Biggane and Margaret G. Biggane on the 19t�' day of January, 2016, at which time all interested parties were given the opportunity to be heard; and WHEREAS, said property is identified as part of SCTM #1000-95.-1-11.2. The address is 8865 Oregon Road in Cutchogue. The property is located in the Agricultural-Conservation (A-C) Southold Town Board Meeting January 19, 2016 page 33 Zoning District and is situated on the northerly side of Oregon Road approximately 525 feet southwesterly from the intersection of Depot Lane and Oregon Road in Cutchogue, New York; and WHEREAS, the proposed acquisition is for a development rights easement on a part of the property consisting of approximately 18.577� acres (subject to survey) of the 19.7� acre parcel. The 1.1� acre area excluded from the acquisition is part of a pending Lot Line Modification ' application before the Planning Board to transfer the area to the soundfront lots to the north. The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owners; and WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase price is $55,000 (fifty-five thousand dollars) per buildable acre for the 18.577� acre easement plus acquisition costs. The purchase offer is less than fair market value of the development rights indicated in the Town's commissioned appraisal and the landowners may be eligible to claim a bargain sale; and WI�EREAS, the property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural value; and WHEREAS, the purchase of the development rights on this property is in conformance with the provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands Preservation) of the Town Code, and WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review) of the Town Code and Local Waterfront Revitalization Program ("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the LWRP; and WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition, and recommends that the Town Board acquire the development rights easement; and WI-�EREAS, the Town Board deems it in the best public interest that the Town of Southold purchase the development rights on this agricultural land; and, WHE1tEAS, the Town Board of the Town of Southold classifies this action as an Unlisted Action pursuant to the SEQRA Rules and Re�ulations, 6NYCRR 617.1 et. The easement will be acquired using Community Preservation Funds. The purchase price is $55,000 (fifty-five thousand dollars) per buildable acre for the 18.577� acre easement plus acquisition costs. The purchase offer is less than fair market value of the development rights indicated in the Town's commissioned appraisal and the landowners may be eligible to claim a bargain sale. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural value. Melissa Spiro,Land Preservation Coordinator MELISSA SPIRO, LAND PRESERVATION COORDINATOR: Hi, Melissa Spiro, Land Preservation Coordinator. The farm shown in red for those of you that can see this, it is outlined in red on the map and there has been a significant amount of land preservation in this area, all the farms marked with white are either in the town or the county's land preservation program. As noted in the hearing,the landowner is before the Planning Board to transfer about one acre on the north end of the property to the lots on the sound and that area shown on the map in the dotted white line and that area is not part of the development rights acquisition. The farm is adjacent to and in the vicinity of many farms that are in active farm, active agriculture, even if they are not preserved and the subject parcel is all prime agricultural soils. The Biggane's have discussed preservation of this property on and off for years and more recently they decided to proceed with offering the development rights to the town at the below market value amount. The purchase price is below that of the towns' appraisal and the owners may be able to use this as a charitable donation. It has been great working with Jack and Maggie Biggane, I have met with them many times and I thank them for giving us the opportunity to preserve this really important farm and both the land preservation committee and I support and recommend that the Town Board proceed. Robert Dunn,Peconic ROBERT DLTNN: Robert Dunn, Peconic. Clarify for me, if you would, the Planning Board and the Building Department rule on things that are already set, right? They don't make the decisions, in other words, they don't introduce anything. They have a set of rules that they follow and if things are okay,they proceed. SUPERVISOR RUSSELL: I am actually going to defer to Jim who's probably got inside knowledge and institutional knowledge on how the whole process works. COLJNCILMAN DINIZIO: They follow what we tell them in the code. MR. DLTNN: That's what my question is. COUNCILMAN DINIZIO: They don't make laws... Southold Town Board Meeting , January 19, 2016 page 38 MR. DLTNN: They don't make laws, they