(3) THE WAIVER WILL AVOID ECONOMIC HARDSHIP Mr. and Mrs. Woodcock purchased their main house ( lot 17) in 1979 and continue to live in their home. The adjacent cottage was purchased by Mrs. Woodcock's father, Mr. Munich, in 1977 who lived there independently. The house was thereafter gifted by Mr. Munich to his daughter, Mrs. DiFrancisca (Mrs. Woodcock's sister). In 1990 Mr and Mrs Woodcock purchased the property from Mrs. DiFrancisca in order to pay for Mr. Munich's nursing home expenses. The property in 1990 appraised for $87,000 and Mr. and Mrs. Woodcock purchased the property for $90,000 ( more than the appraised value). The property was under contract for $90,000 until this issue caused the contract to be terminated. (4) THE NATURAL DETAILS CHARACTER AND SLOPES OF THE LOT WILL NOT BE SIGNIFICANTLY CHANGED OR ALTERED IN ANY MANNER, AND THERE WILL NOT BE A SUBSTANTIAL FILLING OF LAND AFFECTING NEARBY ENVIRONMENTAL OR FLOOD AREAS. The property is intended to remain the same, the house will be enlarged in accordance with the attached plans and will result in a house that will be at least 650 sq.ft.
