WHEREAS, Lehnert Construction on behalf of WINDSONG FARM LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 26, 2015, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the-Board of Trustees has furthered Policies 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the use of 6" diameter piles or less on the catwalk with 8" diameter piles for the float, the use of thru-flow decking on the catwalk from the landward end of the catwalk to not less than 24' seaward over the vegetated wetlands, removing the existing 4'x13' fixed "T" section; and 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 22, 2015, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of WINDSONG FARM LLC to repair or replace existing 3'x97' catwalk; install a proposed 3'x10' metal ramp; and a proposed 6'x20' floating dock with 4"x4" float supporters with flat-plate bottom to support floating dock a minimum of 18" above bottom; with the condition of the use of 6" diameter piles or,less on the catwalk; 8" diameter piles on the floating dock; thru-flow decking to be used from the landward end of the catwalk to not less than 24' seaward over the vegetated wetlands; the removal of the existing fixed "T" section; and as depicted on the site plan prepared by Lehnert Construction, last dated November 3, 2015, and stamped approved on,December 3, 2015. SCTM# 97-6-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP: 1. No permits for the existing structures were found. 2. The proposed private dock extension would extend into the public trust waters. 3. Cutchogue Harbor and Wetlands are a New York State Significant Coastal Fish and Wildlife Habitat Area. 4. The water levels at the end of dock are very low: 1.1' at MLLW. The alternative use of seasonal moorings in areas of low biological productivity and with adequate water depths is a better option to accommodate vessels requiring greater water depths. The applicant currently enjoys access to public water via an existing private, dock structure. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions.
