SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance to the Flag. Thank
you. Before we get to the business of the regular meeting, I would like to take a moment to
present a proclamatiori to someone who has certainly made a huge commitment to this town and
dedicated an awful lot of her time with her, knowledge and generosity and her hard work.
Margaret, will you please come up? On behalf of this entire Town Board, `Whereas Margaret
Brown has served as Commissioner on the Southold Transportation Commission from 1992 to
2016; and whereas as a founding member of the Commission, Margaret was actively engaged in
the North Fork Trail Scen�ic Byway designation; Southold Bicycle Seaview Trails creation; �
Southold Causeway Resource Protection Project; Scenic Southold Corridor Management Plan;
Southold Scenic Byway Interpretive,Signs Project; Susfainable East End Development Strategies

Study; Volpe East End Transportation S'tudy and the Five Towns Rural Transit Plan; and
whereas Margaret's enthusiasm, dedication, vision, wisdom in both good times and bad, and
strong, insightful participation will be strongly missed; and whereas Margaret has tirelessly ,
devoted an enormous amount of her time and talent for the benefit of the residents of Southold
Town; now therefore be it resolved: that the Town Board of the Town of Southold hereby
extends our sincere appreciation and gratitude to Margaret S. Brown for her many years of
devoted service as a Commissioner of the Southold Transportation Commission' I have to tell
you, I have had the pleasure of getting to know you very well in my 10 years here, working
alongside of you, it has been an honor working with you.
MARGARET BROWN: Thank you. Thank you very much. This is very, very nice.
SUPERVISOR RUSSELL: Thank you. Bob?
COUNCILMAN GHOSIO: As the liaison to the Land Preservation Committee, it came as a
shock last week to learn that one of the members of the Committee, Maureen Cullinane,
suddenly passed away and as a result of that, because of all the good work that Maureen did for
the Town, I just want to take a moment to read a brief statement in her honor. The Land
Preservation Committee, members of the Land Preservation Department and the Town Board of
the Town of Southold mourn the sudden loss of our valued friend and colleague, Maureen
Cullinane who passed away Marcli 7th. I would like to take a moment to recognize_her
contributions. Maureen sold the development rights to her 30 acre farm in 2002 and had
generously donated her time and talents to the town and its residents as a faithful member of the
Land Preservation Committee since January of 2008. She also served as a member of the Land
Preservation Stewardship Committee and as a member and president of the North Fork Audubon
since 2001. As a farmer and landscaper, Maureen specialized in native plantings and in her free -
time, she developed bird and butterfly gardens with students at the Oysterponds School and
established gardens at the North Fork Audubon and the North Fork Environmental Council.
Maureen also shared her extensive knowledge of the natural world from her column in the
Suffolk Times from 2003 to 2007. In addition, she had served her community as a member of
' the Orient Fire Department since 2003. For Maureen Cullinane's extensive contributions and
legacy of public service and generosity to the Town of Southold and its people, it is with sincere �
gratitude for her selfless service and untiring efforts to preserve, protect and restore the land in
the Town of Southold and it is with great sadness that I ask for a moment of sadness in her
honor. Thank you.

2016 Spring Clean Up
RESOLVED by the Town Board of the Town of Southold that the Highway
Department Spring Cleanup will start on Monday, April 11, 2016 in Laurel.
Our Highway crews will remove only BRUSH and LEAVES and work in an
Easterly direction until they reach Orient Point. All Leaves Must Be In Bio-
Degradable Paper Bags, NO EXCEPTIONS. We can only pass through an
area once; be it further �

RESOLVED that the Town Board hereby authorizes the acceptance of
residential leaves and brush (free of char�e for five weeks), at the Southold
Town Compost Facility in Cutchogue. This five-week grace period is for those
homeowners who wish to take their leaves and brush directly to the Town's
compost site, provided that they have the applicable sticker. The �race period
will start Sunday, April 3, 2016, and end Sunday, May 15, 2016; be it further
RESOLVED that commercial landscaping and tree removal companies will no
longer be permitted to deposit any loads of branches or yard debris for removal
in the Town's right-of-way. It will be the homeowner's responsibility to make
certain that their contractor(s) haul their yard debris to the Cutchogue Compost
Facility as anyone caught dumping in the Town right-of-way will be fined for
illegal dumping; and, be it further
RESOI,VEI) that the Fishers Island Sprin� Clean-Up will also commence on
Monday, April 11, 2016.
I2ESOLVED that the normal tip fees for brush disposal at the Cutchogue Compost Facility shall
be waived for residential vehicles for the period Apri13, 2016 through May 15, 2016; and that tip
fees for brush shall be reduced for commercial vehicles to $30/ton during the same period; and
be it further
RESOLVED that for the purposes of this resolution, residential vehicles shall be defined as any
vehicle with a resident disposal permit issued by the Town Clerk of the Town of Southold
carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle with a less than one ton carrying capacity (including trailers); and that commercial
vehicles shall be defined as any vehicle with a commercial disposal permit issued by the Town
Clerk of the Town of Southold, or for vehicles without a permit, any vehicle with a carrying
capacity of one ton or greater; and be it further
1�ESOLVED that the tip fee waiver/reduction described herein shall not apply to stumps of any
type; and that it applies to the charge for the weight of the debris ONLY, and not to single entry
fees for vehicles without permits, which will still be charged as appropriate.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent.
This Local Law proposes to amend the Town of Southold Water Supply Plan Map to
include the extension of a water transmission main to 4735 Cox Lane in Cutchogue.
Historically,the Water Supply Plan Map reflects the physical changes in the water supply
network since 2000. The property owner has represented to the Town that the Suffolk County
Department of Health Services has denied his application to install a private well. The extension
of the transmission main is intended to supply the subject property and is not intended to result in
additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services, and upon our consideration of the recommendations of the Town
Planning Department, and the public comments talcen at the public hearing, we hereby amend the
Town of Southold Water Supply Plan Map to include the extension of a water transmission main
to 4735 Cox Lane, Cutchogue.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Local Law No. 2010-3, is hereby amended to
reflect the extension of a water transmission main to 4735 Cox Lane, Cutchogue.
Section 4. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

this has been posted on the Town website and the Town Clerk's bulletin board. And that's it.

SUPERVISOR RUSSELL: I would invite anybody that would like to address the Town Board
on this particular local law to please feel free?
Chris Baiz,Agricultural Advisory Committee
CHRIS BAIZ: Good evening, members of the Board. My name is Chris Baiz, Town of
Southold Agricultural Advisory Committee. The property, the farm property in question here in
this proposed local law approached the Agricultural Advisory Committee amongst others to help
affect the change for the local extension of the water line to this agricultural property so that it
could be used in agriculture. We are, as members of the agricultural community, eager to have
the support of the Town Board on this matter. On the other hand, we find it confounding that a
local farmer has to pay thousands of dollars per acre equivalent to hook the property up to meet
some incredibly over-wrought water convention that suggests that this is commercial activity as
opposed to agricultural activity. We also note that the Suffolk County sanitary code makes no
distinction other than for residential or commercial and does not provide opporlunity for an
agricultural designation and if we are to continue to have agriculture as a mainstay of our
community in the Town of Southold and as mainstay of our economy. These kinds of
overzealous outside requirements for the agriculture industry will drive it out of business.
However, in this case, it is important to get this local law passed with your approvals, so that the
agricultural operation at that site can move forward and be a successful addition to the
agricultural section of this economy. Thank you.

