SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 9, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a code conforming 140,080 square foot lot located in an R- 80 zone. The parcel runs 418.52 feet along Eugene's Road. The parcel runs 420.09 feet on the West side, 309.30 feet on the North side, and 370.87 feet on the East side. The parcel is improved with a two story frame house and garage and a frame shed. There are wetlands on the Northwest side of the property and there is a 100 foot wide scenic easement bordering the length of Eugene's road. The frame house and garage is 202.2 feet from Eugene's road and the frame shed is 105.1 feet from the road. All is shown on a survey by Nathan Taft Corwin L.L.S. dated October 13, 2015 and last revised January 26, 2016. BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and the Building Inspector's December 15, 2015 amended December 22, 2015 Notice of Disapproval based on an application for building permit to construct an accessory in-ground swimming pool and 'as built' accessory shed, at; 1)proposed in location otherthan the code required rear yard. RELIEF REQUESTED: The applicant requests variances to construct an in-ground swimming pool partially in the side yard and to permit the as-built shed to remain in the front yard where code requires a rear yard location. ADDITIONAL INFORMATION: Site inspection by the Board revealed that the existing residence is set back more than 200 feet from the road and substantial screening obstructs the view; and that the as-built shed is setback from the road at more than 100 feet and is buffered by a wooded scenic easement making it difficult to see. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—March 17,2016 ZBA#6930—Adams SCTM#1000-97-3-20.1 The Zoning Board of Appeals held a public hearing on this application on March 3, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes. This home is set far back from the street and is behind a 100 foot scenic easement which consists of wooded trees. The pool is only partially located in a side yard and it will not be visible from the street. The as-built shed is set behind the scenic easement however; the shed can be moved to a conforming location or removed. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant for the non-conforming location of the swimming pool cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The septic system is located in the rear yard and there is a New York state designated freshwater wetlands boundary on the Northwest section of the property making it difficult to locate the pool in a code conforming location. The shed could be located in a code conforming location in the rear yard. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, there are wetlands which limit the placement of accessory structures and a wooded scenic easement which creates a visual buffer so that the in-ground swimming pool will not be publicly visible. 4. Town Law 267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to DENY the variance as applied for, regarding the accessory shed, and GRANT the variance for the in-ground pool as applied for and shown on the survey by Nathan Taft Corwin LLS last updated January 26, 2016. Subject to the following conditions; 1. The accessory shed shall be demolished or moved to a code conforming location prior to the issuance of a building permit for the proposed in-ground swimming pool. 2.Pool mechanicals shall be placed in a sound deadening enclosure. 3. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Page 3 of 3—March 17,2016 ZBA#6930—Adams SCTM#1000-97-3-20.1 Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Lots 1 and 2; County Tax Map Parcel ID Nos. 1000-97-9-15 and 16. The board made the following findings and determination: By this appeal, applicants seek permission to construct an inground swimmingpool in an area in front (westerly) of applicants' one-family dwelling and a 20' by 20' garage structure abutting the brick patio of the subject pool at the northeast corner. The proposed pool is 20' by 40' , brick patio area 2800 square feet and garage structure 400 square feet. Upon inspecting the property, the board finds that only that area westerly of the existing residence is practical due to the loca- tion of the cesspools and the position of the residence. The premises in question is a corner lot as defined by Section 100-119A, fronting along Bay Avenue (a/k/a Skunk Lane) 125 feet and along Lupin-Drive a total of 327.38 feet. The lots in question are part of a major sub- division entitled, "Hickory Acres," Map No. 3325, subdivision lots No. 1 and 2. For the record it is noted that applicants originally proposed a 5' high fence along the frontyard area at-the northerly property line; however, it is the understanding of the board members that this proposal is no longer anticipated and applicants will be conforming with the zoning code with a maximum-height requirement for fences of four feet. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zon- ing code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible for appellants other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in considera- tion of all the above factors, the interest of justice will be served (CONTINUED ON PAGE TWO) DATED: March 29, 1983. Upon application of GEORGE AND NATALIE WIESER, 1415 Harbor Lane, Cutchogue, NY for a Variance to the Zoning Ordinance, Article III, Section 100-32, for permission to construct accessory swimmingpool in an area other than the rear yard, at 1415 Harbor Lane, Cutchogue, NY; County Tax Map Parcel No. 1000-97-6-10. The board made the following findings and determination: By this appeal , applicants seek permission to construct an inground swimmingpool with deck of an area totaling approximately 1 ,600 sq. ft. . and approximately 150 feet westerly from the ordinary highwater mark which is shown on the April 24, 1980 survey prepared by Roderick VanTuyl , P.C. The pool will be situated forward of the existing 1F-story frame, one-family dwelling and will have a setback from the north and south side lines approximately 60' and 45' , respectively. The premises in question is located at the east side of Harbor Lane, Cutchogue, contains