REASONS/FACTS: The request is a modification of the project as applied under Appeal No. 4279 rendered 11/2/94. The percentage of relief requested is not substantial, being a variance of eight (81') inches on the side and 16 inches on the front, at its closest points. This request does not affect density. The relief requested will not produce an adverse effect or impact on the physical or environmental conditions of the neighborhood. We are asking for your favorable consideration of our application for a variance to amend building permit #22491Z covering 60 Rogers Road. My family has lived in Beixedon Estates during the summer and on weekends for the past 43 years. My wife's family did the same for over 50 years. We grew up enjoying the activities and beauty of the North Fork. Joan and I married and our three children have also enjoyed the wonderful atmosphere which exists here. We are now into the fourth generation with our three grandchildren, doing the same things which brought both families here 50 years ago. My purpose in mentioning this is simply to show that we are here for the long haul, not to make a quick profit on improved property. Our parents retired to Beixedon and the house we are reconstructing will become our retirement home in the future. And for that reason, we are building it in a way which will give us pride and enhance the beauty of the community. The construction of our home has been somewhat complex in that it required raising the old house, excavating and pouring a full foundation, moving the house to the opposite end of the foundation and then constructing the addition. The building was designed and modified to fit within the area prescribed by the existing variance. We believed, at the time the foundation was poured, that the final structure was within the approved boundaries. A foundation survey was ordered, but unfortunately, tragedy struck the Van Tuyl Family and it seemed inappropriate to press for a quick response. When the survey was finally completed, it was determined that two small errors were made, causing a violation of the front yard and side yard setbacks each by just a few inches. However, the side yard distance to the line is greater now than it was with the old structure. Beixedon Estates is a pre W.W.II community and more than a dozen of the present homes are placed on or closer to the property lines than the home we are building. Page 2 • • We are very concerned with the appearance of the house within the community. There was an old metal garage in the rear of the property which has been removed and replaced with a garden. The neighbors on all sides of our property have expressed delight at the progress and beauty of the project. There are letters of support attached to this statement and neighbors have come this evening to speak on our behalf. The violations which exist were unintentional and minor. We believe that the project will be even more attractive than it appeared on the plans which you approved at the original hearing. To deny our request for a variance would cause an unnecessary hardship and we sincerely hope that you will favorably consider our request for a variance to amend our building permit. Southold, N.Y. 11971 Dear Gerry; Enclosed are all the necessary documents for our second appeal regarding the Latham property at 60 Rogers Rd.,Southold. On behalf of the Lathams and my brother I wish to thank you for previewing this and hopefully saving as much time as possible further on. After my careful review of the previous appeal #.4279 in preparation for this motion I would like to share my findings with you and the other board members in an effort to reconstruct the building process that has led us to the point we are. As you know the lot, or lots in question and the structure are close enough to three sides of the property lines to require careful measurements. At the time of the previous appeal we were well aware of this, and the rear yard setback was the center of our attention. the side yard (south) and front yard however did not miss our consideration. In section three of our reasons for appeal #.4279 we indicated our intention of locating the south side of the new construction in exactly the same location as the pre-existing structure. After reviewing the appeal at the November 2, 1994 meeting you stated that you " had no problem with this " and the board voted to grant the appeal as requested. It was, is, and always has been our intentions to adhere to the conditions of that appeal. The following day work resumed and the foundation work started. the letter describing the boards findings was not rec#4ved for another nine days,4nd it is only there ghat the side yard measurement of 15 foot, 6 inches is mentioned. This obviously does not conform to the conditions of the appeal. We can only assume this number was taken from the plot plan submitted with the blueprints. During this time the tragedy occured that left the Van Tuyl family unable to survey the foundation for several months. Plotting the new location was therefore left to us in order for the project to proceed. The corners of the existing house were marked and the new foundation was located one foot further east and exactly in place of the old, to the south. The existing survey dated June 21, 1994 has no measurement to either og these points. At this time a new survey is being done with extra careful attention to the critical measurements in the front and side yards. Any possible deviation due to the absence of exact dimensions on the previous survey will be a permanant part of the new survey in progress. After re-visiting the site I viewed the front yard from the north and could not make an accurate comparison to other houses on the same side of the road due to hedges and trees obscuring any other houses from that perspective. The house directly across the street is the only comparable one, and after a quick measurement, the front yard setback is less than that of the Lathams. In consideration of these points, and the requests of the neighbors to continue the project I have a difficult time differentiating the previous appeal that was granted from the one I may be applying for. It is therefore my position that The location of the structure is exactly pursuant to the conditions of appeal #.4279 and that construction should be allowed to continue as soon as the latest, accurate survey is received. I have also enclosed several recent pictures along with older, pre-existing shots to show that setbacks appear equal or greater than before. The construction has unquestionably improved the character of the property and the neighborhood. To halt progress at such a sensitive stage of scheduling subcontracts for a timely completion would be unjustifiable punishment to the owner as well as myself. No. 2-1976; 3.26- 85 by LL.11o.6-1985k A. i1DALWETLANDS: (1) All lands generally covered or intermittently cov- ered with, or which border on, tidal waters, or lands lying beneath tidal waters, which at mean low tide are covered by tidal waters to a maximum depth of five (5) feet, including but not limited to banks. bogs, salt marsh, swamps, meadows, flats or other low lying lands subject to tidal action: (2) All banks, bogs, meadows, flats and tidal marsh subject to such tides and upon which grows or may grow some or any of the following salt hay, black grass, saltworts, sea lavender, tall cordgrass, high bush, cattails, groundseL marshmallow and low march cordgtass:and/or (3) All land immediately adjacent to a tidal wetland as defined in Subsection A(2) and lying within seven- ty-five (75) feet landward of the most landward edge of such a tidal wetland. B. FRESHWATER WETLANDS: (1) "Freshwater wetlands" as defined in Article 24, Ti- tle 1, § 2.1-0107, Subdivisions 1(a) to 1(d) inclusive, of the Environmental Conservation Law of the State of New York: and All land immediately adjacent to a "freshwater wet- land." as defined in Subsection B(1) and lying with- in seventy-five (75) feet landward of the most land- ward edge of a "freshwater wetland." 9705 z-zs.es
