BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector on
July 18, 1995. "Proposed construction is less than 75 ft. from bulkhead . and
will have insufficient side yard setback...."
PROVISIONS APPEALED FROM: Art. IIIA, Section 100-30A.3 and Article XXIV,
Section 100-244B.
RELIEF REQUESTED: Variance for addition for open deck with reduction in
south (south/east) side yard setback from present 7.5 feet to a requested 3.5
feet, and reduction in setback from bulkhead from present 55 feet at the
northeasterly corner to a requested 35 feet at its closest point.

ACTION/ RESOLUTION ADOPTED: Denied 3-1/2 ft. reduction in sideyard, and
Granted setback from bulkhead provided deck is not wider than the existing
width of the house and is not closer than 35 ft. to the bulkhead at the
northeasterly corner at its closest point.
REASONS/FACTS: The setback requested is similar to those existing along the
waterfront in this area. The relief requested will not produce an adverse
effect or impact on the physical or environmental conditions of the neighborhood
as an "open" and "unenclosed, unroofed" deck addition. Grading and drainage is
not to be toward the waterway or bulkhead area and shall be property retained.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Cade of the Town of Southold, that the following public
hearing will be held at a Regular Meeting. of the SOUTHOLD TOWN BOARD
OF APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on WEDNESDAY, AUGUST 9, 1995 commencing at the times
specified below:
7:30 p.m. Appl. No. 4319 - YOSHIMASA OSATO. (Carryover from
July 12, 1995). Proposed addition with reduced front yard setback at
35 Sunset Way and 3250 Cedar Beach Road, Southold.
7:35 p.m. Appl. No. 4324 - RICHARD MAUTNER. Variance under
Article IIIA, Section 100-30A.3 and Article XX1II, Section 100-239.4B,
based upon the disapproval action of the Building Inspector dated July 18,
1995. Applicant proposes to construct deck addition at the rear of
existing dwelling which will have an insufficient side yard setback or
insufficient setback from bulkhead. The subject property is nonconforming
having a lot area of 16,875 sq. ft. and a lot width of 50 feet. Location:
2055 Bay Shore Road, also referred to as Lot 34 on the Map of Peconic Bay

Continuation of hearing carried over from June 7, 1995 and further
postponement from July 12th per request of attorney for applicant.
Location of Property: 580 Basin Road, Southold, NY, Paradise Point
Section One, Filed Map 3761-4/11/63; also known as 1000-81-1-16.7
(formerly part of 16.4). This request is based upon the March 29, 1995
action of disapproval by the Building Inspector, wherein applicants are
requesting a building permit to locate a new single-family dwelling,
disapproved on the following grounds:

Point, Section One, as a building lot; Section 100-281A-7. Single and
separate search required back to 1957.
2. Approval required by Board of Appeals to build single-family
dwelling as a second use on this 1.79-acre parcel. R-80 Zone requires
80,000 sq. ft. of land area per use (or 160,000 sq. ft.), Article III,
Section 100-30A.
3. Approval is required from Board of Appeals under Article
XXIII, Section 100-239.411 for location of dwelling with decks at less than
75 feet from the existing bulkhead...
7:55 p.m. RE-HEARING of Appl. No. 4128 - BREWERS YACHT YARD, INC. k
Based upon the July 12, 1995 Board Resolution, a rehearing is held to
re-consider the use applied for by Brewer Yacht Yard. at Greenport, Inc.
on September 2, 1992, under Article XII, Section 100-12IB(1), Special
Exception #4128, for food services to its marina patrons and others.
Subject premises is located in the M-II Zone District, identified as Parcel
No. 1000-43-3-2. Street address: 2530 Manhanset Avenue, Greenport, NY.
The Board of Appeals will at said time and place hear any and all
persons or representatives desiring to be heard in the above matter.

sets of plans, accurate plot plan to scale. Fee according to schedule.

c. The work covered by this application may not be commenced before issuance of Building Permit.

I am writing in response to a certified letter which was
sent to my mother, Jane Schumacher, for whom I have Power of
Attorney, concerning the addition of a wrap-around deck to the
property located at 2055 Bayshore Road, Greenport, New York
11944, which is adjacent to my mother's property.
My mother has.great concerns with respect to the addition of
the proposed wrap-around deck which the Mautners plan to build
within three and one-half feet of her property line. She feels
that the proposed deck will only add to the loss of privacy which
she has already experienced as a result of the addition of a
second story to the Mautner's home. The addition has created the
feeling of a large looming building hovering above her property,
and the addition of the deck will further deplete what is left of
her privacy with the constant traffic flow in and out of a side
kitchen door. This traffic will be added to the disruption
already produced by an outdoor shower which has already been
built nearly paralleling my mother's deck, where she has enjoyed
a sense of privacy for nearly 35 years.
A similar side entrance was built to the home on the south
side of my mother's home many years ago, and through the years
resulted in constant noise and disruption to any privacy our
family hoped to enjoy on our own deck.
Not only will my mother's privacy be altered with the
addition of this deck, but her view will also be reduced with a
deck of this size being built in front of the Mautner's home.
She feels that the deck should not wrap around to the side door,
but be contained at the front of the house and well within the
required distance from her property line. She believes that any
changes or additions should be well within the legal limits
imposed by the zoning ordinance, which in some small way, may
help her to retain what little, if anything, is left of her
privacy.

Attached is a copy of a survey of the Mautner's home upon
which we have drawn the approximate location of my mother's home
in relation to the Mautner's. This should show you more clearly
what the impact of such a wrap-around deck would have on her
property and privacy. We have all chosen Greenport, and more
particularly, Bayshore Road for its beauty, peace and quiet. We
should be able to sit on my mother's deck and read a book or have
a quiet dinner without being disrupted by "bathing suit" traffic
which would be increased with the addition of a wrap-around deck
to the side kitchen door. Any traffic, including handicapped,
could easily be accommodated through the sliding doors at the
water side of the house.
Any consideration you may give to this request is greatly
appreciated.
