APPLICANT: PHILIP GIOIA.
LOCATION OF PROPERTY: 3450 Peconic Bay Blvd, Laurel.
COUNTY TAX MAP DISTRICT 1000, SECTION 128, BLOCK 6, LOT 27.
BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector
dated November 3 1995.
PROVISIONS APPEALED UNDER: Article IIIA, Section 100-30A.4 (ref.
Article III, Section 100-33) .
RELIEF REQUESTED: 22 ft. by 20 ft. accessory garage - storage building
in the front yard 38 feet from the northerly front property line along
Peconic Bay Boulevard and 15 feet at its closest point to the easterly
right-of-way. The northerly easterly point of the garage towards the
right-of-way is 17+- feet (on an angle) .

ACTION/RESOLUTION ADOPTED: Granted as applied with only electric
(no water or other utilities except by further application to this Board) .
REASONS/FINDINGS: Requested location is not unreasonable due to the
variable dimensions of the lot and the fact that a major portion of the yard
areas are "front yard areas." Accessory buildings are required to be in a
rear yard, but the applicant indicates he would not have access to the rear
yard for a garage from Peconic Bay Boulevard and that he believes he does
not have a legal access for vehicles to cross over the neighboring
right-of-way. The rear yard may also not be suitable for placement of this
garage without another type of zoning variance. No other alternative is
available.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law
and the Code of the Town of Southold, that the following applications will
be held for public hearings before the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on WEDNESDAY, DECEMBER 6 1995 commencing at the times
specified below:
7:30 p.m. Appl. No. 4353 - HELEN RUTKOWSKI. This is a request,
based upon the November 15, 1995 Notice of Disapproval issued by the
Building Inspector, in which applicant was denied a building permit to add
a second story and to convert existing boat facility-accessory building to
single-family dwelling use due to prior restrictions under ZBA action
#2032 dated 5/1/75 and #1954 dated 2/27/75. Location of Property: 1025

Dear Mr. Gioia:
Please find enclosed a copy of the determination rendered by the
Board of Appeals and filed today concerning your variance application.
A copy of this determination has been furnished to the Southold Town
Building Department pertaining to your former building permit
application request.
Since the proximity of this project within 500 feet of a
waterway, State or County Road, we are required by the Suffolk
County Administrative Code to transmit copies of the variance file to
the Suffolk County Department of Planning for their determination,
transmittal has already been done. It is expected that the County
Department of Planning will "pass" its determination for a local
(Town) determination and will furnish you with a copy directly.
It the interim you may follow-up with the Building Department
staff on your former building permit application to determine if any
other information (or fee) is needed for reactivation of the building
permit request. The Building Department may be reached directly at

After investigation and inspection the Hoard finds that
applicant requests permission to construct dwelling with in-
sufficient setback from Private Road, south side of Peconic
Bay Blvd. and Private Road, Laurel, New York. The findings
of the Board are that applicant has a hardship due to the
shape of this lot, and that this is part of a minor subdivision
granted in 1968 at a time when lots were smaller. The Board
agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardships
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use districts and the variance will not
change the character of the neighborhood, and will observe the
spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Raymond T. Goodwin, 83 Wilson
Street, Bast Rockaway, New York, (William Wickham, Attorney) ,
be GRANTED permission to construct dwelling with insufficient
setback from Private Road, on the south side of Peoonio Hay
