Dear Mr. Iavarone:
The following action was taken by the Board of Town Trustees
during its regular meeting held on March 27, 1996 regarding the
above matter:
WHEREAS, PAT J. IAVARONE applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated February 13, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings a/Id
recommendations, and
WHERLEAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 27, 1996, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and'are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit for
existing ill' bulkhead with a I0' return on west 'side,' stairs,
4' X 100.' dock, deck, 8' X 12' cabana and to constrt[ct a 60'
retaining wall with 8' return on east side SUBJECT TO the waste
pipe and shower being removed within 60 days._ Shower. can be
moved up by house. Locate~ 995 West Road, C~tchogue.
and,
BE IT FURTH~ RESOLVED that ~h~$ determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees mu_st be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held March
25, 1996 the following recommendation was made:

Moved by Allan Connell. seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees
CONDITIONAL APPROVAL of the Wetland Application of PAT J. IAVARONE
110-7-3 to obtain permit for existing 111~ bulkhead with a 10' return on west
side, stairs, [[~ x 100~ dock, deck, and 8~ x 12~ cabana and to construct second
bulkhead, approximately_ 60~ long and 6~ high with an 8= return on east side.
The Council recommends approval of the retaining wal provided the
applicant is fined for construction of the bulkhead without a permit. The CAC
also suggests the Trustees require the shower water be disposed of
appropriately into the ground.

CONSERVATION ADVISORY COUNCIL
At a meeting'of the Southold Town Conservation Advisory Council held Monday,
February 26. 1996 the following recommendation was made:

Moved by Kenneth Meskill, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Grandfather Permit Application of PAT J. IAVARONE
for a grandfather permit for existing bulkhead (110' long with 10 return on
west side), dock (100~ long) and cabana with stairway. Also requests
amendment to grandfather permit to allow second bulkhead approximately 60'
long and 6j high with a 8' return on east side.
The CAC recommends the applicant be fined for already completing the
work on the bulkhead without first obtaining a permit. The CAC feels a full
permit application is required for the retaining wall; it cannot be
grandfathered because it did not previously exist. The CAC also suggests the
Trustees require the shower water be disposed of appropriately into the ground
and have the pipe onto the beach removed.

amendment as Larry Turtle has described/n his application. I have been/n contact w/th
Larry to send you an Affidavit stating the described items as pre-existing 1975.
He w/ll forward the affidav/t directly to you. The pictures that I have do not clearly
designate the year they were taken. The one picture I have ora man in knickers at the
house does not show the bulkhead because of the angle it was taken.

Dear Mr. Lister;
To bring everything at my home on 995 West Road to code I am
filing for a permit for the existing dock and bulkhead. I am also
requesting to construct and second bulkhead approximately
seventy feet long behind and above the existing one so as to protect
the existing cabana from the severe grade of the lawn. As the town
has requested, I am sending this notice to all adjacent property
owners. Enclosed is a sketch from Larry Turtle of the proposed
changes.
