The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000 by the Town Board, and most recently amended by Local Law No. 2010-3, is hereby amended to reflect the extension of a water transmission main to 4735 Cox Lane, Cutchogue. Section 4. Severability. If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. Section 5. Effective Date. This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. I do have here a copy of the notice that was sent to the Suffolk Times and also an affidavit that this has been posted on the Town website and the Town Clerk's bulletin board. And that's it. SUPERVISOR RUSSELL: I would invite anybody that would like to address the Town Board on this particular local law to please feel free? • CHRIS BAIZ: Good evening, members of the Board. My name is Chris Baiz, Town of Southold Agricultural Advisory Committee. The property, the farm property in question here in this proposed local law approached the Agricultural Advisory Committee amongst others to help affect the change for the local extension of the water line to this agricultural property so that it could be used in agriculture. We are, as members of the agricultural community, eager to have the support of the Town Board on this matter. On the other hand, we find it confounding that a local farmer has to pay thousands of dollars per acre equivalent to hook the property up to meet some incredibly over-wrought water convention that suggests that this is commercial activity as opposed to agricultural activity. We also note that the Suffolk County sanitary code makes no distinction other than for residential or commercial and does not provide opportunity for an agricultural designation and if we are to continue to have agriculture as a mainstay of our community in the Town of Southold and as mainstay of our economy. These kinds of overzealous outside requirements for the agriculture industry will drive it out of business. However, in this case, it is important to get this local law passed with your approvals, so that the agricultural operation at that site can move forward and be a successful addition to the agricultural section of this economy. We, at 8 Hands Farm on 4735 Cox Lane, have been working with the Suffolk County Health Department (SCHD) for the past 14 months in order to obtain a wastewater permit. Such permit is necessary for us to expand our agricultural business with an Ag& Markets 20C kitchen and cheese making facility. This expansion is necessary for us to remain in business and thrive within the North Fork economy. However, accordingly to SCHD code, public water is deemed available (within a prescribed distance to the farm) and is a requirement for us to obtain approval of our wastewater application. After lengthy discussions and many legislators and officials getting involved, it was determined that public water hook-up would be necessary. Based on this determination,we have requested that the Town revise its public water map to include our property at 4735 Cox Lane. This revision will allow us to hook up to public water, at our expense, and continue to expand our agricultural endeavor in the Town of Southold. We respectfully request the Town's support and revision of the public water map.