BILL SHIPMAN: Bill Shipman, 75 Horseshoe Drive Cutchogue. The first thing I wanted to
know is if the 2012 Supreme Court injunction is against the vineyard on Route 48 called
Vineyard 48 regarding their site plan, is that still enforced?
SUPERVISOR RUSSELL: I am going to ask Bill.
TOWN ATTORNEY DUFFY: Yes, it is still in effect.
SUPERVISOR RUSSELL: It is still enforced.
MR. SHIPMAN: Okay, so from our discussion the last time I was here, Jim, we were talking
about mechanisms in place to enforce this. So do we think that we have this in hand where we
are going to enforce this?
COUNCILMAN DINIZIO: All it takes is a call.
MR. SHIPMAN: Okay, so what I wanted to get across and I am glad there's new mechanisms in
place but there were old mechanisms in place that failed to address these. The old mechanisms,
as I understand them, obviously through word of mouth, through various members of the police
department was if you filed a code violation, the code enforcement officer would come, when we
had one, if we had one. If they were unavailable on a weekend, which obviously this is the time
that most of these things occurred, that the bay constable would respond and take that report but
usually before that particular time on the days the bay constable wasn't there, so then the police
would respond and then take the report and then hopefully forward the report to the town code
where it would be addressed, since the town code enforcement didn't work on the weekends at
the time. So that didn't happen. I have, my police reports from September of 2013, complainant
wanted it recorded that there was approximately 60 vehicles parked at this vineyard when the
limit is 34 vehicles. So we failed to enforce a State Supreme court order that was put into effect
to help us enforce this. So now that hopefully we have better mechanisms, that will work. And
now moving on to, I have asked for targeted enforcement in the particular area and usually the
response was that we will respond accordingly and address those issues. So as of right now,jttst
within the last 10 days, the district attorney confirmed that he is charging somebody with a crime
that was committed in that area and on that particular day that that crime happened, another
person was charged with a crime of DWI which is technically a traffic violation. So those crimes
happened in that area. Prior to that, the motor carrier came out after that accident and they also
confirmed with violations and equipment violations, that those particular actions were occurring.
And in between September 2011 and 2015, numerous people, myself mostly, complained about
these actions occurring in this particular location. So this is something that we have been
complaining about for extended time. So it was never addressed or it was addressed
intermittently. So those crimes are happening, those motor vehicle violations, which are in turn
turning to crimes when tragedy happens, it's occurring. It's there. so I was again, coming to you
and asking for target enforcement in this area for those particular violations that are occurring
which led to crimes and I pretty much want to find out from the Town Board and or the Town
Attorney and or the Police Department what your enforcement actions plan is going to be? And

you can tell me that it's all in litigation, and its top secret but you know what? We are the
victims, so it is not top secret anymore. People want to know and then I don't have to come here
and ask questions of why certain things are enforced or why certain things aren't enforced. I can
keep my mouth shut, I am a big boy, but if you don't tell the people in that particular area what's
happening after an extended time, that it's not a sting operation or whatever, then we come here
asking these questions continuously, so I was looking to get a little bit of feedback on that. I feel
like I am talking to myself a lot when I come here.
SUPERVISOR RUSSELL: Then I will be happy to talk.
MR. SHIPMAN: Because nobody wants to....
SUPERVISOR RUSSELL: What's the nature of the violations now? Over capacity on parking?
MR. SHIPMAN: Well, that's part of the violation. The other violations are when a moving
vehicle fails to yield the right of way.
SUPERVISOR RUSSELL: Well, that's a V & T. Okay. Specific to the facility, it's over
parking?
MR. SHIPMAN: The facility, yes.
SUPERVISOR RUSSELL: That's the violation on site for that facility, is over-parking?
MR. SHIPMAN: Well, you have got a Supreme court injunction, so obviously....
SUPERVISOR RUSSELL: Sure. Okay.
MR. SHIPMAN: The Planning Board was telling the Town Attorney's office that they are
violating that town code.
SUPERVISOR RUSSELL: Okay, that's the nature of the violations now, over-parking on site.
That's essentially the...
COUNCILMAN DINIZIO: Well, there hasn't been a complaint. Like last weekend....
MR. SHIPMAN: Jim, I have been coming here for four years.
COLTNCILMAN DINIZIO: No but remember the last time that we met?
MR. SHIPMAN: Yeah.
COUNCILMAN DINZIO: I said we hired 8 new police officers...
MR. SHIPMAN: I totally get that.

