premises is a substandard lot.
WHEREAS. a public hearing was held on March 2. 199~ and
May 4. lggq. at which time all persons who desired to be heard were
heard and their testimony recorded; and
WHEREAS. the Board has carefully considered all testimony and
documentation submittal concerning this applic~tim~;
WHEREAS. Board Members have personally viewed and are familiar
with the premises in question, its present z~i~g, and the
surrounding a~; and
WHEREAS. the Beard made the following findings of fact:
1. BASIS OF DISAPPROVAL. This is an appli~Lao~ based upon
the following Notice of, Disapproval from the Buiidleg Insl~ector to
construct a pool with fencing partly in the side yard and partly in
the rear ym, d area. which Natic~ dated February 9. 199# is worded as
follows:
"... Disapproved on the following grounds:
Under Article III. Section 100-33 acc~aeory structures
and uses shall be located in the required rem- yaed.
Action required by the Zoning Bom-d of Appeals;

2. CODE REQUIREMENTS. Article III. Section 100-33. re~uiros
accessory buildings and structures to he Io~=b=d in the rear yard. or
in the case of a waterfront parcel, in the front yard. The rear ymed

existing residence - which is limited buildable-area due to the tidal
wetlands alemcj and near the rear property line.
3. PROPERTY DATA. The premises in., questis~ was co~weyed
by Mark McOonakl and Patrick Carrig on January 6, 198~ to the
applicants herein: The subject parcel is described (r-athe~ then part
of a subdivision) and is situated on the southerly side of~ Eugefle~
Road. Cutchogue {East). The size of this parcel is. shown to be
approximately .73 of an acre with 202 ft. frontage along Eugefl~'s
Road. and is improved with a single-family, two-story frame house
situated 61.3 feet from the front property line. 2#.8 feet from the
westerly side property line. and approxinatety 90 feet from the rear
of the foundation to the tie line eiong hi~ water mark {7~+- feet
from the edge of the deck steps to the southerly hightmite~ line. and
77+- feet to the eaateely-hig~ater line. at its closest points).
The property has variable and Iow contours, which le~l to the
limitations for building in reasonable Io¢~tions while, meeting ail
other zoning code requirements.
~r. PROPOSAL. This, application is a request to Io-.~e an 18ft.
by 38 ft. inground swimming pool in the side yard approxlmate~y-8 ft.
from the easterly side of: the dwelling which will leave a seldna~k at
52 feet from the ~==terty property line. A 9-ft. open deck with
raised wall and plerda~ will further reduce the setback to the side
property line to a distance of~ ~9 feet at one point and 1~2.6 feet at
another point.
5. INSPECTION{S) AND RESEARCH DATA.
{a) An inspection of the site reveals tha~ the house is
presently set back approximately-90 feet from the side pr~aertT line
(alom3 the hight~tor mark) at its closest point. No other buildings
or structure are proposed {or exist at the prefldses} except that
landscaping and berm ~ are to be placed in the front yard. nat to
exceed four feet in height.
(b) Regrading and new landa .-~T~d areas m~st he done to
keep surface water runoff directed away from the tidal watlmads and
the property owners will be required to either truck the pool wat~'
off site. or properly install dra/well drains.
6. OTHER TOWN AGENCY JURISDICTION/REVIEW. Submitf~4
for the record is a copy, of, the writto~ authorization issued by the
Board of Southold Town Trustees dated March 2~. 199~ under Permit
No. q296 for this project. No infermatien has been submitted to sho~
whether or not a permit was ac~_~i upon by,the N.Y.S. Department of
Environmental Conservation. for which an application may be pending
at this time. Prior to issuance of~ a buiidlng permit for the

swimmingpool and prior to commencing any building activities, an
approved permit must be obtained by the property owner from the
N.Y.S. Departnmnt of Fnvh-o~mental Conservation.
7. EFFECTS OF RELIEF REQUESTED. It is the position of this
Board that in, considering the relief requested and nmre particularh/
shown on the lan~ plans dated 2-9-9~ prepared by Briarcliff
Landscape that:
(a) the location of the swlmmingpeal structure in. the side
yard is not unreasonable-in, light of the fact that the roaryaed has
Iow elevations and may not be disturbed;
lb) the grant of: the reliet~,~ to locate the pool in the
requested sideyarcl r=~er than the rearyard will not alter the
essential character of~ the neighborh(xx] due to the nature of: the
layout and characteristics o~ thissite;
lc) the benefit sought to be achieved by the appellants
cannot be achieved by a method other than a variance under the
zoning regulatimas;
Id) the difficulty will not ha~e-an adverse effect or
impact on the physical or environmental coflditio~s inthe n~
since the appellants will be required to either truck the pool water
off site or install drywells as reccmmtended by the environmental
agencies of the Town and State,
NOW. THEREFORE. on motion by Member Wilton. seconded by
Chairman Goehrlnger. it was
RESOLVED. to GRANT relie~ to locate the proposed 18 ft. by 38
ft. swimmlngl=ool with nine-ft, deck area and fence enclesure in the
easterly side yard. as requested. SUBJECT TO THE FOLLOWING
CONDITIONS:
1. That the pool area be open to the sky. without a building
enclosure;
· 2. That there be no lighting that weuld- be adverse to
neighboring areas;
3. That the fence be placed as required by the Bui~
Inspector for safety p~;
a. That there be no other land disturbance to or close to the

This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
Submit Planning Board Approval of completed site plan requirements.

