SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Feb. 9, 2016, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP_DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 15,579.14 sq. ft. parcel in the R-40 zone. The northerly lot line measures 105.00 feet along Aquaview Ave. The easterly lot line measures 150.00 feet along an adjacent residential parcel. The southerly lot line measures 105.00 feet along a currently un- developed 9.2 acre parcel, and the westerly lot line measures 150.00 feet, partially along Circle Drive, and partially along the 9.2 acre parcel. The property is improved with a single family dwelling, and an in-ground swimming pool, as shown, with proposed additions, and proposed setbacks, on the site plan labeled SP1 drawn by Mark Schwartz&Associates,undated. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's December 18, 2015 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the minimum code required front yard setback of 35 feet,2)more than the code maximum allowed lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to construct additions with a proposed front yard setback of +/- 32 feet from Aquaview Avenue, a proposed front yard setback of +/-31 feet from Circle-Drive, where setbacks of 35 are required by code, and proposed lot coverage of 22.6% where 20% is the maximum allowed by code. ADDITIONAL INFORMATION: Prior ZBA decision 2910, dated Oct. 8, 1981 established a 32 feet front yard setback on Aquaview Ave., and a 31 feet front yard setback on Circle Drive. Circle Drive is an unpaved private Page 2 of 3—March 17,2016 ZBA#6928—Mantikas SCTM#1000-21-3-11 ROW that provides access to several other parcels. This parcel is a corner lot and has two front yard areas. Two neighbors addressed the potential hazards of on-street parking because of the narrow roads in the neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 3, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The front yard setbacks on Aquaview Avenue and Circle Drive were established by ZBA decision 2910 in 1981, and will remain unchanged by the proposed construction. The proposed alterations and additions are consistent with typical enlargements over time to many single-family dwellings. The amount of non-conforming lot coverage is a consequence of the proposed building additions on the small, non-conforming size of the parcel; however this is not a unique situation compared to other similar-sized non-conforming parcels in the neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling has two non-conforming front yard setbacks, and therefore any new construction within these areas require variances. The applicant is unable to construct the additions without increasing the existing lot coverage of 18% to the proposed non-conforming 22.6% lot coverage;therefore a variance is required. 3. Town Law &267-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 8.5% relief from the code for the Aquaview front yard setback, 11.4% relief for the Circle Drive front yard setback, and 13% relief for the non-conforming lot coverage of 22.6%. In addition, the front yard setbacks were established by the ZBA in 1981. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary.and adequate to enable the applicant to enjoy the benefit of new additions to the single family dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Dantes, and duly carried, to GRANT the variance/variances as applied for and shown on the site plan and architectural drawings labeled SP1A1-9 and T1 SP1 drawn by Mark Schwartz&Associates, undated. CONDITIONS: 1. The applicant shall provide a minimum of four(4)parking spaces on site. 2. Prior to the issuance of a building permit, the applicant shall remove all existing fencing that is not on the subject property to wit: along the north, south and westerly property lines. In your letter, you explain that the scale of the currently proposed project is less than the previous approved plan associated with Appeal No. 6928, dated March 17, 2016, and that the front yard fencing has been removed and the pool fencing has been relocated as per the submitted site plan. Your current plans indicate a reconfigured single family dwelling with a front yard setback of 29.6 ft. from Circle Drive instead of the approved distance of 31 ft. 11 in., a 39.5 ft. front yard setback from Aquaview Avenue instead of the approved distance of 32 ft. 8 in., and a lot coverage of 22% instead of the approved lot coverage of 22.6%. Based upon the information provided, and depicted on the site plan prepared by your firm, dated October 18, 2017, I have determined that your requested modifications to a proposed single family dwelling are de minimus in nature. Although the front yard setback from Circle Drive will slightly increase the degree of non-conformity, the other changes will eliminate the need for one setback variance and reduce the non- conformity of the lot coverage while upholding the intent of ZBA Appeal No. 6928.
