Box 188 Orient, NY 11957 RE: HULSMANN LIVING TRUST C/O ROBERT & ANN HULSMANN 1290 WILLOW TERRACE LANE, ORIENT SCTM# 26-2-24 Dear Mr. & Mrs. Hulsmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 19, 2014 regarding the above. matter: WHEREAS, HULSMANN LIVING TRUST C/O ROBERT & ANN HULSMANN applied to the Southold Town Trustees for an Amendment to Wetland Permit #5-88-26-24 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and for a permit under the provisions of Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated February 14, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 19, 2014, at which time all interested persons were given an opportunity to be heard, and, 2 • • WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of HULSMANN LIVING TRUST C/O ROBERT & ANN HULSMANN for an Amendment to Wetland Permit #5- 88-26-24 and for a Coastal Erosion Permit to excavate on landward side of existing 132' long bulkhead; add vinyl sheathing, replace all dead-men, lay logs, and tie-rods; add new face piles adjacent to existing face piles, add 4"x6" clamp timber, new 2' wide timber cap; and maintain a 15' wide non-turf buffer along the landward edge of the bulkhead; and as depicted on the site plan prepared by Ian Crowley, last dated September 11, 2013 and stamp approved on March 19, 2014; and as also depicted on the survey prepared by John C. Ehlers, Land Surveyor, last dated October 31, 2013 and stamped approved on March 19, 2014. Permit to construct and complete project will expire two years from the date the permit is signed. In the matter of the application of Latham Sand & Gravel, Inc. 'on behalf of Robert Hulsman to construct 135 ft. of timber bulkhead and to backfill from an upland source. Property is located` on 'Willow Terrace, Orient.' Present were: President John M. Bredemeyer, Vice-President Albert Krupski, Trustee John Bednoski, Trustee Henry P. Smith. Trustee Bredemeyer: Is there anyone here who wishes to speak on behalf of this application? No response. Is there 'anyone here who wishes to speak against this application? John Holzapfel, Chairman of the Conservation Advisory Council: I would like to point out that the Conservation Advisory Council is against putting the bulkhead up there. They felt that it was not an absolute necessity. Trustee Bredemeyer: Okay, is there any other discussion on this application? Trustee Krupski: Yes, I would like to comment. The D.E.C.'s position of establishing a solid line there seems like an excuse to extend the property out further there. The further you extend the property out into the bay the more problems you will have in the future. Trustee Bredemeyer: It wasn't actually extended into the bay, it was landward of high water. Trustee Krupski: To bad there wasn't someone here to discuss this application Mr. Hands: I'm an adjoining property owner there. In fact, there are a few of us that are awaiting this because we would like to put in bulkhead also. There is any existing bulkhead there by the Sagalister's which is about I would say, 4 or_5ft. above the high water mark. Even when the hurricane came, a few years ago the tide hit it and it sprayed but it did not come over the bulkhead. Ar an adjoining property owner, we are loosing that bank.` - Trustee Bredemeyer: It is a toe failure situation. Mr. Hands: We are loosing property every year. Trustee Krupski: That is apparent. In my mind about the need. The D.E.C. did not find any need for erosion. John Holzapfel: Again, we were not in favor of bulkheading. Rip-rap would have been our choice again. Just to break the wave action. It was not that we were against the bulkhead. It is erosion, there is not doubt about that. Trustee Bredemeyer: We voted for a rock revetment for one of the neighbors. Then we heard that there may be C & R's in that subdivision against using anything but bulkheading. I'don't know if it is true, it wasn't verified? We 'did call the D.E.C. to ask their position and they indicated that they would perfer to have a unit structure because of reflected waive energy. The Trustees inclination was to try to have a bulkhead as close to the toe of the bluff as possible. John Holzapfel: Now did they tell you to make it one solid, line, or to indent it? I haven't heard this? John Bredemeyer: I have the name, it was Suzanne Rohl, Coastal Erosion Section, she advised us to determine its compliance with flood plain regulations and they wanted permit consistency with the existing permits that were let for the neighboring lots. They were concerned that a failure would lead to a failure of all the neighboring lots particularly if they were bulkheads. That is why they wanted a stable line. - This is border line on a fairly high wave energy area. They felt that it was a substantial enough structure was there, "like the Sagalister's, and they felt this kind of construction was good, but if it was not placed in line it would not be good. Mr. Hands` There are five of us that are interested in the bulkhead. It is my understanding that the bulkheads have D.E.C. approval and with their approval the rest of us can kind of.. - Trustee Krupski: How long, ago did the Sagalister's have that bulkhead. Mr.Hands: Somewhere between 15 and 20 years. Trustee Bredemeyer: I don't believe it was quite that long. I think it was 10 or 12? Mr. Hands: No, it was longer than that. The house was built and then the bulkhead was subsequently built. Trustee Bredemeyer: Maybe 15 years? Mr. Hands: I would say 15 easy, and that can be proven. Trustee Bredemeyer: Sure. Mr. Hands: What you have is Bob Douglas who has the big stone wall, rock and everything else that swings back in. We are not asking to go' out into the water. I am not representing the Hulsman's, I'm just an interested party. Trustee Bredemeyer: Maybe the interests of the D.E.C. could be met by attaching to the Sagalister's and then bringing back at the caster end as close to the toe of the bluff so that we don't continue the line that much more seaward from what the toe is presently. Trustee Krupski: I'm not comfortable with a solid structure. I would rather see the rock revetment. I would rather see that continued. It doesn't matter if one area is out a little more than the other, that wave energy instead of being reflected the wave energy is absorbed by the surface of the rock. I don't know if you are familiar with the rock revetment? Mr. Hands: I'm not. My `question is what is wrong with the structure that is there? Trustee Krupski: The bulkhead represents a very solid structure. When the wave energy hits it, it is deflected down and it scours out the beach, in front of it Mr. Hands: I have lived; there for a long time. Trustee Bredemeyer: In any case why don't we close the discussion and recess this hearing.
