No. 4283. Upon Application of GAIL DESSIMOZ and MICHAEL RACZ (by their agent, Thomas C. Wolpert). Request for Variances under Article III, Section 100-32 and 100-33C based upon the October 21, 1994 Notice of Disapproval from the Building Inspector for permission to: (1) change a lot line resulting in a reduction in the existing lot width on the westerly lot from 208.14 feet to 125 feet (Code requirement is 175 feet in this R-80 Residential Zone District), and (2) if the lot width reduction is approved, to locate swimmingpool in the new side yard area to the west of the existing single-family dwelling. Location of Property: Private right-of-way known as Hallock Lane and Private Read #10, which extends off the north side of Sound Avenue, Mattituck, NY (over and along lands of Charles Simmons and Edward Harbes); County Tax Map Parcels No. 1000-112-1-3 and 4. WHEREAS, the above was published as required by law in the local and official newspapers of the Town, to wit: The Suffolk Times and Long Island Traveler-Watchman, Inc.; and WHEREAS, this matter has been declared a Type II Action under the New York State Environmental Quality Review Act (SEQRA); WHEREAS, after due notice, a public hearing was held on Decem- ber 7, 1994 at which time all persons who desired to be heard were heard and their testimony ~ecorded; and WHEREAS, the Board has carefully considered aH testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Beard made the following findings of fact: 1. AREA VARIANCE. This variance application was filed on October 27, 1994, and pertains to two separate area variances: (1) for a change in lot line location resulting in the proposed reduction of width (frontage) to less than the required 175 feet, and (2) for the location of an accessory swimmingpool structure in a proposed westerly side yard 75 feet distant from the existing two-story frame house (easterly) and 24 feet from the proposed property division line, as modified and noted in (1) above. Page 2 - Appl. No. 4283 Application of MICHAEL RACZ & ano. Decision Rendered December 7, 1994 2. BASIS OF APPEAL FOR ACCESSORY SWIMMINGPOOL AND LOT LINE CHANGE. The Building Inspector's Notice of Disapproval upon which this new Appeal Application is based is dated October 21, 1994 and pertains only to the lot line alteration request and location of an accessory swimmingpool in a side yard area. The Notice of Disapproval does not address the proposed pool house - which was added to amended maps without review by the Building Inspector and after the variance was advertised. Amendments after advertising, as such, do require an application under the same procedure as the original application and amended Notice of Disapproval, as well as amended notice to adjacent property owners. 3. CODE REQUIREMENTS. A) Article III, Section 100-32 (Bulk Schedule) of the Zoning Code provides that the minimum lot width for lots containing 80,000 sq. ft. or more be at 175 feet. B) Article III, Section 100-33(C) provides as follows: ...Accessory buildings and structures or other accessory uses shall be located in the required rear yard, subject to the following requirements... C. In the case of a waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet the front-yard setback requirements as set forth by this Code. 4. EXISTING BUILDINGS AND PROPERTY DATA. (a) The premises in question is situated along a private right-of-way known as "Hallock Lane," Mattituck. Hallock Lane extends north of Sound Avenue, and received a conditional New York Tow~ Law, Section 280-A approval under Appeal No. 3433 on September 11, 1986; (b) variances, with October 1, 1994 westerly parcel 142,017 sq. ft. from 71,889 sq. The premises with existing bnlldings and proposed the exception of the poolhouse, are aH shown on the map prepared by Young & Young, land surveyors. The (Lot 3) w-ill be modified by this lot line change from to 85,861 sq. ft., and the easterly lot (Lot 4) modified ft. to 128,045 sq. ft.; (c) The depth of the parcels from the right-of-way to the highwater mark are shown to be at least 675 feet, except that the land area between the top of bluff as determined by the survey on 8~4/94 and the northerly property line along the highwater mark reduces the lot depth to 370+- feet; (d) The main building or two-story frame dwelling, on the easterly parcel (Lot 4)is shown to be 43+- feet at its closest point to the top of the bluff and 278.60 feet to the southerly most front property line; Page 3 - Appl. Decision Rendered December 7, 1994 (e) The accessory buildings are labeled as one-story frame building and two-story frame garage which are located in the yard facing the water and the yard facing the right-of-way, respectively; (f) The westerly lot (Lot 3) is presently improved with a two-story frame building which is pending review by the Building Department for relocation in accordance with all zoning, building, and other agency requirements. 5. PROPOSED VARIANCE. The 40 ft. by 20 ft. inground swimmingpool structure is shown to be proposed as a separate structure, close to the center and in between the new location on Lot 3 and the existing accessory "one-story frame cottage" building. The rear yard area is that area seaward of the existing dwelling. The front yard area which permits accessory buildings is that general area south of the existing main dwelling. 