with the ECl_ alt applicable regulations, the General Conditions specified (See Reverse Side) and any Special

GENERAL CONDITION S
Inspections
1. The aermitted site or facility, including relevant records is subject to inspection at reasonable hours
and inter/als by an authorized representative of the Department df Environmental Conservation tthe
Department) to determine whether the aermittee is comolying with this permit and the ECL. Such
representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3~. A coby of
this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the prolect site. Failure to produce a copy of the permit
upon request by a Department representative is e violation of this permit~
Permit Changes and Renew~is
2. The Department reserves the right to modify, suspend or revoke this permit when:
a) the scooe of the permitted activity is exceeded or a violation of any condition of the permit
or provisions of the ECL and pertinent regulations iR found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) ne,,v material information iS discovered: or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.
3. The permittee must submit a separate writt~-.,.n application to the Department for renewal, modifica-
tion or transfer of'this permit. Such applic;¢ion must include any forms, fees or supplemental infor-
mation the, Department requires. Any renewal, modification or transfer granted by the Department
must ce in writing.
4. The permittee must submit a renewal appt;,cation at least:
a) 180 days'before expiration of permits for State Pollutant Discharge Elimination System fSPDES),
Hazardous Waste Management Facilities (HWMF"), major Air Pollution Control IAPC) and Solid
Waste Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Department. issuance of this permit does not modify, sup,~rsede
or rescind any order or determination previously iss'ued by the Deoartment or any of the terms, con-
ditions or requirements contained in such order or determination.

Legal Obligations of Permittee
The permittee has accepted expressly, by the execution of the application, the full legal responsibili-
ty for all damages, direct or indirect, of whatever nature and Dy whomever suffered, arising out of
the project described in this permit and'has agreed to indemnify and save harmless the State from
suits, actions, damages and costs of every name and description resulting from this project.
This ~ermit does not convey to the permitlee any right to tresoass upon the lands or interfere with
the riparian rights of others in order to oerf~'rn the cermitted work nor does it authorize the impair-
ment of .any rights, title, or interest in real or personal property held or vested in a person eot a par~y
to the permit.
The perrnittee is resoonsible for obtaining c,¢~y other permits, ao¢rovals, lands, easements and rights-
of-way that may be required for this prolec:.

SPECIAL CONDITIONS
A copy of this permit with supplementary conditions and
approved plans must be available at the project site
whenever authorized work is in progress.
The permit sign enclosed with the permit or a copy of
letter of approval must be protected from the weather
and posted in a conspicuous location at the work site
until completion of authorized work.
At least 48 hours prior to commencement of the project,
the permittee must complete and return the top portion
of the enclosed receipt form certifying that he is
fully aware of and understands all provisions and
conditions of this permit. Within one week of
complstion of the permitted work, the bottom portion of
that form must also be completed and returned.
If the permittee intends to undertake any project
design modifications after permit issuance, the
permittee must submit the appropriate plan changes for
approval by the Regional Permit Administrator prior to
undertaking any ~uch modifications. The permittee is
advised that substantial modification may require
submission of a new application for permit.

SPECIAL CONDITIONS
For Article 25 [ ~£dal 1~etlau~ts
All repairs to existing structures are confined to
replacement of existing structural elements with no
chance.in design, d~mension ?r material~ unless
SPecifically authorized herein.
Constructio~n of bulkhead and return walls must be
completed prior to placement of any fill material
behind such structures.
Use of timbers (wood) treated with pentachlorophenol is
strictly prohibited.
All fill must be from an aFproved source and consist of
clean gravel and soil. Us(;. of asphalt, slag, flyash,
broken concrete or demolition debris is prohibited.
Ail fill must be graded to match the elevation of the
land immediately adjacent to the bulkhead.

Contamination of tidal wetlands and the waters of New
York State by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete,
leachate or any other environmentally deleterious
materials associated with the project is prohibited.

Any debris or excess material from construction of this
project must be immediately and completely removed from
the adjacent area and disposed of at an approved upland
site. Disposal of debris in tidal wetlands is
prohibited.

Any bulkhead constructed ~5.rectly adjacent to vegetated
tidal wetlands is to be je~ted in with minimal
disturbance to the tidal wetland. Trenching is
strictly prohibited.
13.
unless specifically authorized, there shall be no
dredging or excavation in 'the area seaward of the
bulkhead to regain lost fill.
14.
Prior to the ultimate expiration of this permit, the
permittee will cause all fill and exposed faces to be
vegetated to prevent erosion.
15.
The permittee may install a stone "scour pad" to
protect the bulkhead backfill in case of overwash.. The
scour pad shall consist of a minimum 1 foot layer of
cobble size stone set on filter fabric.

The granting of this permit does not relieve the permittee of the
respofis~b~lity Of o~taining a gra~t, easement, or other necessary
approval frO~ the D~visios of Land Utilization, Office of General
Servfees~ ower Build~ng, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.
