dated 9/14/95. "Insufficient front yard setback as set forth in the Zoning
Code 100-30A.3."
PROVISIONS APPEALED FROM: Article III, Section 100-30A.3.
RELIEF REQUESTED: The June 29, 1995 updated survey map shows a
proposed setback at 43' from the edge of the step (stoop) to the westerly
front property line, and 47+- feet to the edge of the asphalt pavement
within the roadway. The distance between the outside wall of the outside on
the westerly yard to the property line is shown to be 55+- feet at the
closest point. The setback from the southerly side property line is shown
at 82+- feet, and from the northerly side property 231+- feet.

ACTION/ RESOLUTION ADOPTED: Approved as applied for.
REASONS/ FINDINGS: Property is a wide but narrow lot due to the wetlands
from the pond area and general variable contours in this FEMA zone. The
house is proposed to be located in the FEMA C Zone area to mitigate flooding
possibilities as recommended by the other agencies (including the Suffolk
County Health Department under HS Ref. No. R10950049, NYS Department of
Environmental Conservation conditional permit No. 1-4738-01114-/00001-0, and
Town Trustees. The relief requested is not substantial in relation to the
requirement. There will be no benefit afforded the applicant if the
variance were denied, and a grant of the variance as approved will not
cause a detriment to surrounding properties regarding environmental or
physicial conditions.

1. STRICT APPLICATION OF THE ORDINANCE would produce, practical difficulties or unneces-
sary HARDSHIP because subject parcel is a pre-existing non-conforming
parcel with respect to area and lot depth. Denial of the
requested variance would preclude the construction and
subsequent use of a high quality dwelling in character with
existing dwellings in the surrounding area.
2. The hardship created is UNIQUE and is not shared by. 611 properties olike,.in the immediate

Dear Mr. Anderson:
Please find attached for your permanent records a copy of
the Findings and Determination rendered by the Board of
Appeals in the above matter. Copies have been forwarded to
the Office of the Building Department for their update and
reeordkeeping.
You should be aware that since this project is located
within 500 feet of a waterway, the Suffolk County Department of
Planning is expected to review the town file and determine
whether or not county action will be necessary, under the
Administrative Code of Suffolk County. It is expected that the
county will either decide it does not have jurisdiction or
refer the matter back to the Board of Appeals concerning the
town's action (rather than taking independent action for a
county disapproval or approval). No further steps are required
on your part since our office is required to send a copy of the.
ZBA file to the Hauppauge office directly.
Please be sure to follow up with the Building Department,
the Health Department, or any other agency which may have
jurisdiction.

Dear Mr. Anderson,
The following action was taken by the Board of Town Trustees
during its regular meeting held on June 29, 1995 regarding the
above matter:
WHEREAS, Suffolk Environmental Consulting on behalf of Peggy
Heller and Anne Wyden, applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated March 29, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 29, 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
Suffolk Environmental Consulting on behalf of PEGGY HELLER AND
ANNE WYDEN to construct a 2,982 s.f. single family dwelling
(base floor), an 800+/- s.f. attached deck, an 840 s.f.
attached garage, an 876 gravel driveway, a 318+/- s.f.
walkway, well and septic system as per amended plans dated June
29, 1995. Also to include drywells and haybales. No clearing
beyond limits shown on survey. Located Major's Pond Road, Orient.
Please note if the Zoning Board of Appeals grants a variance to
move the house closer to the road, you must come back to this
Board for an amendment to the permit.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector
dated 9/14/95. "Insufficient front yard setback as set forth in the Zonin¢
Code 100-30A.3."
PROVISIONS APPEALED FROM: Article III, Section 100-30A.3.
RELIEF REQUESTED: The June 29, 1995 updated survey map shows a
proposed setback at 43' from the edge of the step (stoop) to the westerly
front property line, and 47+- feet to the edge of the asphalt pavement
within the roadway. The distance between the outside wall of the outside on
the westerly yard to the property line is shown to be 55+- feet at the
closest point. The setback from the southerly side property line is shown
at 82+- feet, and from the northerly side property 231+- feet.

