ACTION OF THE BOARD OF APPEALS
Appeal No. 4256:
Application for JON AND CAROL RAND. Variance to the Zoning
Ordinance, Article XXIV, Section 100-244B, and based upon the July
12, 1994 Notice of Disapproval from the Building Inspector, for
permission to construct porch addition with reduced front yard setback
at less than the established nonconforming front yard setback along
Paradise Point Road. The subject premises is nonconforming with a
total lot area of 23,522+- square feet in this Agricultural-
Conservation (A-C) Zone District. Property Location: 2975 Cedar
Beach Road at intersection with Paradise Point Read, Southold, NY;
also known and referred to as Lot 19 on the Map of Cedar Beach
Park; County Tax Map Parcel No. 1000-91-1-2.
WHEREAS, a public hearing was held on August 11, 1994, at which
time those who desired to be heard were heard and their testimony
recorded (no opposition was received); and
WHEREAS, the Board has carefuliy considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Beard made the following findings of fact:
1. The premises in question:
(a) is a parcel of land known as Lot No. 19 on the Map of
Cedar Beach Park, which parcel of land is situate along the northerly
side of Cedar Beach Road and the westerly side of a Paradise Point
Road, at Southold, containing a total lot area of .54 of an acre;
(b) is improved with a single-family dwelling, as more
particularly shown on the site plan map dated 7/7/94 prepared by
Samuels & Steelman, which information was taken from a survey dated
7/29/87 of William R. Simmons, Jr., showing an existing front yard

setback along the easterly side of the dwelling at 24 feet from the
property line along Paradise Point Road.
2. By this application, appellants have requested approval for a
reduction in the easterly front yard setback from 24 feet to 19 feet
for a corner section of a proposed covered porch addition. The land
area adjoining this property along the west side of Paradise Point Read
is shown to be improved with a wood fence and is maintained as an
extension of lawn area from the subject lot.
3. In considering this application, the Board finds that the 30+-
sq. ft. corner portion of the proposed covered porch addition which is
the subject of this variance request is mlnlm~l and will not be an
adverse impact to the essential character of the neighborhood.
Accordingly, on motion by Chairman Goehringer, seconded by
Member Dinizio, it was
RESOLVED, to GRANT the relief requested for the 30 sq. ft. +-
corner of the proposed covered porch addition to existing dwelling as
shown on the above-referenced site plan map with a setback at 19 feet
(as requested).
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Dinizio,
Villa and Wilton. This resolution was duly adopted.

Strict application of the ordinance would produce practical difficulties or
unnecessary hardship because: remodel ing of the first floor necessitates the
addition of a primary entrance adjacent to the driveway/parking area.
Construction of the proposed front porch provides an ascetically-pleasing
transition from the front yard and driveway/parking area to the new front
door.
2. The hardship created is unique and is not shared by all properties alike in the
immediate vicinity of this property and in this use district because:
· Building lot is substandard for the zone, which calls for a 2 acre minimum and
120' lot width.
· Current structure represents a pre-existing non-conforming condition.
· House is sited diagonally on a corner lot.
· Actual property line falls 1__3' inside the border created by Paradise Point
Road, resulting in a proposed effective setback of 3_~g'.
The Variance would observe the spirit of the Ordinance and would not change
the character of the district because: the proposed front porch addition is
architecturally appropriate to the house and is in keeping with numerous other
homes, of similar vintage and type, located throughout the Hamlet and Town
of Southold. In addition, the proposed structure would not impede or limit
access to or use of either Paradise Point Road or Cedar Beach Road.

addition that this applicant is or additions, one of which is covered by
this and the other one which is not for this application and a copy of
the Suffolk County Tax Map indicating this and surrounding properties
in the area. You are representing these people? How do you do sir.
JON RAND: How you do. Good evening, my name is Jon Rand. I'm with
my wife, the home owner of the property. As the application states the
lot is nonconforming, it's approximately one-half acre in an area with
other lots of 2 acre zoning. The house is very unusually situated on
its lot diagonally placed to strike the Cedar Beach Road and Paradise
Point Road, right on the corner with a setback down to the side road
opposed to the front. The purpose of the addition is to provide a
covered entry adjacent to the front area and driveway for a new front
door as part of a larger ( ) lower floor of the house. The
encroachment to this case is very minimal. The physical encroachment is
5 feet. The encroachment is open porch, it's not closed, it's a deck
roof and one post. Our neighbors have endorsed the proposal and
believe that the change will enhance the appearance of the house. The
traditional keeping the style of the house will also enhance the view of
the neighborhood.
MR. CHAIRMAN: So that penned in blue area which goes to the parking
area very simply just, whatever type of area .....
MR. RAND: ........ Maybe even just grass.
MR. CHAIRMAN: So we're asking a reduction which was preexisting at
24 or nonconforming at 24 to 19. Is that correct?

Dear Mrs. Steelman:
Enclosed is a copy of the Legal Notice, as published by our office
in the Long Island Traveler-Watchman, Inc. and Times-Review,
Inc. The Legal Notice outlines a generalized description of the
request being made, based upon the building inspector's initial
Notice of Disapproval, and indicating the date, time and place of
the public hearing.
Please have someone appear at the public hearing who is familiar
with the property. The public hearing will not start before the
time advertised, and you will note that the time between hearings
is minimal, although additional time is always available to you for
your presentation, if needed.
In the event you wish to amend this application which might affect
the location, setbacks, size, etc. of this project, you will be
required to obtain an amended Notice of Disapproval from the
Building Inspector to reflect the changes, and also will be
required to give further notice to adjacent property owners, and
amended publication in the same manner as the initial application.
State law mandates that amended appeals be processed in the same
manner as the original appeal

P.S. If not already done, we ask that the stakes for the proposed
corners of the new corners be placed for Board Member inspection.
Strict application of the ordinance would produce practical difficulties or
unnecessary hardship because: remodeling of the first floor necesSitates the
addition of a primary entrance adjacent to the driveway/parking area.
Construction of the proposed front porch provides an ascetically-pleasing
transition from the front yard and driveway/parking area to the new front
door.
The hardship created is unique and is not shared by all properties alike in the
immediate vicinity of this property and i.n tiffs use district because:
Building lot is substandard for the zone, which calls for a 2 acre minimum and
120' lot width.
Current structure represents a pre-existing non-conforming condition.
House is sited diagonally on a corner lot.
Actual property line falls I__~_~' inside the border created by Paradise Point
Road, resulting in a proposed effective setback of 3._~g'.
The Variance would observe the spirit of the Ordinance and would not change
the character of the district because: the proposed front porch addition is
architecturally appropriate to the house and is in keeping with numerous other
homes, of similar vintage and type, located throughout the Hamlet and Town
of Southold. In addition, the proposed structure would not impede or limit
access to or use of either Paradise Point Road or Cedar Beach Road.

implementing regulations pertaining to Article 8 of the N.Y.S.
Enviror~ental Quality Review Act of the EnviroD~ental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCP~R Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the ~ II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as Mended
February 14, 1990}.
Although this action is classified as ~ype II for this
variance application under SEQP~ {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
