BASIS OF APPEAL: Two separate Notices of Disapproval issued by the
Building Inspector ~ each dated November 7 ~ 1994: "Accessory
building~ as built~ shail be located in the required rear yard~" and
"deck addition~ as built~ with insufficient rear yard setback."
PROVISIONS APPEALED FROM: Article III~ Sections 100-32 and 100-33.
RELIEF REQUESTED: 10' x 12' accessory shed located previously in the
rear yard, and now situated in a side yard, 35'9" from the southerly
property line and more than 60 feet to the easterly side property line.
Subject deck addition is shown 33 feet from the rear property ]Line
instead of the required 35 feet.

REASONS/FINDINGS: Prior to location of deck, accessory shed was
located in a required rear yard. Amount of deck subject to variance
consideration is two feet. The variance is not unreasonable and is
minimal, under the circumstances.

permission to locate an accessory garage building in the southerly

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
saw HARDSHIP because the configuration and location of the premises made
it impossible to construct either the accessory shed or rear deck except
as e~ch was constructed. Both have existed in their present locations for
some period of time and have caused no difficulties for the neighborhood.
Disapproval of this application would require removal of additions which
add substantially to the liveability of the premises and whose placement
does not in any way detract from the appearance of the residence or thwart
the overall enforcement of zoning laws in the Town of Southold.
2. The hardship creotedis UNIQUEandisnotshared by all propeffies alike in the immediate
vicinity ofthis property and in this use district because when the main residence was con-
structed it was squeezed into the southerly portion of the existing lot
leaving little room for rear yard additions. To ease this problem, the
applicant purchased an additional parcel of land to the East and North of
the original.lot~ but such purchase increased the assembled square footage
to 21,188 which in turn increased the rear yard setback fOotage from 35'
to 50'. As it now stands, the rear deck is 33' from the rear property
line and the shed is 35' feet from the rear lot line and approximately 65'
from the side lot line. It'should'als~ be no'ed that the rear 'lot line
abuts property of the Oysterponds.School District which is open land~
therefore the minimal incursion of the existing rear deck into the required
rear yard area has little~ if any, impact upon the neighboring property. .'
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE Dl~lKICTbecause all lo~s in the area are below standard size
according to current Southold Town Zoning. Most of the logs have been
improved and the homeowners have attempted' to maximize their use of the
available land. This applicant has attempted to increase the size of his
property by purchasing the land between his original lot and the Oysterponds
School as well as the land between his original lot and his neighbor to the
North. Even with such additions, the new Town of Southold setback require-
ments can not be met, but applicant's rear deck and accessory sh~d are in
keeping with the character of the community and do not detract from the
appearance of the area.

Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)), this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.