COUNCILMAN DINIZIO: But have you complained yet this year?
MR. SHIPMAN: No, because the violation is there. But I want to know that because last four
years, nobody told you if what was coming or going.
COIJNCILMAN DINIZIO: Well, the last four years we didn't have the new police officers and
we didn't have one and a half code enforcement officers. One which works on weekends.
MR. SHIPMAN: And I totally get that, I am just trying to be a little proactive which I would
have thought that hopefully the town would have been a little more proactive...
COUNCILMAN DINIZIO: Well, we are. Bill, we are.
MR. SHIPMAN: And I am not saying they are not....
COLTNCILMAN DINIZIO: Inaudible. Let's see how it works. I mean, the Town Attorney will
tell you how he has that set up. My impression is that if you call, it doesn't go to the police
anymore, it goes to a member of the Town Attorney's office that responds, on weekends, on
Friday nights when it needs to happen because that is what was lacking before. And let's see
how far that goes.
MR. SHIPMAN: Right.
COLTNCILMAN DINIZIO: I mean, you can't ask us to fix what happened...
MR. SHIPMAN: No, I am just asking if this happens, that there's a plan, that something is going
to happen because one person is telling you this and another person is telling you it is going to
work and you ask the person, you know, is that special detail coming like somebody said and
well, I didn't hear anything about it.
COLTNCILWOMAN DOHERTY: If you call your normal call to the police station, they will
refer it to the code enforcement officer, who will then in turn come out. We have somebody on
call on the weekends, if that code enforcement officer needs back up, that person can also have
police officers for back up.
MR. SHIPMAN: Okay.
COLTNCILWOMAN DOHERTY: So there will be somebody available seven days a week to go
to that call.
MR. SHIPMAN: And onto the traffic conditions that exist between approximately 3 and 6 at
that particular location, that particular time on those particular days.
COLTNCILMAN GHOSIO: I have noticed a much larger police presence on Route 48 in
general.

MR. SHIPMAN: Yeah, I know but we are not into the season yet and trust me, I do understand
that but in the past it was tremendously lacking.
SUPERVISOR RUSSELL: We are adding a second highway patrol officer.
MR. SHIPMAN: I heard that, yeah.
COIINCILWOMAN DOHERTY: We have.
SUPERVISOR RUSSELL: We have already? He is up and running?
COUNCILWOMAN DOHERTY: He's been up and running for a while, yes.
MR. SHIPMAN: So obviously there will be a hopefully a better response and a plan to deal with
certain traffic issues of extended type vehicles blocking a 55 mph zones.
COiTNCILWOMAN DOHERTY: We hope so.
SUPERVISOR RUSSELL: Just to separate the issues for a second, let's talk about the site, the
on-site violations of the (inaudible), at what point do we violate if there's permission for 34 cars
and they have 40? Is that a violation?
MR. SHIPMAN: Sure. I am not that picky type of person but the complaint that I did file at that
particular time was that they are in excess of 60 vehicles on site.
SUPERVISOR RUSSELL: How about recently?
MR. SHIPMAN: No, not recently. I am just saying in the past because the majority of the
problems that weren't addressed in the past are the ones that I am asking and hopefully they are
going to be addressed...
SUPERVISOR RUSSELL: Which we are all now geared up to address.
MR. SHIPMAN: Since we have the new mechanisms in place.
SUPERVISOR RUSSELL: That's right.
MR. SHIPMAN: So I guess we can agree that hopefully the new mechanisms will deal with
that.
SUPERVISOR RUSSELL: We put everything in place now, sure.
MR. SHIPMAN: Okay. So, were you aware that there was a decision on the state liquor
authority appeal?

MR. SHIPMAN: What about the cigar shop that's on site? That was discussed in the Zoning
Board of Appeals.
SUPERVISOR RUSSELL: I thought that was already mothballed? That was already
mothballed. That is not a permitted use...
MR. SHIPMAN: It's a permitted use there?
SUPERVISOR RUSSELL: No, it's not a permitted use and that was already mothballed from
our understanding.
MR. SHIPMAN: Really. And if it's not, that should be addressed a town code meeting?
SUPERVISOR RUSSELL: Oh, immediately. Absolutely.
MR. SHIPMAN: So that facility,that building shouldn't be used for a retail of tobacco items?
SUPERVISOR RUSSELL: Of cigars? No.
MR. SHIPMAN: Okay. When was that mothballed?
SUPERVISOR RUSSELL: It was negotiated as part of a, it was a while ago.
TOWN ATTORNEY DUFFY: Since I have been here.
COUNCILWOMAN DOHERTY: Yes, it was before Bill.
COLTNCILMAN GHOSIO: I don't remember it being opened this summer. The cigar shop? I
used to go there and get cigars. It wasn't open last summer.
MR. SHIPMAN: Saturdays.

Saturday's, we have someone that can go there now. We put everything in place.

