LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Applicants parcel is non-conforming, consisting of 11,671.9 sq. ft. in a R40 residential district. The parcel has 98.92 feet on Second Street, 118 feet on the north property line, 98.94 feet on the westerly property line, and 118 feet on the south property line. It is improved with a one story frame ranch type dwelling with an attached two car garage. Shown on a site plan prepared by Thomas Samuels, Architect, dated January 27, 2016. BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and Article XXIII Section 280-124 and the Building Inspector's January 20, 2016 Notice of Disapproval based on an application for a building permit to construct an accessory garage at: 1} proposed in location other than the code required rear yard, 2} lot coverage proposed at more than the code maximum allowed of 20%. RELIEF REQUESTED: The applicant requests variances to locate a proposed accessory two car garage, in the front yard at a conforming front yard setback where the code requires a rear yard location, and lot coverage of 23.07%,where the code permits a maximum of 20%. ADDITIONAL INFORMATION: The applicant proposes to convert the space in the existing attached two car garage into habitable space, and to construct a new 18 ft.x 22 ft. accessory 1 '/z car garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 3, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant - and makes the following findings: Page 2 of 3—March 17,2016 ZBA#6931—Roussan SCTM#1000-117-8-10 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is similar in size and non-conformity to other nearby parcels. The present home takes up much of the width of this very wide parcel. The mature trees and plantings on the subject property will effectively screen the proposed accessory garage from view. 2. Town Law 267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because of the existing location of the dwelling the applicant simply has no conforming rear yard and therefore can only place an accessory garage in the front yard area in a location adjacent to the existing driveway. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the front yard location and 15.4% for excessive lot coverage. However, the proposed accessory garage will be well screened from the road and neighboring properties by existing mature landscaping and the minimal size of the proposed accessory structure which is only 396 sq. ft. and 12 feet high. 4. Town Law 4267-b(3)(b)(4) No Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new 18' by 22' accessory garage in the front yard area while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Samuels and Steelman Architects and dated January 16, 2016. Subject to the following condition; CONDITION: 1. The accessory garage shall only be used for storage. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because the garage proposed is a small structure with a low roof line, and is almost completely hidden behind extensive landscaping. It does not intrude upon the required front yard setback, and, as such, is further from the street than is the building neighboring to the north. Similarly, it is further setback than is the newly constructed garage on the opposite side of the street, and significantly lower. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because the existing house sits almost entirely within the required setbacks, so that even a second floor addition would intrude on setbacks, requiring a variance. If the garage were attached to the existing residence, it would ' not require a variance, but it would block off all natural light and access to usable space in the existing garage, which will be converted into habitable space. 3. The amount of relief requested is not substantial because this is a variance, in part, to located an accessory structure in a front yard, which is an 'all or nothing' proposition. Regarding lot coverage, the proposal is not substantial because what is proposed is a 1-1/2 car, single story garage, about as small as it could be, while still accommodating a car and some storage for bicycles and gardening furniture and equipment. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because it is so minor. Many of the houses in New Suffolk exceed the allowable lot coverage, due to the small lot sizes in the hamlet. 5. Has the alleged difficulty been self created? NO. The existing house is located mostly in the required rear yard setback, and nearly fills the maximum lot coverage, meaning that any addition, no-matter how modest, would take the lot coverage over the required maximum. There are NO Covenants nor Restrictions concerning this land.
