BASIS OF APPEAL: Notice of Disapproval issued by the Building
Inspector 10/28/94. "Proposed construction will have insufficient front
yard setback."
PROVISIONS APPEALED FROM: Article IIIA, Section 100-30A.3.
RELIEF REQUESTED: Four (41) extension to living room which is 20
feet wide along front of dwelling, leaving a reduced setback from 37
feet to 33 feet (confirmed by owner in the application).
MOTION MADE BY: Goehringer SECONDED BY: Dinizio.
ACTION/ RESOLUTION ADOPTED: Approved 4' x 20' wide addition, as
applied, in order to increase living room area, leaving a reduced front
yard setback at the requested 33 (or 32.9) feet. No reduction in side
yards to less than code requirements requested.
REASONS/ FINDINGS: Variance requested is minimal at two feet from the
code requirement. No other alternative is available since the dwelling
is located as shown since prior to the enactment of zoning (prior to
1957). Property has frontage along two access routes and is
substandard in size (assessors' records show the property to be .30 of
an acre, or 16,000 sf. House has existed for over 50 years.
Substandard size and unusual dimensions of the land lend to difficulties
in conforming with the setback requirement.

approximate placement of the house on the property and the notice of
this request basically reducing the front yard to approximately 33
feet. I have a copy of the Suffolk County Tax Map indicating this
and surrounding properties in the area. Mr. Smith would you like to

A. i1DAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with, or which border on. tidal waters, or lands
lying beneath tidal waters. which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet. including but not limited to banks.
bogs, salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action;
(2) All banks, bogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black
grass, saltworts, sea lavender, tall cordgrass, high
bush, cattails, groundseL marshmallow and low