SUPERVISOR RUSSELL: Who else would like to address the Town Board on any issue?
Beth Shipman, Cutchogue
BETH SHIPMAN: Beth Shipman. 75 Horseshoe Drive Cutchogue. I just wanted to clarify
because Bill said it had been a while, on October 24, 2015 I actually called and at that point in
time, I was told that we did have the new town code enforcement officer. And I called Southold
Town and I asked for somebody to come down because not only were they over the 34 vehicles
at the front of the property that was visible, they were also parking off premises, dropping people
off and going and parking off premises, over at Schulman's barn and over on Commerce Drive.
And as well as in the parking lot at Our Lady of Ostrabrama. What happens when they do that,
is that's when they are looping around, so the traffic where they are making those three point
turns because these vehicles really are incapable of making a continuous U turn, so there is a
direct correlation to the unsafe traffic conditions that they are causing and the business itself.
My understanding is that the reason we have the 34 vehicle limit on them is so that, that
correlates to their occupancy and how many people are supposed to be on premise at one time.
That's supposed to help keep the numbers down which when you are parking off-site,
completely mitigates that. as well as the fact that when I did call that day, the back parking lot,
which is not a legal parking lot which if you remember, they came to you for the site plan
adjustment and asked for the parking lot in the back and it was denied, they are using that. I
have pictures of it where they have at least 40 cars on that date and I called and I was told that
the town code enforcement officer was unavailable. I spoke with a dispatcher who suggested
that I speak with the sergeant on duty. I did get a phone call from Sergeant Santacroce. And he
had no answer for me, he had no town code enforcement officer to go to. He said he tried to
reach multiple times on the cell phone and was unable to get through. So nothing actually
happened on that date. But I do have the pictures from that date. It is ongoing, even sadly, after
this accident. On, you know, in September with the four young ladies that passed. These
vehicles are still making these turns, which is really hard to believe that given what they know
and what they have to know, I mean, I am not a commercial driver, I know what my vehicle is
capable of and god bless them if they don't. Because that is just idiocy. They have to know
what their vehicle is capable of doing and what it's not capable of doing and their vehicles are
not capable of making these turns and yet they continue to do that. We got the traffic light. The
traffic light really doesn't address these vehicles. These vehicles still are unable to make the
turns and they are still attempting to make the turns. That light without a green arrow, gives
them zero opportunity to go through that intersection in the direction that they want to go in, as
opposed to the safe direction of traffic without the other, you know, eight lanes of traffic moving,
so they are still going to do the same thing and that's really what I would beg of this Town Board
and Southold Police Department to look for. To enforce. I mean, when we say that we need a
targeted enforcement in that area, we really do. We are going to be in the same boat again, we
are going to lose more lives if this is not addressed and it is a sad, sad situation. And the fact that

we have been coming since 2011 really makes me sick. So I wish you all a good night and I
really hope that you take to heart what I am saying to you. I really do.

THERESA WARD: Hi, my name is Theresa Ward and I am renovating a property on Ackerly
Pond Lane and I have a request in to amend the water map as well and I just wanted to see if that
is going to be discussed tonight?
SU'PERVISOR RUSSELL: We actually discussed it at work session today.
MS. WARD: Oh, okay.
SUPERVISOR RUSSELL: Generally, if we are going to entertain other prospects of amending
� the water map, we will put the onus back on the applicant, saying you need to show us why it
needs to be amended and there usually need to be criteria.
MS. WARD: Okay.
SUPERVISOR RUSSELL: We don't just amend the water map, really that's probably a poor
choice of words but we do it because there is a compelling reason why we need to amend it, so
that's the types of things that we will be sending you in the next few days, is some questions to
answer those.
MS. WARD: Oh, okay. Because it is a high water table and grade issues. That's the main
reason.
SUPERVISOR RUSSELL: High water?
MS. WARD: There's very high ground water at the property and there is a significant grade
issue and our neighbor across the street has had significant water issues with their property. And
we are in the middle of renovation and we are making the decision, we have been rejected twice
by Department of Health for our permit and we thought we should pursue the public water.
SUPERVISOR RUSSELL: What are they turning you down for?
MS. WARD: It was grade issues and the water table, so they are making us make adjustments
and then it was, it is kind of complex because of all the adjacent property owners, it's an odd
shaped property on the corner there.
SUPERVISOR RUSSELL: You will be hearing fi•om us, our town attorney will be getting in
touch with you in the next day or two. And those are the types of reasons to specify, the reason
for the request.
