PROPERTY FACTS/DESCRIPTION: The Applicants' property consists of a total (merged) area of
36,375 square feet, with 365 feet along the east side of Tuthill Road and 67.90 feet along C.R. 48
(a/k/a Middle Road). The property is improved with the following: (a) one-story, single-family
dwelling, (b) a detached one-story garage, and (c) one-story frame house, presently under
reconstruction.
BASIS OF APPLICATION: Article II, Section 100-26, based on the Building Inspector's November
17, 2003 Notice of Disapproval, which stated that the subject lot was as a result of mergers under
Section 100-25 due to common ownership with the first lot at any time after July 1, 1983.
APPLICANTS' REQUEST: Applicants request Lot Waivers to unmerge CTM Lot 6 and CTM Lot 9
from the remaining CTM Lot 8.
FINDINGS OF FACT
The Zoning Board of Appeals held public hearings on these applications on March 18, 2004, at
which time written and oral evidence were presented. Based on all testimony, documentation,
personal observations of members of the board, and other evidence, the Zoning Board finds the
following facts to be true and relevant:
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
1. The title search, prepared by Ticor Title Insurance Company dated January 20, 2004, indicates
that all three lots were held in separate deeds by predecessors in title dating back to 1944. On
June 15, 2001, Sue Mason conveyed each lot individually, as follows: CTMs 9 and 6 conveyed to
Kelly L. Krudop and CTM 8 conveyed to Robert H. Krudop.
2. The Board received testimony from the applicants and their attorney that the lots were
purchased with the intention of building a future dwelling on each. As further evidence that the
applicants had not intended to merge CTM Lots 6 and 9 with the remaining area (CTM 8), they
point to many facts, including lack of drinking water and that there was a concrete foundation
remaining from a house that existed until about 1990, and an accessory storage building which
was in disrepair at the time of purchase on June 15, 2001. There also was an encroachment on
CTM 9 of approximately four feet of the corner of the house. While planning to build a contractor's

storage workshop on the existing foundation in 2001, the applicants obtained approvals to move
the house to a more conforming location on CTM 8. During October 2003, the Town changed the
zoning of the area from Light Industrial to R-40 Residential. Also, CTM 6 had a small bungalow on
it, however the house was taken down when the County condemned a portion of the property for
widening of County Road 48.
3. The waivers of merger for CTM 6 and CTM 9 will recognize the original lot lines shown on the
deed recorded at Liber 12126 page 510. The waivers will result in lots similar in size to lots in the
immediate neighborhood. CTM (vacant) Lot 6 consists of 9,334.08 square feet, and CTM (vacant)
Lot 9 consists of 12,254.58 square feet. CTM Lot 8 of 14,787.45 square feet will remain improved
with two dwelling structures and a detached accessory frame garage.
4. The waivers of merger will allow for the ultimate construction of two single-family residences in
the neighborhood, one on CTM 6 and the other on CTM 9, which will not result in a significant
increase in the density.
5. The waiver will avoid an economic hardship for the applicants and their family. •
6. The waivers of merger will allow for construction of one single-family dwelling on the lots as
originally conveyed, which will not result in a significant increase in the density of the
neighborhood. There will be no need for significant change in its contours or slopes, and no
evidence was presented to suggest that the lots would require filling affecting nearby
environmental or flood areas, or to suggest that its natural details, character, contours or slope
would be significantly altered in any manner.
7. In granting the waivers, the Board finds that the interests of the town will be served because the
applicants intend to reconstruct a house on the property within the required setbacks for this zone,
utilizing all of the current codes pertaining to fire, building, safety, and zoning codes that apply.
RESOLUTION: On motion by Member Dinizio, seconded by Chairwoman Oliva, it was
RESOLVED, to GRANT the lot waivers, as applied for.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.