6. ALTERNATIVES. While the second map dated November 21, 1994 was not submitted by the applicants to the Building Inspector prior to the issuance of the Notice of Disapproval, the pool is located in the side yard area of a "cottage" building. Information has not boon submitted to show the history of the cottage building and the intent of the "cottage" building. The applicant should re-label the one-story "frame cottage" building to read "accessory" building which is understood to have been the use prior to the inception of zoning in 1957. This correction would allow the area seaward of the main house to be rear yard, and the subject pool and related accessory building(s) wouid appear to be better able to meet the requirements of Section 100-33 of the zoning code. 7. EFFECTS OF RELIEF REQUESTED. Board that: It is the position of the (a) the location of the accessory structures in the westerly side yard of the building labeled "one-story frame cottage", aa well as in the westerly side yard of the main building, is substantial in relation to the requirements, at 100%; (b) there are alternatives for applicants to pursue, other than a variance; . accessory variance; (c) there is other usable land area available to locate buildings without a variance, or possibly with a minimal (d) the relief requested for the location of the accessory pool on the October 1, 1994 map, and for the accessory pool house on the November 21, 1994 map is not the minimum necessary to afford relief; (e) the difficulties claimed are personal in nature to the landowner rather than due to the uniqueness of the land since the owners Page 4 - Appl. Decision Rendered December 7, 1994 will not be deprived of reasonable use of a swimmingpool (or other structure) in other land areas; (f) in view of all the above, the interests of justice will be served by denying the relief, as requested, for the pool and poolhouse location, without prejudice to a future application for different relief; (g) with respect to the lot width reduction from 175 feet to 125 be approved, the interests of justice will be served. Accordingly, on motion by Member Villa, seconded by Chairman Goehringer, it was RESOLVED, to APPROVE the lot width reduction of Lot 3 to 125 feet, and new lot width of Lot 4 at 154.09 feet, as shown on the map dated October 1, 1994 SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the two-story f~une house to be located shall not be occupied until properly re-located in accordance with all permits and approvais; and 2. That there shall be the least amount of disturbance to soil and areas subject to erosion to the maximum efforts possible; and BE IT FURTHER RESOLVED, to DENY the relief requested on the map dated October 1, 1994 pertaining to the accessory pool location for the reasons noted above; and be it FURTHER RESOLVED, to DENY the relief requested on the map dated November 21, 1994 pertaining to the poolhouse location in the side yard in its entirety, for the reasons noted above. It was decided by the Board Members at our Regular Meeting held on May 3, 1995, that the owner through his surveyor place an in-ground marked at the point where the 100 ft. setback is shown for use when physically measuring the setback at the site. The same marker can be used for other measurements as well, when needed. In the future it would be best i~ the surveyor, when oelginally applying for a variance, would show the contours at the highest elevation and the reasoning for placing the "average top of the bluff line" at a different location than the actual top of the bluff. KENNETH ABRUZZO: Now, most of the things that the Chairman Ward announced in the Resolution, I would like to say a few things though that these two parcels if you didn't know are Gail Dessimoz and Michael Racz, are husband and wife, they have parcels that are that are owned by one jointly, and one by the wife. These easterly parcels as it presently exists today does not conform to zoning area or lot width and what we wish to do is to enlarge the easterly parcel whereby it would conform to lot width and more than conform the lot width and exceed the zoning requirements by a good deal. MEMBER VILLA: Easterly lot or the westerly lot? KENNETH ABRUZZO: The easterly lot. As the easterly lot exists at this time it's only 71,889 sq. ft. The lot width on that is approximately 124 feet. We wish to enlarge that lot. CHAIRMAN: OK. Questions. The reason for the relocation of the house on the westerly parcel? KENNETH ABRUZZO: Well the reason for that is, Mr. Racz has antique cars. He'd like to put in the front yard a garage to store his antique cars and that's the, although I understand that's permitted under the zoning that he could have accessory structure in tile front yard. Like to take that existing bungalow that's on the westerly or the frame house on the westerly side and relocate that as close to the bluff as the DEC, the Trustees and the Building Department will allow for views and for steps. Certainly when that house is relocated we know we're going to be involved with whatever Building Permits and DEC and Health