That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit,and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents,and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. , 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if,in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 77,276 sq. ft. or 1.77 acre parcel in the R40 zone district with 176.55 ft. of frontage along Peconic Bay Blvd to the north; 163.18 ft. along Peconic Bay to the south; 495.29 ft. along the easterly property line; and 467.75 ft. along the westerly property line. It is improved with a 2 story frame house and a frame garage, as shown on the survey by John C. Ehlers Land Surveyor last dated 10-20-2015. BASIS",OF APPLICATION: Request for Variance from Article III Section 280-15F and the Building Inspector's November 9, 2015 Notice of Disapproval based on an application for building permit for accessory in-ground swimming pool, at; 1) proposed in location other than the code required rear yard or front yard on waterfront property. RELIEF REQUESTED: The applicant requests a variance to locate an in-ground swimming pool in a side yard location, where the code requires a front yard or rear yard location on waterfront properties, as shown on the survey/site plan prepared by John C. Ehlers, L.S., dated 08-20-2015 and last revised 10-20-2015 to show proposed pool location. A Page 2 of 3—March 3,2016 ZBA#6913—O'Toole SCTM#1000-145-2-6 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 22, 2016 submitted a plan increasing the side yard setback from 10.2 ft. To 16 ft. where the code requires a minimum of 20 ft. side yard setback while maintaining a proposed 84 ft. bulkhead setback, thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: A letter was received from the adjoining property owner to the west, most directly affected, in opposition to the proposed location. Through personal inspection of the neighborhood by the Board Members, it appears that the adjoining property to the west also has an in-ground swimming pool in a side yard location.Another letter was received from a property owner to the north stating that he has no objection to the relief sought. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4,2016,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are customary accessory structures to residential properties and the alternative relief for a minimum 16 foot setback from the side yard will create an adequate buffer. The adjoining property to the west also has an in-ground swimming pool located in a side yard and the side yard setback of the principal dwelling is 16 feet to the adjoining property line. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for -the applicant-to_pursue, other than an_area variance.The applicant could construct_an in-ground swimming pool in a conforming front yard location on this waterfront parcel; however that would require the removal of many large mature trees whereas the location granted by alternative relief would require the removal of one mature tree and a few smaller ones.There is no location in the rear yard that would not require a bulkhead setback variance. 3. Town Law $267-b(3)(b)(3). The alternative relief variances granted herein for a side yard location and a 16 foot minimum side yard setback are both mathematically substantial, representing 100%relief and 20%relief from the code, respectively. However, the adjoining property to the west has an in-ground swimming pool located in a side yard and the principal dwelling has a 16 +foot side yard setback at the adjoining property line. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an in-ground swimming pool in a side yard location, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to DENY as applied for, and GRANT THE RELIEF AS AMENDED as shown on the Survey/Site Plan prepared by John C.Ehlers, L.S. last revised 2/18/2016.
