COUNTY TAX MAP DISTRICT 1000, SECTION 115, BLOCK 2, LOT 11.
BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector
dated May 31, 1995: "Proposed construction will have insufficient rear yard
setback... proposed addition to dwelling would cause existing accessory garage
to be in a side yard and accessory buildings shall be located in a rear yard."
Zone: R-40 Residential.
PROVISIONS APPEALED FROM: Article IIIA, Section 100-30A.3, A.4.
RELIEF REQUESTED: 10' x 12' addition (mud room) extending at the
northerly corner of the existing dwelling into the present rear yard which
normally would not require a variance except that the addition will now place
existing accessory garage in what is considered a "side yard" area.
Accessory garage are not permitted in side yard areas without Board of
Appeals approval. Setbacks of accessory building will not be changed by this
application. and proposed addition will comply with all setback and other
zoning restrictions.

ACTION/ RESOLUTION ADOPTED: Granted permission to maintain existing
location of accessory garage as built and due to the proposed construction of
a 10' x 12' addition is placed in a side yard area. (Note: No conditions
of variance except as provided by all other codes of the Town of Southold.)
REASONS /FINDINGS: Addition will meet all zoning restrictions. Garage
existed for many years in its present location. Relief requested is minimal.
Under the circumstances, project is not unreasonable and will not cause a
detriment to nearby properties or adverse impact on the physicial or
environmental conditions in the neighborhood or district; although the
difficulty may be considered by a court of law as self-created, the board does
not feel it should preclude the granting of this area variance.

Dear Mr. Rutkoski:
Please find enclosed a copy of the determination rendered by the Board of
Appeals at our July 12, 1995 Regular Meeting concerning your variance
application. A copy of this determination has also been furnished to the
Southold Town Building Department pertaining to your pending building permit
application request. However, it will be necessary for you (or the owner) to
contact the Building Department (765-1802) to be sure all your permit
application papers are in order, for further processing by the Building
Department.
Also, due to the proximity of this project within 500 feet of a waterway,
State or County Road, the Town is required under the Suffolk County

Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990).
Although this action is classified as Type II for this
variance application under SEQRA (specifically 617.13, 616.3(j),
and 617.2(jj)), this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

Accessory garage are not permitted in side yard areas without Board of
Appeals approval. Setbacks of accessory building will not be changed by this
application. and proposed addition will comply with all setback and other
zoning restrictions.

difficulty may be considered by a court of law as self-created, the board floes
not feel it should preclude the granting of this area variance.

A. i1DAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with, or which border on, tidal waters. or lands
lying beneath tidal waters. which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet, including but not limited to banks.
bogs. salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action:
(2) All banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black
grass. saltworts. sea lavender, tall cordgrass, high
bush, cattails, groundseL marshmallow and low
march rardgrass,and/ar
(3) All laad immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