Department Trustee regulations would apply at that time. The application as it exists right now, we tried to show everybody what we're going to do and by relocating the boundary line we didn't want somebody to think that that house was going to stay right where it is. We are, we always had plan to relocate it if this boundary line agreement, boundary line alteration goes through. MR. CHAIRMAN: The propose swimming pool approximate location is 100 feet. I would imagine that somebody from the Board, now that all of the Members have visited this site (inaudible)beautiful site and I believe they'd like to sit out by the pool and have the view of the sound. That's why they purchased this property and so the closer we can get it and still meet all of the regulations to the bluff and to the flat portion up there they'd like it. Certainly they didn't want the pool or pool house located in the front of their house or towards the right-of-way. MR. CHAIRMAN: The only concern I have is that knowing this area and the prior owner of this house you have a substantial amount of erosion in this area and I know that they probably have done a substantial amount of planning to try and hold that erosion back. You don't have a topo of this piece so we could take a look at it? KENNETH ABRUZZO: No I have not done a full topo on this at all. But, what I can tell you is that there is, well I've been up there, sought of a double bluff. There, there's an edge of a what you might call a ravine section which is vegetated where we have located the top of the bluff is where the vegetation stops and there's a drastic drop to the beach. Between that point and a point somewhat seaward of the cottage up there, there is a drop off in the elevation. I know that Mr. Racz has planted many for a lack of a true name, maybe bamboo type of plants that really have good root systems in growths and since he's owned this property he's kept that vegetation going so that there would be no erosion. That's line where it does drop off that's all have a topo of that but I don't think there's a lot of erosion where the vegetation has been established. Maybe further down at the bluff there's certainly been erosion on and off. MR. CHAIRMAN: this gentleman? MEMBER VILLA: MR. CHAIRMAN: Alright. Mr. Villa do you have any questions of No, not really. Alright. Do you have any specific concern? I don't mean to put you on the spot. MEMBER VILLA: Well, erosion is always a problem and sometimes it's stable for many years then all of a sudden you lose a great deal in a storm. It's hard to say. I understand that the proposed antique automobile storage is a permitted structure in the front yard. We have no plans to modify the house or the block wall of the cottage. We would just, we'd like to move the existing property line west in order to locate his proposed swimming pool and pool house on the side yard. MEMBER DIN1ZIO: OK. ED WORTH: 20 x 40. MEMBER DINIZIO: That's the size of the pool? Is there a deck, a, is there going to be a ..... ? ED WORTH: No, there was just a patio. We've shown on here there's going to be a 4 or 5 foot wide concrete patio, just around the pool. MEMBER DINIZIO: So, this 20 feet is to where? To the corner of the pool where the water is going to be, or 20 feet to the? ED wORTH: 20 feet is to the corner of the pool house. The 24 feet is to the edge of the concrete. We've tried to center the pool, the proposed pool in the center of the pool house. So, the edge of the be 24 feet, the pool will be about 28 feet or so from line, the pool house will be 20 feet from the property MEMBER VILLA: So, that's the nearest point of that whole structure? ED WORTH: That correct. They'll be nothing closer than 20 feet from the prope~'ty line. MR. CHAIRMAN: And what's the approximate size of the pool house? ED WORTH: The pool house I believe it's about 18 x 25 or 30. MR. We're, we're certainly going to be a little restrictive on the pool house. ED WORTH: You mean as far as the square footage? MR. CHAIRMAN: No, in reference to the way the pool house should be designed and the way the door should open for the ingress and egress to the specific changing rooms and the lavatory and so on and so forth. Go ahead, I'm sorry. ED WORTH: The garage as the architect, I'm sorry, the pool house measurements that the architect have provided is about 20 x 30. But again, I don't have full architectural. These were you know, concepts. We have submitted this and we got a letter from the Zoning Board of Appeals that asked us to show any improvements that might be in that side yard. Until I got that letter I didn't realize that there was going to be a pool house but you asked for fences or patios or anything that would show. I did contact the architect and he sent me a sketch of everything that he desired to do there. I didn't think, he realized that he had to show it all in the beginning. So, I don't have full architectural but I'm drawing the scale on it, it's about 20 x 30. MEMBER DINIZIO: Is it one story? ED WORTH: Yes, yes it is. That's what you have to ask. MR. CHAIRMAN: I should point out to you that tile requirements that this Board uses for pool houses is that lavatories shall open to the outside of the building. We don't