APPLICANT' S REASON #1 :
Your applicant purchased from Sue Mason on June 15, 2001, a
vacant lot at 50 Tuthill Road, Cutchogue, New York (SCTM #1000-
096 . 00-01 . 00-006 . 000) , hereinafter referred to as Tax Lot 6 .
At the time of the purchase of this property it was zoned "Light
Industrial" (LI) . Originally my purpose in purchasing this lot
was as an investment to build a one-story contractor' s storage
building and workshop to be rented out as space was sorely
needed for this type of use in the Town of Southold. However,
on October 7, 2003 due to political and racial considerations,
the Southold Town Board created in its minds eye the "Church Lane
Neighborhood" , and changed the long standing "Light Industrial"
(LI) zoning to "Residential" (R-40) involving 15 individual
properties (a copy of this Town Board resolution is attached
hereto as Exhibit 1) .
Rather than contest the R-40 spot zoning designation by the
Town Board, I decided to build an affordable one-family residence
on this property. I filed a building permit application only to
find that the Building Inspector wad adding insult to injury in
that he had merged this property with the adjacent lot (SCTM
1000-096 . 00-01 . 00-008 . 000) at 170 Tuthill Road which is owned by
Robert H. Krudop (a copy of the Notice of Disapproval of the
Building Inspector dated November 17, 2003 is attached hereto as
Exhibit 2) .
When I checked with the prior owner, Sue Mason, I was
informed that Tax Lot 6 was always separate and was never a part
of Tax Lot 8 . Further, Tax Lot 6 was originally owned by Sue
Mason' s grandmother and had a small bungalow on it . However, the
house was taken down at the time the County of Suffolk condemned
a portion of the property for widening of County Road 48 . In
1984 this lot was transferred by Pearl Taylor to Sue Mason' s
father, James Mason. In 1994 Sue Mason also informed me that
when she found out her mother and father were ill from drinking
the water on the premises which had become polluted she moved
them to live with her at her home in Virginia. Her mother passed
away in 1996 and her father shortly thereafter in early 1997 .
Prior to her father' s death, she was advised by her attorney to
place all of the property owned by both her father in her name so
she could pay the mortgage, taxes, insurance and other bills as
well as collect the rents from the properties . Apparently, she
did this in haste on the eve of her father' s death which is
obvious from the way the Quitclaim Deed was hand drawn. This
deed was recorded sometime after her father' s death (a copy of
the Quitclaim Deed dated November 12 , 1996 is attached hereto as
Exhibit 3) . Sue Mason emphatically informed me that it was never
intended that Tax Lot 6 be merged with her father' s and mother' s
house parcel which was on Tax Lot 8 (see attached single and
separate searches by Ticor Title Insurance Company which are
attached hereto as Exhibit 4 along with the accompanying deeds) .
It was obvious when I purchased Tax Lot 6 that it was small,
but I was under the impression it was a separate lot on which I
could construct a modest contractor' s building. Setting aside
the recent political and zoning history of this property which
for the last year has been the subject of numerous newspaper
articles and Town Board hearings, when you look at this "Church
Lane Neighborhood" none of the 15 lots rezoned to R-40 satisfy
the requirements and as a result all are undersized and
non-conforming.
My request for this waiver of merger will not result in any
significant increase in the density of the neighborhood as it
will be just one additional house . ,Prior to the widening of
County Road 48 , this parcel had a home on it . As a result of the
condemnation the property has only 9, 334 . 08 sq. ft . remaining and
it is undersized in the R-40 designation by the Town Board.
However, this lot is not much smaller than the average lot size

in this neighborhood and is almost identical in size to the
property which is immediately adjacent to the east (Tax Lot 7)
which has a modest single-family house on it . Further, because
the property fronts on the very wide County Road 48 and a
50 ' wide Tuthill Road, the siting of the house where I propose
will not result in any overcrowding.
There is no question my application for a waiver will avoid
an economic hardship to me not only because of the property
devaluation due to the recent zone change, but if I am not
granted the waiver so I construct a house this lot becomes
basically worthless . I do not know what to do with this
residential lot as it is has absolutely no use to Tax Lot 8 which
the Building Inspector has merged it with. Further, the owner of
the adjacent lot to the northeast has no interest in purchasing
this property. The drinking water is polluted, however, the
Suffolk County Water Authority has furnished a water line to
the property so that will not be a problem to have its use as a
one-family dwelling. The only reasonable use for this property
as a result of the Town Board' s action is the erection of a
modest affordable house .
The topography of this parcel is level and the construction
of a one-family house will not result in any change of the
topography as there will be no filling of the property. Although
small in size it is well suited for the erection of a one-family
house which I propose to build. A copy of the building plan to
this house is attached hereto as Exhibit 5 . Also, I am enclosing
an affidavit of Sue Mason sworn to on December 15, 2003 as
Exhibit 6 .

