I would invite anybody that would like to address the Town Board to please feel free? Bill Shipman, Cutchogue BILL SHIPMAN: Bill Shipman, Cutchogue. I have a couple of questions regarding the town code enforcements as of late. I have seen that there has been enforcement with the short term rentals and then we moved on to the bluff where the gentleman built the steps too close, so we are tackling some of that and there was one other thing that, what I am trying to get at is, if you guys are enforcing certain town codes, I have been asking for a particular town code to be enforced, the parking at Vineyard 48. October 19t", I went to the Town Attorney's office sometime in the afternoon. Mr. Duffy returned my call, said he would look into it and get back to me. I was just wondering what happened with that? SUPERVISOR RUSSELL: I can't speak to the issue but I know we have spent a considerable amount of resources over the years enforcing the parking requirements there but also let me clarify that we just recently hired a part-time code enforcement officer to work nights and weekends which is critical to getting code enforcement done. She has been up and running for about three weelcs now. So we have a ways to go. We are not just focusing on one aspect of the code but on several. We have actually written violations beyond the three you have just mentioned. MR. SHIPMAN: The other one was the PTA for the Turkey Trot. What I am trying to get at is, I have been complaining about this for four years, 2012. So we are almost working on four years. And how long does a FOIL take, approximately? Town Clerk Elizabeth Neeille TOWN CLERK NEVILLE: We respond to it pretty much as soon as we get it. MR. SHIPMAN: Okay, I filed.... TOWN CLERK NEVILLE: Did you go through the website or did you... MR. SHIPMAN: No, I came to Town Hall here and filed it. Southold Town Board Meeting January 5, 2016 page 42 TOWN CLERK NEVILLE: When did you file it? MR. SHIPMAN: December l ltn TOWN CLERK NEVILLE: And you received no response at all? MR. SHIPMAN: No response, no email. TOWN CLERK NEVILLE: Do you have a copy of it there? MR. SHIPMAN: Yes, ma'am. TOWN CLERK NEVILLE: Could you give me a copy of it? MR. SHIPMAN: Sure, do you want it right now? TOWN CLERK NEVILLE: I will make sure that it is addressed immediately to you. I am not sure what happened, why it didn't get addressed. MR. SHIPMAN: Inaudible. I went on the Suffolk Times website and I got the sheet that I was looking for. So... TOWN CLERK NEVILLE: I am not sure what happened to it but generally we respond as soon as we can. , Bill Shipman MR. SHIPMAN: Right. I just find that interesting but going back to the Vineyard 48, when we were here in December of 2013, they had the site plan application process worksheet, the staff (inaudible) worksheet, so in this worksheet they address parking, traffic safety and pedestrian safety. In it, it says information in this record demonstrates that parking, traffic safety, pedestrian safety are issues that need to be addressed at this site. There have been numerous calls to police regarding traffic hazards, resulting from the use of this site over the past two and a half years. The Planning Board also contains firsthand accounts of traffic safety, pedestrian safety, witnesses by neighbors and passersby. In one instance, an apparently intoxicated pedestrian was seen crossing Route 48 to get to their limo parked on the other side of the street. In another, the car traveling on Route 48 nearly collided with a limo, making a U-turn on County Route 48. Other safety problems include parking on CR 48 and the check-in while waiting to get into the driveway. In addition, this site is clearly in non-compliance with town code section 280- 78-H which requires that the parking for the use of this site be contained on-site. So since this time, 2012, I have had the police document, I don't have the police reports with me tonight but they document that there's more than 34 vehicles on site and they are going over to the Planning Board, the Town Attorney's office went to the trouble to get an injunction against said Vineyard for said parking. In the injunction, enjoining the defendants from parking vehicles on their property except in parking spaces shown on their approved site. So when they park in parking spots that aren't on the approved site plan, they are in violation of the town code, yes? Southold Town Board Meeting January 5, 2016 page 43 TOWN ATTORNEY DUFFY: Mr. Supervisor, if I could just remind the Board that this is an active litigation and we also do have ongoing investigations going on, I do aslc the Board to limit their comments in response. MR. SHIPMAN: Right but I have been asking the same question before this litigation, before this tragedy ever happened, since 2012. SUPERVISOR RUSSELL: I think he is referring to pending litigation with regard to the TRI, I believe that we pursued litigation that it completely outside the scope of the accident. This is a separate issue that we had ongoing with Vineyard 48 for some time. MR. SHIPMAN: Right. So I realize this is a civil case, so you would be telling me that you couldn't talk to me because of the litigation but if I was the victim as well as my neighbors of a , criminal case, you wouldn't be telling me that. And when I ask how things are going to be enforced or what's going to happen, nobody gets back to me. I have to come in and ask for something from October. And when I come down here to FOIL a request in the beginning of December, now I come here almost a month later with no reply at all. I will give it the possibility of being errors. Everybody makes mistakes, I understand that but this is highly coincidental. TOWN ATTORNEY DUFFY: You did make complaints before of them parking off-site and we investigated,we did issue summonses for parking off-site. MR. SHIPMAN: Well, when I ask what happens with it, why doesn't anybody tell me? So t hen I have got to come here two months later, I ask, are there being suminonses, I don't know, we'll have to check into it. Then I have to come back two months later and find this out. This is going on, they have been parking in the same places, at the same site at the same time since 2012. So if you are violating them from 2012, why doesn't anybody tell the people that are complaining about it that they are being violated? You make me come back, you make me go over this stuff again. I am tired of coming here. You tell me what I am supposed to do? I stopped complaining and the tragedy happened. Complaining in, December 2, 2013, your town wrote in the staff report, at the hearing there were numerous reports of limousines and busses attempting U-turns on CR 48 and having to make multiple maneuvers back and forth to make the turn, blocking traffic and creating a life threatening hazard. Vehicles on CR 48 