want another bunk house and I'm not referring to this applicant or this is a generic opinion, OK and I'm not speaking for the Board, I'm speaking for myself. Their welcome to say whatever they want. We've had some pretty sophisticated pool houses. We've had pool houses that will accommodate a landing pad for a helicopter. We've had all kinds of substantial looking things that a, so this is the reason, this is basically why we've adopted these. ED WORTH: I a, I certainly understand your concerns and although I really don't know Mr. Racz's feelings about the doors. He's always been willing to cooperate in anyway and I think if that's a condition of approval that his doors open to the outside for his bathrooms and things like that, I don't think that would be a problem. The property to which appellants are requesting New York Town Law, Section 280-a approval, is located in the "A-80" Residential and Agricultural Zoning District as more particularly shown on site plan dated November ], 1985, prepared by Peix and Crawford Architecture, contains a total lot area of 1.940± acres and lot width of 124± feet, and is improved with the following s: (a) sing]e-family, one-story frame dwelling; ~Tuct~reby 22' garage located in the frontyard area; and 1 ' (c) a 9' by 16' accessory building, as referred in Certificate of Nonconforming Premises No. Zl1990 dated October ll, 1983 (Carel DeLeeux and Edward Urbanello). This parcel is identified on the Suffolk County Tax Maps as District 1000, Section ll2, Block ], Lot 4, and is referred to as 4255 Private Road No. 10 (Hallock Lane), Mattituck. By this application, appellants request a variance pur- suant to the requirements of New York Town Law, Section 280-a, as more particularly shown on surveys, #3876-2 revised May 20, 1986, and Survey Map of Farm for Herbert M. Reeve Est. dated July 7, 1966, all prepared by Roderick VanTuyl, P.C., Surveyor. 3. The right-of-way over which appellants have requested 280-a consideration is situated at the north side of Sound Avenue, and extends in a northerly direction over lands partly of Simmons and partly of Harbes, a distance of approximately 4,000 feet, to the applicants' property. 4. Road Engineer Report No. 523 dated July 7 1986 indicates as follows: ' The first 2200± feet is fairly level, with variable widths from 20 feet at Sound Avenue to 10 feet. The material in this area consists primarily of a mixture of sand, loam~ with small, medium and large gravel. There are numerous 3" to 8" deep pot- holes. The next 400± feet has similar materials as above with some potholes and depressions, and average road width of ll± feet. The remaining distance varies from a flat profile to a plus grade, with some washout and backfill with large gravel. Material in this last length is sand, loam, small, medium and'large gravel with occasional stone blend and averaging ll± feet in width. The existing base, except for depressed areas, is hard- packed and stable. Corrections are recommended for improvement. 5. Appellants have also requested some relief from the greatest requirements normally placed for rights-of-way of this nature inasmuch as they are applying for a building permit only for renovation and repairs to the existing accessory structure (referred to as "cabin" without kitchen facilities). 6. It is noted for the record that the premises in question was the subject of a prior Appeal under No. 3431 rendered March 10, 1986, and that 280-a access is pending with the Town Planning Board concerning a division of land for Charles p. Simmons. 7. The board finds that under the circumstances, the improvements as noted below should be the maximum at this time, to allow for the issuance of a building permit for a renovation and repair of the existing accessory building, and the minimum for proper, sufficient, and safe access by emergency and other vehicles. In granting this limited 280-a variance, the board finds: (a) the relief requested is not substantial; (b) there will be no substantial change in the character of this dis- trict; (c) the relief as conditionally granted will not cause a substantial effect or detriment to adjoining properties; (d) the circumstances of this appeal are unique and there is no other method feasible for appellant to pursue other than a variance; (e) in view of the manner in which the difficulty arose, justice will be served by Page 3 - Appeal No. 3433 Matter of DESSIMOZ AND RACZ Decision R~-6'der~d September 11, 1986 allowing the variance, as conditionally noted below. That this 280-a approval is limited requiring minor improvements to the right-of-way in order to allow proper issuance of a building permit for the renovation/repair of existing accessory (cabin) structure. No other building permits shall be issued for this property or other properties having this same legal access route until final 280-a has been filed and re-considered. 2. Improvements, within the legal perimeter of the right-of-way for a minimum width of ten (10) feet, without disturbance to nearby trees along the right-of-way~ as follows: (a) commencing approximately 2200 feet north of Sound Avenue, regrade with bankrun having a 20% stone content; and (b) filling all potholes and depressions. 3.