BE IT ENACTED, by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent.
The Town Board of the Town of Southold retained an independent planning firm, Greenman-
Pedersen Inc., to conduct a planning, environmental, and cultural analysis of the portion of the
Town bordered by North Road (C.R. 48) on the south, Cox Lane on the east, Oregon Road on the
north, and Depot Lane on the west. The analysis was refined into a primary study area consisting
of fifteen parcels, hereinafter referred to as the"Church Lane Neighborhood" on the south side
of the landfill.
EXHIBIT I
These fifteen parcels are Suffolk County Tax Map (SCTM)#1000-96-1-3; 1000-96-1-4.1; 1000-
96-1-5.1; 1000-96-1-6; 1000-96-1-7; 1000-96-1-8; 1000-96-1-9; 1000-96-1-11.1; 1000-96-1-12;
1000-96-1-13.1; 1000-96-1-14; 1000-96-1-15; 1000-96-1-16; 1000-96-1-18.2; and 1000-96-1-
18.3 and all are currently zoned Light Industrial(LI).
The study/analysis prepared by Greenman-Petersen dated August 2003 indicated that the Church
Lane neighborhood is one of the few African-American communities in the Town of Southold.
It was established in the early part of the last century, and the families who have maintained
homes there since that time have cultural roots to the establishment of agriculture on the North
Fork. The continued existence of this unique historic settlement is jeopardized by its current
industrial zoning classification. Previous land use conflicts between the Town landfill and the
residential use of the Church Lane neighborhood no longer apply, as the landfill has been
capped, and this facility must be considered a long term open space and parkland asset to the
neighborhood. The solid waste transfer and recycling center, and the yard waste composting
facility still provide land use conflicts, but these are being mitigated by provisions for a noise
barrier and a vegetative border. Additional mitigation is anticipated as best management
practices are implemented, and as technology for transfer, recycling, and composting improves.
In preparing the report/recommendations, Robert Grover of Greenman-Petersen met with
residents of the community on August 11, 2003 and determined that the residents support
rezoning the Church Lane community to a residential zone in an effort to preserve their
community. The report concludes that it is clear from the analysis that, on the basis of cultural
resources, land use, and the Town's established planning goals, the Church Lane neighborhood
should be rezoned to Residential R-40.
A public hearing was held on the Town Board's own motion for rezoning the fifteen parcels to
Residential(R-40) and the public was given an opportunity to be heard.
Section 2. Enactment.
Therefore,based upon the aforementioned goals and identified needs of the Town, the cultural
and historical resources, and existing land use patterns in the Town, and upon our consideration
of the recommendations and comments of the Southold Town Planning Board, the Suffolk
County Planning Commission, independent planning consultant Greenman-Pedersen, and the

public comment taken at the public hearing and otherwise,we hereby determinethat it is
necessary and desirable to revise and amend the zoning designations applicable to the identified
parcels, and we hereby change the zoning district designated for the parcels of property known as.
Suffolk County Tax Map (SCTM)#1000-96-1-3; 1000-96-1-4.1; 1000-96-1-5.1; 1000-96-1-6;
1000-96-1-7; 1000-96-1-8; 1000-96-1-9; 1000-96-1-11.1; 1000-96-1-12; 1000-96-1-13.1; 1000-
96-1-14; 1000-96-1-15; 1000-96-1-16; 1000-964-18.2; and 1000-96-1-18.3 from the (LI)Light

Building Permit #29566-Z dated 7/14/03; July 7, 2004 Notice of Disapproval
This will confirm that the substantial reconstruction activities of the dwelling and foundation area
were previously discussed by the ZBA during public hearings and discussions with the applicant and
his attorney (ref. prior application #5029, #5486 and #5487). The additional construction is within
the existing footprint of the dwelling and has been under construction to meet the New York State
Building Code. The applicant also indicated that the 28.4 ft. section of this dwelling was removed
without any plan for reconstruction, except as confirmed on the May 8, 2004 foundation survey. The
applicant's proposal was considered by the Board of Appeals, without change of the same
nonconforming setbacks.
It is requested that the July 7, 2004 Notice of Disapproval be withdrawn.