ACTION/ RESOLUTION ADOPTED: Approved as applied for.
REASONS/ FINDINGS: Property is a wide but narrow lot due to the wetlands
from the pond area and general variable contours in this FEMA zone. The
house is proposed to be located in the FEMA C Zone area to mitigate flooding
possibilities as recommended by the other agencies (including the Suffolk
County Health Department under HS Ref. No. R10950049, NYS Department of
Environmental Conservation conditional permit No. 1-4738-01114-/00001-0, and
Town Trustees. The relief requested is not substantial in relation to the
requirement. There will be no benefit afforded the applicant if the
variance were denied, and a grant of the variance as approved will not
cause a detriment to surrounding properties regarding environmental or
physicial conditions.

applicable zoning code regulation. §267(1) of Town Law.
The new' Statute no longer includes the term "practical difficulty" or-. any
particular test, and now provides that ZBAs consider two basic things:
1. the benefit to the applicant if the variance is granted; and
2. the detriment to the health, safety and general welfare of
the neighborhood or ccmmu*ity that would occur if the variance were to
be granted.
In balancing the interests above, ZBAs must also consider the following five
factors for an AREA VARIANCE: '
1. whether an undesirable change will be produced in the character of
the neighborhood or a detriment to nearby properties, if granted;
2. whether the benefit sought by the applicant can be achieved by some
method, feasible for the applicant to pursue, other than an area variance;
3. whether the area variance is substantial;
4. •whether the variance will have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district; and
5. whether the alleged difficulty was self-created, which consideration
shall be relevant to the ZBA's decision but shall not preclude the granting
of an area variance.
Also, as part of the "balancing concept," the new Statute provides that:
6. the ZBA shall grant the minimum valiance that it shall deem necessary
and adequate, and at the same time preserve and protect the character of the
neighborhood and the health, safety and welfare of the community.

USE VARIANCE is authorization by the ZBA for the use of land in a manner or
for a purpose which is otherwise not allowed or is prohibited by the applicable

regulations for the particular district where the property is
located:
(a) the applicant cannot realize a reasonable return,
provided that lack of return is substantial as demonstrated by

1. Any work, disturbance, and storage of construction materials

2. A snow fence or other temporary project-limiting fence shall
be erected prior to the commencement of any permitted
activities along the upland edge of the designated buffer
area in order to prevent the inadvertent intrusion of
equipment into the protected area. The fence shall be
maintained until project completion.
3. Prior to commencement of any construction activities, a
continuous row of straw. bales shall be staked end to end
along the base of the snow fence (or other temporary,
project limiting fence) on the upslope or project side of
the fence. The bales shall be maintained, repaired and
replaced as often as necessary to ensure proper function,
until all disturbed areas are permanently vegetated. The
average useful life of a bale is approximately 3-4 months.
Sediments trapped by the bales shall be removed to an
approved upland location before the bales themselves are
removed.
4. Straw bales shall be recessed two to four inches into the
ground.

For Article 24 Freshwater Wetlands I
5. Any demolition debris, excess construction materials, and/or
excess excavated materials shall be immediately and
completely disposed of on an approved upland site more than
100 feet from any regulated freshwater wetland. These
materials shall be suitably stabilized so as not to re-enter
any water body, wetland, or wetland adjacent area.
6. Use of wood treated with pentachlorophenol or creosote is
prohibited. Standard pressure treated lumber is treated
with CCA and its use is permitted.
7. All equipment and machinery shall be stored and safely
contained greater than 100 feet landward of the regulated
wetland or water body at the end of each work day. This
will serve to avoid the inadvertent leakage of deleterious
substances into the regulated area. Fuel or other chemical
storage tanks shall be contained and located at all times in
an area greater than 100 feet landward of the regulated
wetland or water body. If the above requirement cannot be
met by the permittee, then the storage areas must be
designed to completely contain any and all potential
leakage. Such a containment system must be approved by
NYSDEC staff prior to equipment, machinery or tank storage
within 100 feet of the regulated wetland or water body.
8. All areas of soil disturbance resulting from this project
shall be seeded with an appropriate perennial grass, and
mulched with straw immediately upon completion of the
project, within two (2) days of final grading, or by the
expiration of the permit, whichever is first. Mulch shall
be maintained until a suitable vegetative cover is
established. If seeding is impracticable due to the time of
year, a temporary mulch shall be applied and final seeding
shall be performed as soon as weather conditions favor
germination and growth.
9. Suitable vegetative cover is defined as a minimum of 85%
area vegetative cover with contiguous unvegetated areas no
larger than 1 square foot in size.
10. The permittee shall incorporate the following language as a
notice covenant to the deeds

