TERMS and CONDITIONS

part of the consideration for the issuance of the Permit do~ understand and p~esctibe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released fz~om any and
all damages, or elnlmq for damages, of suits arising directly or indirectly as a result of any oper-
atlon performed pursuant to this pelmait, and the said Parmittee will, at his or her own expe~se~
defend any and all such suits initiated by third parties, and the said Petmlttee assumes full liability
with respect thereto, ro the complete exclusion of the Board of Trustees of the Town of Son'old
2. That this Permit is valid for a period of 2 4 moo. which is considered to 1~ the
estimated time required m complete the work involved, but should circtunstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that anth-
orizanon was originally obtained.
4. That the work involved will be subject to the inspection and approval of ebe Board ar
its agents, and non-compliance with the provisions of the originating application, ma.v be eanse for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a r~t of the work
herein audaotized.
6. That there shall be no interference with the tight of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstmcuon ro free navigation, the said Permirtee will be required,
upon due notice, to remove or alter this work or projec~ herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee oo the completion of the work auth-
orbed.
9. That the Permktee will obtain ali other permits and consents .~lmt may be required mt>-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Ms. Israel,
Recently we became aware of a problem with the docking situation
at Gull Pond. The current configuration of docks doesn't
conform to permits granted and is a potentially dangerous
situation.
The Southold Town Board of Trustees are requiring all involved
parties to conform to their permits (in regard to dock size and
loc~tion) and to work with this board and their neighbors to
resolve this problem.

The following action was taken by the Board of Town Trustees during
its regular meeting held on October 3, 1991 regarding the above
matter:
WHEREAS, JOHN GEIDEMAN ON BEHALF OF PAULINE ISRAEL applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated August
t2, 1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recorm~endations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 3, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has Considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT JOHN GEIDEMAN ON BEHALF OF PAULINE ISRAEL BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
construct a 4' X 12' catwalk, 3' X 10' ramp, 6' X 20' float.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.

The following recommendations were made by the CAC at its meeting
held Thursday, September 26, 1991:
On a motion by John Holzapfei, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application No. 35-7-4 of Pauline Israel to construct a 4' x 12'
catwalk, 3' x 10' ramp and 6' x 20' float. The CAC suggests everyone
move to their own proper space.

On a motion by Stephen Angell, seconded by Robert Keith, it was
RESOYLED to recommend to the Southold Town Trustees conditional
approval of Wetland Application No.123-3-23 & 24 of Patrick Co]aguiri
to install, from an existing bulkhead, a 3' x 12' hinged ramp leading
to a 6' x 30' float. Float to be secured by two sets of two pile
dolphins. Approval is recommened provided the applicant provides
written permission from the property owner.

On a motion by Bruce Loucka, seconded by Robert Keith, it was
RESOVLED to recommend to the Southold Town Trustees approval
with exceptions of W~tland Application Nee 71-2-8 and p/o 1.3 of
George Koch to repair or replace, in kind, in place, existing bulkhead
return and extend landward to an overall length of 30'. Repair 4' wide
walk landward of bulkhead. Appproximately 100 c.yo of clean sand
for bulkheading. The Council recommends approval of the project
with exception of the fill. The Council objects to the backfill because
it will just wash into the channel.

I am in receipt of your letter dated November 3, 1993.
I am also hopeful that you have become accurately apprised of this
situation and its convoluted details. Perhaps now we can move to
resolve this issue.
Allow me to present the problem as I perceive it. Ail Gull Pond
mooring lot owners realize that their property is on an arc. Each
of us should be able to enjoy not only the twenty feet of.bulkhead
frontage but a similar distance across the back water end of the
mooring area. If that distance is 18, 17 or 16~feet,' so be it, for
one and all! So herein lies the problem. No one really knows
where the apex of~the arc is.
To resolve this situation, Mr. McGough hired a surveyor to protect
his interests. His surveyor's findings differed from that of
Fir. Geideman who is a surveyor, an owner and also representing the
interest of Mr. Israel. Be advised that an on site meeting was
held with Mr. Roberto Barbosa of the Army Corp. of Engineers and
interested mooring lot owners on this very issue.
The outcome was that Mr. Geiderman and Mr. McGough's surveyor were
to determine a mutually agreeable aperture for each of us. Once
this was accomplished all of the floating docks could be accurately
positioned. That meeting was over a year ago with no formal or
informal proposed rendering coming forth thus far.
I too am anxious to demonstrate my willingness to cooperate with
the Southold Board and my neighbors to resolve this matter in a
timely and harmonious fashion.

the docks at Gull Pond. Mr. McGough has asked me to thank you for
your attention to this problem and to extend to you on his behalf
any cooperation you may require.
Last year, Mr. McGough commissioned from Hawkins Jaeger
& Webb a survey of the docks near his parcel on Gull Pond. If this
survey would be useful to you, please call me and I will arrange
for you to receive copies.

