The current configuration of docks doesn't conform to permits granted and is a potentially dangerous situation. The Southold Town Board of Trustees are requiring all inVolved parties to conform to their permits (in regard to dock size and lodation) and to work with this board and their neighbors to resolve this problem.' I am also hopeful that You have become acCurately apprised of this situation and its convoluted details. PerhaPs now we can move to resolve this issue. Allow me to.present the problem as I perceive it. Ail Gull Pond mooring lot owners realize that their. Property is,.on an arc. Each of us should be able to enjoy not only the twenty feet of.bulkhead frontage but a similar distance across the back water end of the mooring area. If that distance is 18,. 17~or'!6~fe~t,~. so be it, for one and all! So herein lies the problem~ No one really knows where the apex of~'the arc is. To resolve this situation-, ~r. McGoughhired a surveyor to protect his interests. His surveyor's findings differed from that of ~r. Geideman who is a surveyor, an owner and also representing the interest of Mr. Israel. Be advised that an on site meeting was held with Mr. Roberto Barbosa of the Army Corp. of Engineers and interested mooring lot owners on this very issue. The outcome was that Mr. Geiderman and Mr. McGough's surveyor were to determine a mutually agreeable aperture for each of us. Once this was accomplished all of the floating docks could be accurately positioned. That meeting was over a year ago with no formal or informal proposed rendering coming forth thus far. I too am anxious to demonStrate my willingness to cooperate with the So~thold Board and my neighbors to resolve this matter in a timely and harmonious fashion. Box 1210 Southold, New York 11971 Dear Mr, McLaughtin- The fol!owing is in regards to the subject application to co~struct a pier assembly in Gull Pond, Gardiners Bay, at the Town Of Southold, Suffolk County, New York, and in furtherance to our letter dated june 1, 1993, copy enclosed. As stated in our previous letter, this office cannot authorize a proposal that would result in undue interference with, access to, or use of, navigable waters. For this reason, it was recommended to Mr. Geideman that an agreement to relocate the existing structures be attained with Mr. George McGough, Mr. Ralph Grandinetti, and himself, in a manner that would allow 'Ms.~. Israel to install the proposed pier assembly. During a telephone conversation with Mr. Roberto Barbosa of my staff, you stated that it has been extremely difficuIt to .reach a consensus regarding the proposed relocation of the structures that would satisfy all parts involved. In light of this information, we recommend that Ms. israel and Mr. Geideman explore alternative arrangements that would allow both parties to moor their vessels in a safe and adequate manner without interfering with the adjacent property owners' ability to moor their vessels, and to use the waterway in a safe and adequate manner. 'If necessary, the applicant should reduce the width of the proposed float or may increase the encroachment of the proposed structure in Gull Pond provided the encroachment is not excessive so as to restrict navigational access. It should be noted that any proposed change cannot result in undue interference with navigation to any of the current boat owners. Gull Pon~ ..... Dear Mr. Bredemeyer: We understand that a permit to construct a dock at the above-captioned'location was issued last October, subject to DEC and Corps of Engineer's approval. Please be advised that the Israels' neighbor, Mr. George McGough, is currently trying to resolve major issues with Mr. and Mrs. Israel concerning the siting of their dock. I have been retained by Mr. and Mrs. McGough to assist in the negotiations among the Corps of Engineers, Mr. and Mrs. Israel and Mr. and Mrs. McGough. Early drafts of the plan for the Israel dock would have rendered Mr. McGough's dock useless, and we are working to attain a satisfactory solution to this problem. Mr. Matthew Crane of the Port Jefferson surveying firm of Hawkins Webb & Jaeger is preparing an accurate survey to assist in these proceedings. I do not know whether Southold's procedures call for a reissuance of the permit in a case such as this, so I will inform you when the current dispute is resolved.
