SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 3, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is a conforming 48,678 sq. ft. lot in the R40 Zone District. It is improved with a one story residence, an accessory in-ground swimming pool and accessory shed. It has 334.63 feet of frontage on Bayberry Road, 115.00 along the north property line, 287.00 on the east property line and 140.92 along Bridge Lane as shown on the survey dated 23rd December 2015 prepared by Nigel Robert Williamson,Architect. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's November 19, 2015 Notice of Disapproval based on an application for building permit to construct an accessory garage, at; 1)proposed in location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to locate an accessory garage in a Front Yard location whereas the Code requires a Rear Yard location as shown on the Site Plan prepared by Nigel.Williamson, R.A., dated 12/23/2015 and the architectural drawing, sheet A-1, of the proposed accessory garage prepared by Amish Backyard Structures, dated 4/10/2015. ADDITIONAL INFORMATION: Applicant was granted a prior variance under ZBA#3291 in 1985 for an accessory in-ground swimming pool in the front yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—March 17,2016 ZBA#6921—Pagoto SCTM#1000-111-15-1 6 The Zoning Board of Appeals held a public hearing on this application on March 3,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An accessory garage is a common structure in residential neighborhoods, and the applicant proposes to locate same at more than 100 feet away from Bridge Lane and 30 feet at its closest point from Bayberry Road on this parcel with two front yards. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject property is a corner parcel having two front yards and along with the existing dwelling's location creates a small rear yard area in which to locate an accessory garage in a conforming location. It is not feasible to attach a garage to the existing dwelling because of the interior layout of the dwelling. Furthermore, this parcel has a sloping grade which runs approximately 350 feet diagonally across the property with an elevation differential of over 35 feet from the highest point in the northeasterly rear yard location to the lowest point at the intersection of Bridge Lane and Bayberry Road, creating a challenging and difficult building site. The proposed location is the most feasible because it can easily access the existing driveway and minimize land disturbance and existing tree removal. 3. Town Law 267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the proposed location is over 120 feet from Bridge Lane and 30 feet from Bayberry Road. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage in a front yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, and as shown on the Site Plan prepared by Nigel Williamson, R.A., dated 12/23/2015 and the architectural drawing, sheet A-1, of the proposed accessory garage prepared by Amish Backyard Structures, dated 4/10/2015. Subject to the following condition; CONDITION: 1. The garage shall be used for storage only and shall remain unheated and unfinished. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The most northerly end of the pool area is proposed to be brick patio at a width of approximately 12 feet ; 5. The proposed pool and decking is requested to be set back not less than 25 feet from the easterly property line and at a distance of 90 to 100 feet from the southerly front property line ; 6 . For the record it is noted that the premises in question was the subject of a prior variance , under Appeal No . 2461 by Thomas and Rosa Fucile . of August 17 , 1978 , which conditionally permitted the construction of a one-family dwelling on vacant land with a minimum setback of 40 feet from Bayberry Road and 50 feet from the northerly and easterly property lines ; 7 . Article III , Section 100-32 of the Zoning Code permits accessory structures to be located only in the rearyard area ; 8. It is the opinion of the board members that in view of the fact that the premises is a corner lot with limited rearyard area and for the reasons stated by the applicant, the requested location of the structures in question is the most feasible under the circumstances . In considering this appeal , the board determines : (a ) that the relief requested is not substantial ; (b) there will be no effect on population density and will not affect available governmental facilities ; (c) there will be no substantial change in the character of the neighborhood or a substantial detriment to adjoining properties ; (d) the circumstances of this appeal are unique in that this is a corner parcel ; (e ) that there is no other method feasible for appellant other than a variance ; (f) that in view of the manner in which the difficulty arose , justice will be served by allowing the variance applied , as noted below.