with the number assigned to this permit, shall be sent within one
calendar year of the issuance of this permit to: NYSDEC,
Regional Manager BEP, SUNY Building 40, Stony Brook, New York
11790-2356.

Wetlands; Coastal Erosion Management; and wild, Scenic, and
Recreational Rivera Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory-Affairs at the address on page
one or telephone (516) 444-0365.
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permitter
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany,%NY 12242 (516) 474-2195, which
may be required; for any encroachment upon State-owned lands
"underwater. '

The following action was taken by the Board of Town Trustees
during its regular, meeting held on June 29, 1995 regarding the
above matter:
WHEREAS, Suffolk Environmental Consulting on behalf of Peggy
Heller and Anne Wyden,. applied to the Southold Town Trustees for
a permit urfder the provisions of the Wetland Ordinance of the
Town of Southold, application dated March 29, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 29, 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,

will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
Suffolk Environmental Consulting on behalf of PEGGY HELLER AND
ANNE WYDEN to construct a 2,982 s.f. single family dwelling
(base floor), an 800+/- s.f. attached deck, an 840 s.f.
attached garage, an 876 gravel driveway, a 318+/- s.f.
walkway, well and septic system as per amended plans dated June
29, 1995. Also to include drywells and haybales. No clearing

Please note if the Zoning Board of Appeals grants a variance to
move the house closer to the road, you must come back to this
Board for an amendment to the permit.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

TERMS and CONDITIONS
The Permittee Petty Heller and Anne Wyden
residing at Majors. Pond Road, Orient N. y„ as
part of the consideration for the issuance of the Permit don understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third patties, and the said Permittee assumes full liability
with respect thereto, .ro the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.

5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the tight' of the public to pass and repass along
the beach between high and low water marks.
7. That if futuie operations of the Town of Southold require the removal and/or alterations
in the location of the work bprein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.

OPTION T PURCHASE
AGREEMENT made this / day of . u 14 1995, between
NANCY R. DOUGLASS, residing at (no Willow Terrace Lane,
Orient, New York 11957, hereinafter called the "Seller," and
PEGGY C. HELLER and ANNE WYDEN, both residing at 42 Farm Lane,
Great Neck, New York 11202, hereinafter called the "Purchasers."
W I T N E S S E T H T H A T:
WHEREAS, the Seller is the owner of a certain parcel of real
property (hereinafter the "subject parcel"), which parcel is
located at the end of Willow Terrace Lane, in the Hamlet of
Orient, Town of Southold, County of Suffolk, and State of New
York, is identified on the Suffolk County Tax Map as Parcel No
1000-026.00-02.00-039.001, and consists of approximately 1.111s
acres; and
WHEREAS,, the'Seller wishes to grant to the Purchasers an
exclusive option to purchase the subject parcel, and the
Purchasers wish to accept said option.
,NOW, THEREFORE, the Seller hereby grants to the Purchasers
the exclusive right, privilege, and option of purchasing the
subject parcel pursuant to the following terms and conditions:
1. The Purchasers shall pay to the Seller, for such
option, the sum of TWELVE THOUSAND DOLLARS ($12,000.00), receipt
of which is hereby acknowledged, subject to collection, which sum
is non-refundable. Notwithstanding the foregoing, in the event
that the Purchasers exercise their option to purchase the subject
parcel and close title in accordance with the annexed Contract of
Sale, the parties agree that the option monies paid hereunder
shall be credited toward the purchase price, which credit shall
be given to Purchasers at the closing of title pursuant to the
annexed Contract of Sale.
2. In addition to payment of the option monies
described in Paragraph "1" above, the Purchasers shall pay to the
Seller the sum of SEVEN HUNDRED AND FIFTY-THREE AND 81/100
DOLLARS ($753.81), receipt of which is hereby acknowledged,
subject to collection, which sum represents the real estate taxes
assessed to and due on the subject parcel for the 1994-95 tax
year. All monies paid pursuant to this paragraph are non-
refundable under any circumstances and are not to be credited
against the purchase price.
3. This option must be exercised on or before the
earlier of (a) seven (7) days following receipt by the Purchasers
of all permits, as.described in Paragraph 116" hereof, or (b) the
day of.Lo ~ti 1995, which is eight (8) months from
the date of the execution of this agreement.
4. In the event the option is not exercised within the
time periods set forth in the preceding paragraph, all monies
paid under this "Option to Purchase" shall immediately become the
property of the Seller, this "Option to Purchase" shall be null
and void, and no party shall have any further right against any
other party under this "Option to Purchase."
5. The aforesaid option shall be exercised by the
Purchasers delivering to the Seller's attorneys, Esseks, Hefter &
Angel, at 108 East Main Street, P.O. Box 279, Riverhead, New York