approximately 2.0 acres in area, and has a width of 168 feet (average). For the record, it is noted that the property in question has received conditional variances on February 25, 1983, Appeal No. 3071 for an accessory storage building and on November 25, 1983, Appeal No. 3177 for conditional approval of access over applicants' 15' wide right-of-way. In considering this appeal , the board determines: (a) that the relief requested is not substantial ; (b) that by the granting of the requested relief, a precedent has not been set and therefore will not adversely affect the character of the neighborhood; (c) that by allowing the variance, no substantial detriment to adjoining properties would be created; (d) that no adverse effects will be produced on available governmental facilities of any increased population; (e) that the relief requested will be in harmony with and promote the general purposes of zoning; and (f) that the interests of justice will be served by allowing the variance, as indicated below. No. 4217. Upon Application of THOMAS PULS and. DONNA RICCO. A variance is requested from Article IIi, Section 100-33 for permission to locate swIimmingpool with fence enclosure in an area other than the required rear yard. Location of- Property: 1350 Eugene`s , Road, Cutchogue. NY; County Tax Map Parcel No. 1000-97-6-1.2. Zone District: R-80 Residential. The subject premises is a substandard lot. BASIS OF DISAPPROVAL. This is an application based upon the following Notice of, Disapproval.- from the Building Inspector to construct a pool with fencing partly in the side yard and partly in the rear yard area, which Notice dated February 9, 1994 is .worded as follows: "... Disapproved on the following grounds: Under Article iiI, Section 100-33 accessory structures and uses shall be located in the required rear yard. Action required by the Zoning Board of Appeals; Action also required by the Board of Town Trustees and N.Y. State Department of Environmental ...." 2. CODE REQUIREMENTS. Article III, Section 100-33, requires accessory buildings and structures to be located in the rear yard, or in the case of a waterfront parcel, in the front yard. The rear yard of this parcel is technically that yard area south/southeast of the •, Page •2 -- Appl. PROPERTY DATA. The premises in:question was conveyed by Mark McDonald and Patrick Carrig on January 6, 19811- to the applicants herein: The subject parcel is described (rather than part of a subdivision) and is situates on the southerly side of, Eugene's Road, Cutchogue (East). The size of this parcel is• shown- to be approximately .73 of an acre with 202 ft. frontage along Eugene's Road, and is improved with a single-family, two-story frame house situated 61.3 feet from the front property line, 24.8 feet from the westerly side property line, and approxin y• 90 feet from the rear of• the foundation to the tie line along high water mark (74+- feet from the edge of, the deck steps to the southerly highwater line, and 77+- feet to the easterly- highwater line, at its closest points). The property has variable. and low contours, which lend to the limitations for building in• reasonable locations while meeting all other zoning code requirements. 4. PROPOSAL. This application is a request to locate an 18 ft. by 38 ft. inground swimming pool in the side yard approximateLy-8 ft. from the easterly side of the dwelling which will leave a setback at 52 feet from the easterly property line. A 9-It. open deck with raised wall and planter will further reduce the setback to the side property line to a distance of 49 feet at one point and 42.6 feet at another point. 5. INSPECTION(S) AND RESEARCH DATA. (a) An inspection of- the site reveals ° that the house is presently set back approximately- 90 feet from the side property line (along the highwater mark) at its closest point. No other buildings or structure are proposed {or exist at the premises} except that landscaping and berm areas are to be placed in-the- front yard, not to exceed four feet in height. (b) Regrading and new landscaped areas must be done to keep surface water runoff directed away from the tidal wetlands and the property owners will be required to either truck the pool water off site, or properly install drywall drains. 6. OTHER TOWN AGENCY JURISDICTION/REVIEW. Submitted for the record is a copy• of the written authorization issued by the Board of Southold Town Trustees dated March 24, 1994 under Permit No. 4296 for this project. No information has been submitted to show whether or not a permit was acted upon by•the N.Y.S. Depart of Environmental Conservation, for which an application may be pending at this time. Department of• Enviironmental- Conservation. 7. EFFECTS OF RELIEF REQUESTED. It is the position of this Board that in. considering the relief requested and more particularly shown on the landscape plans- dated 2-9-94 prepared by Briarcliff Landscape that: (a) the location of the swimmingpool structure in•the side yard is not unreasonable• in. light of- the fact that the rearyard has low elevations -and may not be disturbed; (b) the grant of the relief- to locate the pool in the requested sideyard rather than the rearyard will not alter the essential character oft the neighborhood due to the nature of, the layout and characteristics of- this- site; (c) the benefit sought to be achieved by the appellants cannot be achieved by a method other than a variance under the zoning regulations; (d) the difficulty will not have- an adverse effect or impact on the physical or environmental conditions in.the neighborhood since the appellants will be required to either truth the pool water off site or install drywells as recommended by the environmental agencies of the Town and-State, NOW, THEREFORE, on motion by Member Wilton, seconded by Chairman Goehringer, it was RESOLVED, to GRANT relief to locate the proposed 18 'ft. by 38- ft. swimmingpool with nine-ft. deck area and fence enclosure in- the easterly side yard, as requested. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the pool area be open to the sky, without a building enclosure; 2. That there be no lighting that would- be adverse to neighboring areas; 3.