SUE MASON, being duly sworn, deposes and says :
I reside at 209 Coachman Drive, Chesapeake, Virginia 23325,
and am making this affidavit concerning the properties previously
owned by my family which are located on Tuthill Road, Cutchogue,
New York as set forth with the above-captioned tax map numbers .
I was born on November 20, 1937; and in 1946 I moved with my
parents to their house at 170 Tuthill Road, Cutchogue, New York
(Tax Lot 8) . I lived with my parents in this house until about
1958 at which time I moved to Riverhead, New York. When I lived
on Tuthill Road I remember there were three individual properties
on the northerly side which were owned by my family. At that
time Tuthill Road was a sand road and it was the main entrance to
the Southold Town dump. The property on the corner of Middle
Road and Tuthill Road (Tax Lot 6) was owned by my grandmother,
Ida Taylor Wyche, and then by my uncle, Samuel Taylor and his
wife, Pearl . After my uncle ' s death it was left to my aunt,
Pearl Taylor, who my father took care of . Originally, on this
lot there was a small bungalow which were my grandmother, Ida
Taylor Wyche, had lived. In 1984 , Pearl Taylor, transferred this
corner lot on Tuthill Road to my father. At the time of the
transfer the lot was vacant as the house had been previously torn

down around the same time the, Countyof,. Suffolk had widened
Middle Road and taken some of the property which I believe was in
1964 .
At 170 Tuthill Road '(Tax Lot 8) is ‘the house where I grew up
and was owned by both my father, James Mason and mother, Ida
Mason. In addition to our home on the property there was another
one-story house which my father rented• out as well as a large
garage in which he kept some of his trucks, equipment and tools
and he operated his business from this property.
The property immediately to the west which is 250 Tuthill
Road (Tax Lot 9) was also owned by my father and on that property
there was a one-story house which he built andit was always
rented out to third parties . In 1990 my father modernized this
house as it had suffered a large fire which destroyed the
structure, the result of which it had to be torn down.
The point I am trying to make is that all three of these
lots were not only held separately, but each had each own house .
While I lived there on Tuthill Road I remember it was very busy
as stated previously it was the main entrance to the dump and no
one paid too much attention to property lines or what took place
on the properties in this area. Tax Lot 6 was owned individually
by my father; Tax Lot 8 by my father and mother; and Tax Lot 9
was also owned by my father individually.
There was no particular reason why it was held this way. My
father was a business man and my mother was not interested in
owning any other property other than what was her home . Each of
the lots had its own tax bill, insurance policies and Tax Lot 8
had its own mortgage payments .

In the early 1990 ' s the drinking water had been become so
bad that it was polluted and my parents could no longer live
there as they had become sick from drinking this water. At that
time I moved them to my home in Virginia. The people who lived
in the rented houses had to use bottled water as the groundwater
as I stated was not drinkable .
My mother passed away on February 25, 1996 while living with
me in Virginia. A little while later I was informed by my
father' s doctor that he had advanced leukemia, was terminal and
was going to die shortly. The lawyer I had in New York at that
time was a man by the name of Richard Miller of Babylon,
New York. He advised me that while my father was still alive I
should deed the properties to myself so I could continue to make
mortgage payments and pay 'taxes and other bills as well as
collect the rent as my father was not capable of doing any of
these things at that point . I did not know what to do so on my
own I prepared three deeds and on November 12 , 1996 had my father
sign them and sent them to the lawyer for recording. My father
died shortly thereafter on January 8, 1997 . It is my
understanding the lawyer recorded these deeds sometime later.
Lastly, I wish to make a point that there never was any
intention to merge these properties as they were always held
separately. After my father died I listed these lots for sale
separately and was finally able to sell them in 2001 . Tax Lots 6
and 9 were sold to Kelly L. Krudop and Tax Lot 8 to her husband,
Robert H. Krudop. The only reason I put the deeds in my name was
I did not know what to do as my father was dying and again the

only reason I put the deeds in my name was because of my father'
tdying. Subsequently, I sold Tax Lot 6 to Kelly L. Krudop, Tax
Lot 8 to Robert H. Krudop, and Tax Lot 9 to Kelly L. Krudop.
This affidavit is given for the purpose of informing the
zoning officials of the Town of Southold so they are aware of the
history of these properties . I am told if I had proper legal
advice in the past these individual lots would have never merged
under the Southold Town Zoning Ordinance as I would have placed
them in my adult children' s names .

