situation, you know. You can get
prices and get everything rolling so that you are ready to go.

gone. I don't think there is anybody on this Board --and I
didn't poll anybody because that is not what we do, but I don't

tower. As we described to you over the weekend, it is more to

MR. BAILEY: It will have the Bidwell name on it, but
you know the letters are fifteen inches high or something and
from a distance will never be read, so it isn't intended to be a
sign there.
MEMBER DINIZIO: Is there a possibility you could make
that so it does not need a variance?
THE CHAIRMAN: They can apply for it, and we can
restrict it to 18 feet. Either that or you can modify it to 18
feet.
MR. BAILEY: Can this accessory structure have
internally lit capability to light a directional sign?
THE CHAIRMAN: We have to now get into the sign
ordinance portion of it, okay? And that is an issue that I
would ask you to address with the Building Inspector; and that
is why I think it is good to have this period of time; then come
back to us in January. The meeting was going to be January
fifth. We are going to modify it, and I am going to ask the
Board if they will go along with January 12th which is a
Wednesday night, and in fact we can say it is only five weeks
from today; so let's take all that into consideration so that we
have everything done and are ready to go. Is that all right?

MEMBER VILLA: I would just like to see that he
complies with those Town Codes. And the signs.
THE CHAIRMAN: Sure. And we do have a thing about
specific statements in the Code under the sign ordinance to read
on lighting of directional signs, and I personally don't even
know if we have any directional signs anymore that are lit
anywhere in the Town; and I think that was the purpose of the
'89 code, so-- Not that this is really a directional sign
because it is on the property, but the only thing you would be
directing it to would be to a specific parking lot or whatever
so it is not really a directional sign.
MR. BAILEY: That is, after all, the weak corner of
the site. It is not in any way as interesting as the other
side. So this is to deflect some attention from the existing
building. At least, that's how I understand it from the
architects, so I think it is important to have something there,
and that was the intent, to have a sign.
THE CHAIRMAN: Sure.
MR. BAILEY (Continuing): --not per se, something to
focus the eye and not on the existing building.
THE CHAIRMAN: Also it is great that you put it on
there because we wouldn't have come up with this issue of the
--it would have been an incomplete application. We would
certainly have granted it without that, I would have -- I am not
speaking for the Board. An example of which was in Cutchogue

with the North Fork Country Club, we went through the granting
of that really magnificent building that sits there now; and
then when they wanted other things in reference to parking lots
and stuff, they did have to come back because of the Code.

Dear Mr. Bayley:
In reviewing the documents left with us yesterday, it is noted that the
Notice to Adjacent Property Owners' Form with Affidavit of Mailing and
original postmarked certified-mail receipts were not attached.
Once you have submitted the above, together with the eight (8) sets o~
map~and one original survey of the premises and confirmation that the
corners of the proposed new building area have been staked (and
photographs submitted), we will be in a position to transmit copies to
the Board Members for reviews and inspection (and file the application
with the Town Clerk).
In order to help expedite the processing of this proposed application,
you have agreed in the interim to meet with members of the Planning
Board for the purpose of review and obtaining the Planning Board's
recommended changes or other recommendations on the location of the
building as it effects the general site plan elements for
maneuverability of vehicles, customer parking, egress, etc.
However, today Bob Kassner (Site Plan Reviewer for the Planning Board
in this project) has indicated that the required map has not been
delivered to him as yet, it is not possible to adequately con~ent until
it has been submitted for reviews. Therefore, it is suggested by our
office that you meet on a preliminary basis on the planning and layout
issues as soon as possible. Once this has been accomplished and the
Planning Board has reviewed the new plan, a written letter would then
be expected (with any recommendations for changes or other action by
the Planning Board).
Once all the above has been completed, the Board of Appeals would
calendar the same for a public hearing to be held at the next available
