APPLICANT: Jay and Mary Thomson LOCATION OF PROPERTY: 3605 Bay Shore Road Greenport, NY. COUNTY TAX MAP DISTRICT 1000, SECTION 5 BLOCK 6, LOT 14. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector 11/30/94. Proposed "addition exceeds permitted lot coverage.- PROVISIONS APPEALED FROM: Article IIIA, Section 100-30A.3. RELIEF REQUESTED: 12' x 12.4' addition at the westerly end of the existing dwelling for expanded living floor area. Lot coverage requested to be 25.86 percent of the 7623 sf lot size. Nonconforming setback at 7+- feet to be maintained at the southerly side without further reduction over existing nonconformity. Lot coverage as exists without addition is shown by owner to be 1823 sq. ft., or 23.34 percent. MOTION MADE BY: Member Villa SECONDED BY: Member Dinizio ACTION/ RESOLUTION ADOPTED: Denied 12' x 12.4' addition as requested and granted alternative lot coverage to allow for an 8' x 12.4' wide addition, maintaining the side yard as exists at the south side and extending not more than eight feet towards the road subject to the following conditions: (1) no manufacturing, sales or millinery is permitted; (2) no further lot coverage increases over than the existing (1823 sq. ft.) and 99.2 sq. ft. granted by this variance; (3) cellar entry shall be located on side of house, as required by Building Inspector for safety and fire purposes. REASONS/ FINDINGS: Prior lot coverage variance was issued 7/5/79 under #2561. Property presently has a lot coverage of 1823 sq. ft., and with additional 99 sq. ft. will be 1922 sq. ft., or 25% of lot size. House has existed since 1950+- on this substandard parcel. Unusual size and dimensions of the land, together with established nonconforming rear, bulkhead, and side yards of preexisting dwelling structure, having existed lend to difficulties in conforming with the lot coverage limitation. Wilton Telephone (516) 765-1809 BOARD OF APPEALS TOWN OF SOUTHOLD MEMORANDUM TO: John Boufis, Building Inspector FROM: Board of Appeals DATE: February 2, 1995 RE: Your Inquiry - Appeal No. 4292 - Jay and Mary Thomson You have advised us that the location of the cellar way (bilco entry) at the southerly side of the proposed addition would be inappropriate and unsafe, particularly due to the fact that a 2' setback would obstruct access on that side in the event of a fire. Also, you have been advised that there is a water line approximately 4' deep at the opposite side of the proposed addition, which is inappropriate since the bilco door would need to be 5' deep and would disturb the water line. Please be aware that Condition No. 3 of the above determination dated January 4, 1995 is worded in a manner which will authorize you to locate the bilco entry for the cellar in a safe and more appropriate location to meet other codes. The words "as required by the Building Inspector" also means "as suggested by the Building Inspector" alternatively. I have a copy of the survey which is dated back to May 15, 1978, which indicates it's one and a half story frame house which again sits approximately in the center of the property. I only brought three. (Talking amongst themselves). That is the interior of the room standing in the doorway, the first photo you see. The second photo is another shot of the room itself, if I may go along with you. If you see that lamp in the middle of there, there's a bureau in between, you cannot open the draws because the chairs are so tight together. On this one, the, this bookcase here, you can't open the bottom because it hits the couch. This was taken from across the road. There's the notice that I was required to put up. If you look very closely down at the base of this there are two white chairs which you can't see it, you can barely see. Those are the extent of the addition. You see this building to your right here, this is a garage. It's almost the length of the property. There's about a 15 foot opening. The next photo shows getting closer. Again, if you look between the side of this tree here, you see the two windows. That's where the addition starts, right there next to the shutter. MEMBER WILTON- You won't be any closer to the road than the garage next to you? JAY THOMSON: I won't even be out as far as the garage. MR. CHAIRMAN: His existing garage. JAY THOMSON: My own garage. MR. CHAIRMAN: Yes, his own garage. JAY THOMSON: That green garage is only 5 or 6 feet back from the road. That will be as it shows with shrubbery in it. MEMBER VILLA: So, it's going over to the, as far to the right as your existing house. So, it's, what and I don't, I don't have a survey. JAY THOMSON: Which photo are you looking at? Well, if you go through the photos, I think it will become self-explanatory. In this photo right here, you see the two white chairs, those are the end of the addition. MEMBER VILLA: Unfortunately, there's three chairs. JAY THOMSON: No, the two white chairs on the right hand MR. CHAIRMAN: That are in line with the barbecue grill. MEMBER VILLA: Well, there's one, two JAY THOMSON: Well, these two right here, these, the two right ones. MEMBER VILLA: OK, I'm looking at the one that was half in by the tree, that's a third one. Come over to this chair and go right back in between, well, right where this, right where the photo ends. MEMBER VILLA: Alright. So, you'll be 5 feet in front of his. JAY THOMSON: You'll notice his building has no windows on that side. It's MEMBER VILLA: What you're saying is that he's out 7 feet and you're going to 5 feet in front of that, you're going out 12 feet. JAY THOMAS. Correct, but then you go another 6 or 7 feet he has a full length garage running right on the property line. Alright, now I've stepped back to the garage. You see where the chair is, not the first white chair, but the second one? MR. CHAIRMAN: Right. JAY THOMSON: That's where it will start. It's a perspective problem because it's a 12 x 12 room, then I'll just a, take in another shot, it shows another of how far that building next to me extends right along with what I'm going to. Because they are extremely small lots in that area, most of us that had majority are what I call a single lot, some people were brilliant years ago and bought double lots and then put their house in the middle or offset it to one side. So what we've done their house is parallel to ours. Now, the Czako use to own it and that's where I wish to put the addition. This small odd little box at the end is my entrance to the basement. That will have to be moved and I'll have depth. MR. CHAIRMAN: So you're going to have a basement in there I guess. JAY THOMSON: There is a basement. MR. CHAIRMAN: No, I mean in the addition ( JAY THOMSON: I have to put a walk space. I have no other access to the basement. So literally the doors that now exist will simply be moved out. There is a very large, right at the end of this is a very large apple tree which in the summertime and this end of the lot is very heavily wooded as you, if you look at the photos. It is difficult to even see this end of the house in the summertime. With that apple tree full which is very important where we live because we don't get the afternoon sun. We get the morning sun which cooks the house. If we got the afternoon sun too, it would be a broiler. But, the trees protect us from the afternoon sun, the later afternoon sun and a, this additional will only be visible from one portion of the property itself. As you get down on the south side it will disappear behind the tree. MEMBER VILLA: And the tree is behind the garage, your neighbor's garage. JAY THOMSON: Yes. The garage is actually right here. Their garage is there.
