PROVISIONS APPEALED FROM: Article III~ Section 100-30A.4 (ref. 100-33)
RELIEF REQUESTED: 16'6" x 20' accessory storage (barn) building located
in the southerly side yard with a setback of at least throe (3') feet from
the southerly side property line (along land roferred to as Lot 26). The
shed is located near the pool and fence enclosure and wili not protrude
into the front yard aroa, as moro particularly shown on survey dated
3/28/88 submitted with the application.

ACTION/RESOLUTION ADOPTED: Granted side yard location of an 16'4" x
20' accessory barn building for storage purposes~ as exists near pool area,
with a setback at throe feet from the southerly property line as shown on
3/28/88 survey, SUBJECT TO THE FOLLOWING CONDITIONS: (1) Be
used for accessory storage purposes incidental to the owner's residency in
the main building; (2) Only utilities shall be electric, as proposed.
REASONS/FINDINGS: House was built in 1970 with a 25 ft. rear yard
setback, which today is nonconforming. Size of property is also
noneonforming, although lot is known as Lot #25 on the Subdivision Map of
Yennecott Park. Rear yard area is very limited due to shape and character
of lot. These circumstances have existed for 24 years and lend to
difficulties in conforming with a rear yard location. No alternative is
available.

Town BuiYdjng Department pertaining to your pending building permit
application request. However, it will be necessary for you (or the
owner) to contact the Building Department (765-1802) to be sure your
application request is returned to their re-activation rack.
Also, due to the proximity of this project within 500 feet of a

By this appeal, appellant seeks permission to construct an
18' by 36' swimmingpool with a minimum sideyard setback of 25'
and rearyard setback at its closest point of 8' Existing on
the premises is a large one-story frame house with circular
driveway. The lot in question is heavily wooded.
The Board finds that the relief requested is not substantial in
relation to the Code requirements; that the relief requested is within
the spirit of the zoning ordinance; that the variance if granted will
not change the character of the neighborhoood; that no adverse effects
will be produced on available governmental facilities of any increased
population; that the hardship or practical difficulty is unique; and
that the interests of justice will be served by granting the relief
requested as noted below.

MARY ANN GREFE: My name is Mary Ann Grefe, and besides
reiterating what we already put down in the application the fact
that it is considered the sideyard to me' it is my backyard because
my house, my front door does not face the road. All right, so it
is considered sideyard; however, to me it is the backyard. Plus
the fact that it is adjacent to the backyards of all my neighbors,
plus as you probably already know that lot is heavily wooded and
none of my neighbors would be able to see the swimmingpool, nor
would you be able to see it from the road because of the fact
that it's heavily wooded.

Appeals.) I have a copy of the survey, original date filed was March
28, 1988, indicating the nature of this application which appears to
be entered into the survey as a barn. It is again adjacent to the
swimming pool area and I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in the area. Mrs. or Mr.
Bertani? Mr. Bertani. How are you tonight, Sir?
JOHN BERTANI: Fine, thanks. I'm here to answer any questions
I can for Mrs. Grefe. She couldn't be here and she doesn't live in
town. This all came about she's trying to sell the house, basically
she's trying to get everything in order.
MR. CHAIRMAN: I guess you built the barn is that what happened?
JOHN BERTANI: Yes, well, actually Mr. Grefe at that time had
gotten all the permits that were necessary, the requirement stamp for
the permit.
MR. CHAIRMAN: All right. What's in the barn?

JOHN BERTANI: There's a gas heater for the pool and you know,
he keeps garden tractors and so on and lawn cutting equipment.
That's it.
MR. CHAIRMAN: And the upstairs is just a storage?
JOHN BERTANI: Yeah, just empty storage. I'm going to do the
same thing.
MR. CHAIRMAN: So utility wise we have electricity and probably
water?
JOHN BERTANI: I don't think there's any water. Just gas, the
gas heater.
MR. CHAIRMAN: So, whatever water comes in is just the water
that's heating for the pool and it goes, it circulates.
JOHN BERTANI: It's just gas, I don't think ---
MR. CHAIRMAN: All right. Do any of you gentlemen have any
questions of Mr. Bertani? Jim?
MEMBER DINIZIO: How far does this barn set off the property line?
JOHN BERTANI: I think it's 3 to 4 feet in one corner and it goes
a little further as it goes back. The property line is at an angle.
MR. CHAIRMAN: No-one has any questions?
MEMBER DINIZIO: No, it's clearly in the right place for this piece
of property.

MR. CHAIRMAN: The height I think is 18, I remember viewing it.