11901, four (4) executed copies of the annexed Contract of Sale,
together with a check, in the amount of $13,000.00 and made
payable to Esseks, Hefter & Angel, as attorneys, representing the
down payment provided for under the said Contract of Sale. The
said down payment check shall be held in escrow, pursuant to the
said Contract of Sale.
6. This "Option to Purchase" is subject to and
conditioned upon the Purchasers obtaining (a) a building permit
from the Town of Southold, (b) necessary permits, if any, from
the Town of Southold Board of Trustees, and (c) necessary
permits, if any, from the New York State Department of
Environmental Conservation, to construct a one-family dwelling on
the subject parcel. Upon receipt of a fully-executed counterpart
of this "Option to Purchase," the Purchasers shall make diligent
applications to obtain all the aforesaid permits.
7. In the event that the permits described in the
preceding paragraph are obtained, the Purchasers shall, within
thirty (30) days of the receipt by Purchasers of all permits, as
described in Paragraph 116" hereof, (a) exercise the option set
forth herein in the manner provided ifi Paragraph "5" above, and
(b) subject to the terms of the annexed Contract of Sale, close
title on the purch&se'of the subject parcel. The Purchasers'
failure to comply with the time limitations set forth in the
preceding sentence shall, unless such time limits have been
extended by the Seller in writing, constitute a default under
this "Option to Purchase." In the event of such default, all

become the property of the Seller, this "Option to Purchase"
shall be null and void, and no party shall have any further right
against any other party under this "Option to Purchase."
8. This "Option to Purchase" may not be assigned
without the prior written consent of the Seller. Any attempt to
assign this "Option to Purchase" shall be a violation of this
"Option to Purchase" and shall be ineffective to transfer to the
purported assignee any interest in this "Option to Purchase."
9. Any neglect or failure of the Purchasers to
complete the purchase of the subject parcel pursuant to the
annexed Contract of Sale shall be conclusively deemed a waiver of
all future rights of the Purchasers, or either of them, under
this "Option to Purchase," and the Seller shall thereupon be at
liberty to sell the subject parcel to another purchaser for such

10. The Seller hereby acknowledges that she has
reviewed and conditionally approved the preliminary building
plans for the Purchaser's proposed one-family dwelling for the
subject parcel, which plans are dated December 26, 1994, and were
transmitted to Seller's attorney on or about January 9, 1995.
Seller's approval of the aforesaid preliminary building plans is
specifically conditioned on:
(a) the final design of the dwelling exterior being of the
"modified carriage house" style;

shall have a cape style roof, that is a the bay

(e) the use of white cedar shingles in the final exterior
design. (This shall not be construed as requiring the