The following action was taken by the Board of Town Trustees
during its regular meeting held on March 24, 1994 regarding the
above matter:
WHEREAS, ~~applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated, March 2, 1994, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 24, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHP/LEAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of

Dear Mr. Cichanowicz:
At the initial public hearing in the above matter, one of the Zoning
Board members questioned whether or not the property owner was
planning to comply with the maximum.four-ft, height ~requirement :for
the berm area in the front yard. The plan presently before the
Board shows an elevation above four feet-- for which a Notice of
Disapproval could be issued if the property owner felt they wanted to
request an additional variance.
Please clarify this position with the Building Inspector, in writing,
and furnish a copy to us for our file. If the above is received by
our office on or before April 15, 1994, the matter will be abte to be
advertised for the May 4, 1994 hearings calendar. If an additional
variance is to be requested, a separate variance application should
be filed on or before April 15, 1994 together with a Notice of
Disapproval for the bern height and additional $150.00 filing fee. '

THE CHAIRMAN: I have Application 4217 of Briarcliff Landscape, Inc.,
which indicates a rather extensive pool and patio area to be constructed basically on
the easterly side of this residence on Eugene's Road. We have seen stakes and are
somewhat aware in the snow of what exists there, and what is proposed; and I have
a copy of the Suffolk County Tax Map indicating this and surrounding properties in
the area. Is there anybody from Briarcliff? Hi, how are you?

MR. ClCHANOWICZ: Yes.
THE CHAIRMAN: Is there anything you would like to add to the hearing?
MR. ClCHANOWICZ: No; I just am here to answer any questions you might
have on the site or work to be done.
THE CHAIRMAN: Okay; the only thing that concerns me at this time is that
you are just in the process of dealing with the Trustees, and I assume some sort of
application has been made to the DEC concerning this, okay. So what we would like
to do is hold it in abeyance until we get at least the Trustees' opinion on the site;
and we will recess it for probably 45 days?

MR. CICHANOWICZ: CCA.
THE CHAIRMAN: Like CCA landscape ties basically?
MR. ClCHANOWlCZ: Right, six-by-six ties.
THE CHAIRMAN: I don't have any specific questions at this time. I will
further go back and investigate it. It is a little difficult, Neil, at this time
with all of the snow there. I was there about two weeks ago, and it was really
snow. I did appreciate the spray-paint. Some of the members didn't see that.
MEMBER WILTON: What did the two yellow stakes represent?
Were they corners or centers?
MR. CICHANOWlCZ: They were all corners.
MEMBER WILTON: When I was there, there were only two stakes.
MR. CICHANOWICZ: They must have fallen. I did it a couple weeks ago,
and there was a lot more snow, and I couldn't get any stakes in the ground.
THE CHAIRMAN: I saw all the stakes. There was no problem, and I saw the
spray-paint. It was really great; that orange spray-paint came up great against the
white snow. Does anybody have any questions of Neil while he is here?

About 45 days. Conceivably you are not going to be able to
MEMBER VILLA: The only question I have --I am sorry-- is on the berm
height in the front. There is a berm requirement of four feet. and they are
exceeding it. Town Code says berms shall be only 4 feet. and you have got almost
five-and-a-half feet in the front --

MR. CICHANOWICZ: There is berms there now. I know that.
They exceed what is allowed as well. I believe on the other page there is berm
heights listed that are at four feet.
MEMBER VILLA: So what are you going to do, scale them down?
MR. CICHANOWlCZ: --They are not going to be made any higher than the
berms are now. They are just going to be moved because the driveway entrance area
is going to slide over a little bit; so what they are going to do is extend it
places.
MEMBER VILLA: That brings a question, Jerry. Are we going to address the
existing berms in this, or are we going to close our eyes7
THE CLERK: We can't. We have to advertise; he has to apply separately for
berms.
MEMBER VILLA: Well, that is part of the plan.
THE CLERK: Well, then you will have to restrict him to four feet until he
comes back, right7
MEMBER DINIZIO: I think what Bob is saying, that they exceed four feet
now.

THE CLERK: Yeah. but in our decision we would have to have him cut it back
to ~. feet unless he came back with another application to exceed the 4 feet.
MEMBER VILLA: Well. it is an item that has to be addressed then,
THE CHAIRMAN: Well. the only concern is if there~is a C.O. on the property
at this time. The Building Inspector did not indicate that there was a violation of
those berms as they exist. So they exist. Okay. How they got there is not
necessarily this gentleman's concern. He is coming in with --in fact. he is going to
manipulate those berms not to exceed 4 feet in the area he is going to be dealing
with.
MEMBER VILLA: Well. my question to you was: Are we going to address the
berm height or not?
THE CHAIRMAN: No; we can send a note to the Building Inspector indicating
to him a short memo that in this application we did indicate that the berms were
higher than they should exist.
MEMBER VILLA: --or a condition for a decision.
THE CLERK: That's right; you could do it two ways.
THE CHAIRMAN: You could do it two ways. We'll inform they are higher and
that they exist higher at this particular time. and is that a part of the normal
overall plan in reviewing the situation, that possibly --if he thinks they are higher
than 4 feet. then maybe they should be addressed in the variance procedure.
THE CLERK: But it would have to be applied for separately, that we could
advertise it separately, and take it from there.
THE CHAIRMAN: Sure.
THE CLERK: But it really is a separate application.

higher than 4 feet, it doesn't address existing, does it?
THE CLERK: Isn't the berm there now?
THE CHAIRMAN: Yeah, Mr. Villa is referring to the fact that the berms now
exceed 4 feet, okay; and you are telling us that you are not going to exceed u, feet
with any manipulation of a berm, that you are going to be dealing with and changing
the driveway procedure or whatever the case might be. so, you know, we will
determine through the Building Inspector if the berms are legal or if they are not
legal and then --What we are trying to do is encompass everything into one nice neat
package so that when you go in there, if we do approve this. with your equipment,
that everything is done at one time, and that is the whole process. All right?
MR. CICHANOWICZ: Okay.
THE CHAIRMAN: Is there anybody else, while we are at this hearing, who
