Application for THOMAS AND JOAN KELLY. This is a
request for a variance under Article XIII. Section 100-239.4B of
the Zoning Code, Location of Property: 1050 West Cove Road.
at Nassau Point. Cutchogue. NY; County Parcel ID 1000-111-5-1
containing 1,54 acres.
WHEREAS, an application was filed appealing: the March 10,
1994 Notice of Disapproval from the Building Inspector and
requesting a variance for permission to locate a small storage
building along and near the edge of the bulkhead at Horseshoe
Cove. Cutchogue,Harbor; and
WHEREAS, after due notice, a public hearing was held on
April 6, 1994, and at said hearing, the Board asked the agent
for the applicant to consider an alternative location which
would have a greater setback from the bulkhead near the
existing driveway area (which appears to be about 70 feet from
the bulkhead); and
WHEREAS. the Board has received a request to withdraw
this application since the owners feel there is no alternative
for the owners' best interests at this time;
NOW. THEREFORE. BE IT RESOLVED. that Appeal
Application No. 4236 filed by Samuels F, Steetman, Architects,
in behalf of THOMAS AND JOAN KELLY. BE AND HEREBY IS
WITHDRAWN. AS REQUESTED.

the rear yard area towards the Gluckmau property, probably within
40 to 60 feet from thc Gluckman property, OK? You're welcome to

NANCY STEELMAN: Well, I thiuk the applicatiou does state forward
that primarily they're asing it for boat storage, there are some
stairs, existing stairs now that are being recoustl'ucted right to the
beach. From up to thc edge of tho bulkhead too much they use it
for windsurfers and various sunfish and then there is an existing
patio that it will be sccu adjacent to ....
MR. CIIAtRMAN: 1 should puint out to you that this board really does
not-- has not gt'antcd any of these on the west side of Nassau Point.
OK. We dou't censidcr l[le--~ I slmuldn't say we, I dou't, I'm not
even going to get to that point. Tile consideration OK, on tile west
side of Nassau Point is the fact that unless yea have a high bluff
area thru there is a hardship. OK, there is not necessarily that

high bluff but
MI{. CIIAIRMAN: Yes, uot a high bluff, right. I mean I went down
the stairs, I meaa ~he walkway, aud so on and so forth, that I am

if you refer to them as bluffs, there really not bluffs there, hills,

would ever try and drug a sailfish up or a sunfish up 85 feet you

under constmmtion pretty soon which is close to elevation change of
18 feet which was the enly other aPea wbieb it could store any other
kind of accessories. So there is a little bit of a climb here yes its
not even 5 feet but tl~m-'e is up tlmve.
MR. CIfAiRMAN: In otl~er woz'ds they are going to apply for a
garage? Is that what your saying?
NANCY STEELMAN: There is now currently, I think its out of your
jurisdictien I would say 5 feet.

Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13ta) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.
