ACTION OF THE BOARD OF APPEALS
DATE OF ACTION: November 8, 1995 APPL. #4346.
APPLICANT: REGINALD MINOR.
LOCATION OF PROPERTY: 360 Private Road #1, Stephenson Rd, Orient.
COUNTY TAX MAP DISTRICT 1000, SECTION 17, BLOCK 1, LOT 12.
BASIS OF APPEAL: Notice of Disapproval issued by the Building
Inspector dated October 3, 1995.
PROVISIONS APPEALED FROM: Article XXIII, Section 100-231 and
Article IIIA, Section 100-30A.4 (ref. Article III, Section 100-33).
RELIEF REQUESTED: Proposed swimmingpool in a yard technically
defined by the zoning code as a front yard location, and proposed
fence, as built, at six feet in height along a front yard. Proposed
pool is shown to be 10 feet from the easterly property line and more
than 200 feet from the Main Road.
MOTION MADE BY: Robert A. Villa; SECONDED BY James Dinizio, Jr.
ACTION/ RESOLUTION ADOPTED: Granted as applied.
REASONS/ FINDINGS: Requested location is not unreasonable since it
will be placed in the yard area which is normally a rear yard, and due
to the location of a right-of-way is considered a front yard. This
property does not have a designated rear yard as regulated by the
code. No other alternative is available, nor is any other yard area
better suited to this type of construction. Fence heights up to 6-1/2
feet are normally permitted along a designated rear yard.
VOTE OF THE BOARD: Ayes: Serge J. Doyen, Member

Richard A. Wilton, Member
Lydia A. Tortora, Member

Dear Mr. Minor:
Please find enclosed a copy of the determination rendered by the

with the Town Clerk's Office concerning your variance application.
A copy of this determination has also been furnished to the

Re: Appl. No. 4346 - Pool Location and Fence Height (Variance)
Dear Mr. and Mrs. Minor:
Please find enclosed a copy of the Legal Notice sent for
publication in this week's newspaper by our office. Someone who is
familiar with the property should attend the public. hearing (not
later than the time specified) for your application in order to
answer possible questions.
Also, enclosed is a Poster which must be placed at this time
either on a stake or other post, or on the front of a tree facing the
entrance to the right-of-way or your driveway where it can be easily
seen. Appeals Board Members will each (probably at different,
separate times) visit the neighborhood, and it may be easier for them
to locate your house if the poster is placed where your driveway
starts.
After you have placed the Poster, please be sure to check it to
be sure it has not been removed for seven days. If you need
another sign, call us or stop by and we'll give another. After the
sign has been posted for seven days, please sign and return the
enclosed "Confirmation of Posting," or bring it to the hearing.
If you have any questions, please do not hesitate to call our
office.
Very truly yours,
Linda Kowalski
