Supervisor Scott Russell
SUPERVISOR RUSSELL: Would anybody like to address the Town Board on any issue?
Anne Murray, East Marion
ANNE MURRAY: Anne Murray from East Marion. I feel very lonely here today. Just two
quick questions, I am very confused about the Homeland Security resolution.
SUPERVISOR RUSSELL: Sure. What it is...
MS. MURRAY: Are we getting money, are we giving money?
SUPERVISOR RUSSELL: What it is, is a multi-agency agreement each year to provide patrol
and security of Peconic Bay and including Plum Island. Because of the nature of the Peconic
Bay touching so many jurisdictions, the town and the county work together along with
Homeland Security to assure that not only the bays patrolled and also that Plum Island is secure.
Southold Town Board Regular Meeting
April 5, 2016 page 43
MS. MURRAY: Of course. So are we getting that money from the federal government?
SUPERVISOR RUSSELL: No. Our contribution is our man-power and other agencies, Suffolk
County might qualify for the money as an agency but we actually have an agreement, so we
don't get the money. We contribute to the solution.
MS. MURRAY: I see. So does that mean that there are extra patrols...
SUPERVISOR RUSSELL: Yes.
MS. MURRAY: Using our police department?
SUPERVISOR RUSSELL: Yes. And more or less it's an agreement so that these different
agencies might find themselves working in another agencies jurisdiction, there's an
understanding that that's okay.
MS. MURRAY: Got it. Okay, thanks. And then the other one is, this code enforcement has the
power to issue a stop work order, wasn't that the case before?
SUPERVISOR RUSSELL: No. I will let Bill speak to that.
MS. MURRAY: That seems kind of strange.
TOWN ATTORNEY DUFFY: We had a change in title, so the title code enforcement officer
wasn't including with the ability to issue stop work orders, so I just wanted to clarify that he is
allowed to do that. Because his title changed.
MS. MURRAY: Oh, interesting. I didn't realize that, so now the code enforcement officer can
go anywhere and on the spot, issue a stop work order?
SUPERVISOR RUSSELL: Yes. - -
TOWN ATTORNEY DUFFY: The code previously allowed zoning enforcement officer and
director of code enforcement, it just didn't have the title code enforcement officer.
MS. MURRAY: Okay, good. Thank you.
COUNCILMAN DINIZIO: He can issue stop work orders on anything that he is qualified to, he
couldn't issue a stop work order say on a building permit, unless he was qualified to do so.
MS. MURRAY: So does this mean he can issue a stop work order on pretty much anything
now?
COUNCILMAN DINIZIO: Anything that concerns the code, the town code.
Southold Town Board Regular Meeting
April 5, 2016 page 44
MS. MURRAY: Okay.
SUPERVISOR RUSSELL: Why wouldn't he be able to do a stop work order on construction,
on property under construction without a building permit?
COUNCILMAN DINIZIO: Because the building inspector has certain, you know, he has to
follow certain code rules.
TOWN ATTORNEY DUFFY: This would allow him to issue it because under the code, you
need a building permit, if you don't have a building permit he can issue it. what he couldn't do
is go under the state code and make a determination as to whether a structure is safe or not,
because he is not a building inspector.
SUPERVISOR RUSSELL: Right.
TOWN ATTORNEY DUFFY: But he could do stop work for no building permit.
COUNCILMAN DINIZIO: Right.
MS. MURRAY: I am still confused but okay.
SUPERVISOR RUSSELL: The issue that Jim raised was that he couldn't do anything that he
wasn't qualified to do, the discussion was, can he stop construction when no building permit has
been issued? Bill just said, yes....
MS. MURRAY: And the answer is yes, of course.
SUPERVISOR RUSSELL: And all other zoning issues.
MS. MURRAY: Okay. Thank you: - -
SUPERVISOR RUSSELL: Sure. Any other comments, suggestions or otherwise?
Councilman Dinizio
COUNCILMAN DINIZIO: Yes, I have something to say. I had the privilege of working with
Vicki Toth for a number of years on the Zoning Board and I think that this town is going to
sorely miss the expertise that she brings to that job and I just want to wish her all the luck in her
next endeavor.
Supervisor Russell
SUPERVISOR RUSSELL: Yes, it's going to be a big loss and very, very difficult to fill, I can
tell you right now. Given the knowledge, the insight to codes and everything else, it's not going
to be easy to find someone. Anybody else? (No response)