FINDINGS OF FACT
PROPERTY FACT: Applicant's property is a 14,787.45 sq. ft. parcel with 112.50 ft. frontage along
Tuthill Road (north) and a depth of 133+- feet. The lot is improved with two single-family dwellings
and a garage building.
BASIS OF APPEAL: September 26, 2001 Notice of Disapproval which cites Section 100-243A of
the Zoning Code. The reasons stated in the Building Inspector's Notice of Disapproval is that a
"nonconforming building containing a nonconforming use shall not be enlarged, reconstructed or
structurally altered or moved, except as set forth below, unless the use of such building is changed
to a conforming use." The property is located in the Light Industrial Zone District.
RELIEF REQUESTED: The relief requested is to move one of the dwellings which straddles the
westerly side lot line, to a new location at about two feet from the westerly side property line and
31.7 feet from the rear property line.
FINDINGS OF FACT: The Zoning Board of Appeals held public hearings on this matter on
November 15, 2001, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal observations of members of the Board and other evidence, the
Board finds the following facts to be true and relevant:
During the public hearing, the board members requested and applicant agreed to provide the
maximum possible side yard setback of the westerly dwelling from the lot line. The applicant has
revised his plan to increase the side yard setback to the westerly lot line to a minimum of three
feet.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The dwellings and accessory garage are
preexisting nonconforming. Part of one of the existing dwellings straddles the westerly property
line and the applicant wishes to correct the problem by moving the dwelling so that it is situated
fully within the applicant's property lines. The applicant also plans to renovate an existing one-
story frame dwelling and renovate and move an existing accessory garage. The renovated
structures would reduce the existing lot coverage from approximately 20 percent to approximately
16 percent. The renovated structures and improvements will enhance the property and be a

benefit to the neighborhood and surrounding properties. The variances granted herein will reduce
the degree of the buildings' nonconformity.
2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue
other than an area variance because the westerly dwelling straddles the property line. The
applicant cannot move the dwelling to meet the 10-foot required side yard setback because the
accessory garage is adjacent to the dwelling, and the garage cannot be moved further east
because of existing cesspools. If the westerly dwelling were moved more to the center of the
property, the garage and dwelling would be in a conforming location, but the dwellings would block
access to the garage doors and the garage would be unusuable.
3. The area variance is not substantial because the applicant will increase the westerly side yard
setback of the existing dwelling from a zero set back to three feet. Although a small section,
approximately 10 x 32 ft. of the front of the garage is in the side yard of the westerly dwelling, it is
in a nonconforming location (the required rear yard) of the easterly dwelling.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. Although a small section, approximately
10 x 32 ft. of the front of the garage is in the side yard of the westerly dwelling, it is in a conforming
location (the required rear yard) of the easterly dwelling.
5. The action set forth below is the minimum necessary and at the same time preserves and
protects the character of the neighborhood and the health, safety and welfare of the community.

INSTRUCTIONS
•
a. This application MUST be completely filled m by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale.Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authonzed has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County,New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The
applicant agrees to comply with all applicable laws,ordinances, building code, housing code, and regulations, and to admit
authorized inspectors on premises and in building for necessary inspections.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises,relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authonzed has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authonze, m writing,the extension of the permit for an
addition six months.Thereafter, a new permit shall be required.

2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue
other than an area variance because the westerly dwelling straddles the property line. The
applicant cannot move the dwelling to meet the 10-foot required side.yard setbackbecausethe
accessory garage is adjacent to the dwelling, and the garage cannot be moved further east
because of existing cesspools.. If the westerly dwelling were moved more to the center of the
property, the garage and dwelling would be in a conforming location, but the dwellings would block
access to the garage doors and the garage would be unusuable.
3. The area variance is not substantial because the applicant will increase the westerly side yard
setback of the existing dwelling from a zero set back to three feet. Although a small section,
approximately 10 x 32 ft. of the front of the garage is in the side yard of the westerly dwelling; it is
in a nonconforming location (the required rear yard) of the easterly dwelling.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmentalconditions in the neighborhood or district. Although a small section, approximately

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) By March 5th: Please send the enclosed Legal Notice, with both a cover letter including
a contact person and telephone number, and a copy of your survey filed with this application
which shows the new construction area, CERTIFIED MAIL, RETURN RECEIPT REQUESTED,
to all owners of property (vacant or improved) which abuts and any property which is across
from any public or private street from the property included in the application or petition. Use
the current addresses shown on the assessment rolls maintained by the Town Assessors' Office
located at Southold Town Hall (765-1937) and the County Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailing address or to deliver the letter to the current owner,
to the best of your ability and to confirm this in either a written statement, or at the hearing, with
the returned letter. Please either mail or deliver to our office your Affidavit of Mailing (form
enclosed) with parcel numbers, name and address's noted, and return it with the white
receipts postmarked by the Post Office. When the green signature cards are returned to you by
the Post Office, please mail or deliver them to us before the scheduled hearing. If any
signature card is not returned, please advise the Board at the hearing and return it when
available. These will be kept in the permanent record as proof of all Notices.
2) By March 9th: Please make arrangements to place the enclosed poster on a sign board
