Laurel, New York Dear Sir. : I am writing to ;you again as your name appears on the top of the list of signatures on the petition Ite: Mr. James Hurray' s Marina, Brushes Creek., Laurel:, New York. 5ince my letter of August 30th, I have exr rained the Town Trustee records and the Town Boards re;oris and find that on May 1, 19,67a committee was at the trustees meeting to inquire about this marina operation. The .Trustees ,investigated and found that these was no violation of their rules or jurisdictio.I1. The Town Board has not set a speed limit for boats in Brushes' ,Creek up to t''i:s time. I gave at hand a written copy of Mr. Murray' s operation record showing the start of operations in 1931 and names of eleven (i .) people who moved boats there in 1953 and 1957, which would establish his rights to a ffnon-conforming anon-conforminguae u of an eleven boat marina 'without further approval of the Board of Appeals or Town Trustees. Since receiving the petition I ha:Te talked, to Mr. Murray' and he has assured Me that most of the boats now moored at the marina are owned by nearby residents from North Oakwood Road who cannot get in and Out under the present Peconi.o Bay 51vd., Bridger himaerlf' his brother, and one or two who live direo t1y on the 131vd. nearby. 4 (2) As far as the Zoning Ordinance is concerned it makes no difference who owns the boats tied up there, the property has been used for this purpose since 15.1 and the entire frontage on the Water has been used Thr moorings and, launching ramps prior 'to the adoption of the Zoning Ordinance in Apr .'s. 1957. Thus creating a "non-conforming use" which can 'be maintained as long as it 16 not diseontinurd for 4 2 year or longer period. If boats_ using Brushes Creek are operating, neck:LesSl-y or as a nuisance it would not be under the control. of this department, we are only concerned with the use of land and buildings. Terry Died: Sunday, December 17, 2006 Age: 94 Howard M. Terry, a Southold resident, died at San Simeon Nursing home on December 17. He lived in Southold his entire life, except for a few years in the 1920s when he lived in Arizona. Mr. Terry was born in Southold on October 13, 1912 to Mary (nee Monsell) and Howard H. Terry. He attended Southold schools, including the Old Bayview Schoolhouse, and, over the years, had been a farmer, a truck driver, a carpenter and worked on oyster boats.IFrom 1956 until 1977, he was a building inspector for the Town of Southold.1 Mr. Terry was a member of the First Presbyterian Church in Southold, the International Order of Oddfellows, the Building Inspectors Association of Suffolk County, and served on the Civil Defense Commission of New York State. For 76 years, he was an active volunteer firefighter with the Southold Fire Department. There he served as a commissioner and delegate to the North Fork, Suffolk County,and Southern New York Volunteer Fireman's Association. For a period of time, he was a Fire Coordinator for the Eighth Division. Predeceased by his wives, Doris Jones and Katherine Berry, he is survived by four daughters, Jane Joerchel of Calverton, Frances Cooper of Mattituck, Edna Terry of Southold, and Catherine Terry of Mattituck; a sister, Caroline Ross of Prescott Valley, Arizona; and 10 grandchildren. He was predeceased by two daughters, Helen Pontino and Elizabeth Montgomery, and a brother, Jonathan Terry. The family received friends at the DeFriest-Grattan Funeral Homes in Southold where firematic services and IOOF services were held. Funeral services were held at the First Presbyterian church by Rev. Dr. Peter J. Kelley. Interment was at the Presbyterian Cemetery.