Dear Mr. McLaughlin:
The fol!owing is in regards to the subject application to co~strucl~ a pier
assembly in Gull Pond, Gardiners E~ay, at the Town Of Southold, Suffolk County,
New York, and in furtherance to our letter dated June 1, 1993, copy enclosed. _
As stated in our previous letter, this office cannot authorize a proposal that
would result in undue interference with, access to, or use of, navigable waters. For
this reason, it was recommended to Mr. Geideman that an agreement to relocate
the existing structures be attained with Mr. George McGough, Mr. Ralph Grandinetti,
and himself, in a manner that would allow Ms. Israel to install the proposed pier
assembly. -
During a telephone conversation with Mr. Roberto Barbosa of my staff, you
stated that it has been extremely difficult to reach a consensus regarding the
proposed relocation of the structures that would satisfy all parts involved. In light
of this information, we recommend that Ms. Israel and Mr. Geideman explore
alternative arrangements that would allow both parties to moor their vessels in a
safe and adequate manner without interfering with the adjacent property owners'
ability to moor their vessels, and to use the waterway in a safe and adequate
manner. If necessary, the applicant should reduce the width of the proposed float
or may increase the encroachment of the proposed structure in Gull Pond provided
the encroachment is not excessive so as to restrict navigational access. It should
be noted that any proposed change cannot result in undue interference with
navigation to any of the current boat owners.
Once we receive a revised proposal acceptable to the applicant and Mr.
Geideman, we will review such to assess whether such would result in undue
interference with navigation, or it would result on' a safety hazard. If you have any
questions, please contact Mr. Roberto Barbosa of my staff at (21 2) 264-6730.

Please be advised that Messrs. McGough and Israel met over the
weekend and are very close to reaching an agreement as to the
proper placement of the dock. I will inform you of all additional
progress.

On October 7, 1992 this office sent your agent~ John Geid~manr
a notice for construction fees an relation to your dock approval
(copy attached).
As you had previously s~nlitted $240.00 toward.-.this fee when you
suSDmitted your check in the ~ount of $390.00 ($150.00 is the
non-refundable permit application fee) this office did not
properly notify you that only $108o00 in construction fees
r~ain to be paid.
As soon as we receive the $108.00 we shall issue you your per, lit
which will entitle you to proceed legally under chapter 32 of
the To~ Code.
My letter to you of October 7, 1991~ although denoting the
acceptance of your application, is not actually a permit we
apologize for any confusion this may have caused you.

Enclosed is a copy of the Hawkins, Webb & Jaeger Survey.
As you can See, there appears to be a significant difference of
opinion as to the setting of the docks. George McGough is willing
to resolve this matter as conveniently and efficiently as possible.

Dear Mr. Bredemeyer:
We understand that a permit to construct a dock at the
above-captioned location was issued last October, subject to DEC
and Corps of Engineers approval. Please be advised that the
Israels' neighbor, Mr. George McGough, is currently trying to
resolve major issues with Mr. and Mrs. Israel concerning the siting
of their dock. I have been retained by Mr. and Mrs. McGough to
assist in the negotiations among the Corps of Engineers, Mr. and
Mrs. Israel and Mr. and Mrs. McGough.
Early drafts of the plan for the Israel dock would have
rendered Mr. McGough's dock useless, and we are working to attain
a satisfactory solution to this problem. Mr. Matthew Crane of the
Port Jefferson surveying firm of Hawkins Webb & Jaeger is preparing
an accurate survey to a~sist in these proceedings.
I do not know whether Southoldts procedures call for a
reissuance of the permit in a case such as this, so I will inform
you when the current dispute is resolved. You can reach me at the