typically travel at least 55, so if the Town Board, seven people, eight people, whatever it is, you are going to have to start taking it in individual stance and take a little more active role in it. SUPERVISOR RUSSELL: Look, I am not saying I am disagreeing with you, I am saying I totally disagree with you. The fact of the matter is, over the years I have gone out there, I have driven by the site on request, I have gone out there weekends, I have sat there, watched traffic. I have done all the things you have asked over the year. We have done all we could to bear on the specific operation itself. Southold Town Board Meeting January 5, 2016 page 44 MR. SHIPMAN: Why aren't they being cited for the simple town code violations which in turn, where they are not addressed, lead to bigger problems, being the traffic conditions there. SUPERVISOR RUSSELL: We have issued violations. We have.... MR. SHIPMAN: Intermittently. At best, from April to November, at least once a week, I am complaining on a Saturday, at a particular time, a particular place that this is happening. So if you are going to cite them each and every time, maybe it will set a precedent. I am not here because I am getting anything out of it. I am not getting anything out of this. SUPERVISOR RUSSELL: This is all subject to litigation, I have to bite my tongue here but the fact of the matter is, I think the town has put a particular emphasis on an operation that's gone beyond its boundaries, without a doubt. We have spent an incredible amount of time, effort and resources to try to get this addressed. Violations have been issued. Litigation is pending. COLJNCILMAN DINIZIO: Can I comment on, Bill, kick me if I am going too far. You know, when I first got involved in this, now since 2013, there was a thing back and forth about who exactly writes these code violations? You know, you can call the police department, they were kind of coming and answering but they didn't write the actual violations. And then we got the building inspector out there and he would do some of it, he has done some of it. And you know, it's always this back and forth within the departments themselves that really have never gotten addressed. Well, we have taken care of that, I think. Okay, we are in the very beginning stages of having a real code enforcement entity in this town, that is accountable to those types of violations. You go to a building inspector and what he wants to do is building inspections. He doesn't necessarily want to do code. Police aren't code enforcers, they are police officers and you know, there was a thing that was missing and what was missing was code enforcement. So we have got one and a half people plus a town attorney basically working on that. And you know, maybe this summer, it is better. I know, Bill, that you worry about that constantly. I would not want to live under what you are living Lulder but I think there is a light at the end of a tunnel when it comes to those types of violations. But we can only go so far, we can only violate them. It doesn't say that the court is going to do anything. we have no idea what the court does and how they work but I think you ought to give us that little bit more time to let this code enforcement, they have got their marching orders and that was part and parcel the reason why we did it. It wasn't the only reason but it was one of the reasons because we didn't have any enforcement on weekends which is always a tough one and at night. We have that now. But we have had it since November. MR. SHIPMAN: Right. COUNCILMAN DINIZIO: And they are just coming on board basically and they are getting their feet wet, too, on how to run this thing. MR. SHIPMAN: When you instituted the noise ordinances, there were people that were issued tickets at night by the police because there was obviously no code enforcement to do this, okay, Southold Town Board Meeting January 5, 2016 page 45 , but when you are talking 2012, 2013, 2014, get somebody to work a weekend or a nighttime shift... COUNCILMAN DINIZIO: We have got that now. MR. SHIPMAN: Now we have it but you can't say that for four years, when there is a particular problem from April to November, a particular site that you are not going to address it or... COUNCILMAN DINIZIO: We have. We have, Bill. Okay, I understand that it hasn't been to a timeframe that anybody, including myself, is acceptable to but it had been addressed and my hope is that it gets better. You talk about the noise and those noise meters, well, we are having trouble with that, too. We are having trouble figuring out who the heck knows how to use them and who even wants to use them. Who even carries them in their cars.... MR. SHIPMAN: It's called a manufacturer. COUNCILMAN DINIZIO: Excuse me? MR. SHIPMAN: It's called a manufacturer, that produced the thing. They should go for training on it. COUNCILMAN DINIZIO: Well, no, we have a problem in town, with our employees, as to who knows how to use them and who doesn't know how to use them and it's a whole, there's a whole problem just with that. You are talking about the amount of time you have to invest just to see if we can get a noise ordinance. SUPERVISOR RUSSELL: Let me just comment on the issue of noise and I think we are going a little too far with regard to the discussion... MR. SHIPMAN: Noise is just something that I brought up, I could care less about noise. SUPERVISOR RUSSELL: But I think we are going too far with the other discussion because there is pending litigation. With regard to the noise, we get a lot of complaints about noise and we go out and use the meter and guess what? They are not violating the code. Perception of noise aren't the same as violations of the code. MR. SHIPMAN: Inaudible. I have heard it all, I got it. SUPERVISOR RUSSELL: So, all those violations that the paper writes, well, we have all these complaints, and nothing is being done, only a few have been written. We go out there, time and time again, and it just doesn't rise to level of violation of the code. Now, maybe the code needs to be revisited but there's a big distinction of perception of noise and noise that violates the code. MR. SHIPMAN: Well, forget I brought up the noise code, noise code has nothing to do with what I am here now talking about, I just brought that up to, as an example. Southold Town Board Meeting January 5, 2016 page 46 COLTNCILWOMAN DOHERTY: I think what Jim was saying, going forward, we hope to have more progress in controlling the issue that has been going on for years and we hope to have satisfactory answers going forward. MR. SHIPMAN: Okay. Well... COLTNCILWOMAN DOHERTY: It is frustrating for us,too. MR. SHIPMAN: Well, yeah. I wouldn't want to have me come and talk at these stupid meetings but now, on January 7th, I get commanded by the grand jury to appear for this. Thank you.