don't do anything. You guys in terms of code, you said okay we are going to go by the state code or the county code or the federal code. COLTNCILMAN DINIZIO: Right. MR. DLTNN: And they follow it. SUPERVISOR RUSSELL: And it should be pointed out that there is some room for discretion in the code. No code can be so ironclad that... MR. DUNN: I am sure. That's what they get paid the big bucks for. COLJNCILMAN DINIZIO: But even in the code, the discretion is described. We give them the discretion to do... MR. DLTNN: And they are all professional in what they do and they need to (inaudible), I am not questioning anything they have done, I am questioning something that's going on. The gas station that has been proposed for 48, it was a gas station, I see no reason that in the big picture that it could be objected to but there's something that having grown up and lived in Queens, I noticed that that became very annoying at gas stations, we have one here that does it but it really doesn't affect anybody and I don't think (inaudible). The new modern gas stations all have public address systems that crank out 24 hour, the entire time they are open, crank out promotional stuff, did you get your butter, did you get your eggs and when it's not cranking something out, it's playing music. It's really annoying to the people that live around and it would seem to me that if you are going to have more of these gas stations that you seriously consider a preemptive ruling on that stuff. The BP station on 48 does it now. I don't think he bothers anybody because there's nobody around, there's nobody close enough but when that station opens, whether it opens with 18 pumps or 6 pumps or whatever finally gets determined, those people should not be subjected to that. SUPERVISOR RUSSELL: Bill, does the Planning Board have the jurisdiction now, the authority to make that part of the conditions of the approval of the site plan? TOWN ATTORNEY DUFFY: Yes and actually they did do a pos dec on the SEQRA analysis, so they are going to have to do a full EIS, environmental impact statement, addressing light, noise and traffic impacts. MR. DL1NN: Well, I know we do light things but I mean that the board would give them some type of directive, we don't want that. It's not essential to operating a station, it's really not. SUPERVISOR RUSSELL: I personally think that Planning Boards have enough discretion to do that. I am sure Justice Scalia down the block is going to disagree with me. . COtJNCILMAN DINIZIO: I think they do, yes. Through the course of their hearings, they can have that discussion with them, certainly. , Southold Town Board Meeting January 19, 2016 page 39 MR. DLTNN: During the course of... COIJNCILMAN DINIZIO: The public hearing. MR. DLTNN: The town function, would it not be wise of the Board mentioning that to them? SUPERVISOR RUSSELL: The problem is, you don't want Town Board's mingling in the affairs of another discretionary board because we don't want to look like we are over- influencing. Let me just point out what Bill had just said, it was pos dec on a SEQRA, so all those concerns get laid out and the document gets presented to the applicant, who has to prove or show how they are going to mitigate those impacts. So if the noise is an issue, he is going to have to come back to the Planning Board and show how he is going to address it, possibly eliminate it. MR. DLTNN: As I told you a few minutes ago, you already have a gas station in town that obviously got approved... SUPERVISOR RUSSELL: Yes. Good point. MR. DUNN: By the Planning Board and the Building Department as they should have. They asked to do something that was legal in there and it slipped through and what I am trying to do here, it is not going to affect me, you all know where I live, no one is ever going to put a gas station there, so what I am trying to do and I was going to speak about this last week but when Mr. Shipman comes in and gets up, I really don't like to rain on his parade. I believe in what he is trying to do and i feel for him. So I don't want to see one of the neighbors to that or any other gas station in here, a year from now or two years from now, saying I can't get any relaxation at my house because I am either listening to bacon and egg ads or music at all hours of the day and night and it's not right. And then it's too late because you can't put the horse back in the barn once it's gone. COUNCILMAN RULAND: Bob, I think if you did some research into the site plan of the Valero station in Cutchogue, the very same thing happened but I do believe that it was a part of their site plan that they couldn't do that but they did and I do believe the Planning Board stopped them. Once they knew about it. MR. DLTNN: Okay. I mean, I just think that.... SUPERVISOR RUSSELL: If there is an appropriate way we can convey our concerns with regard to the noise or the amplified sounds to the Planning Board, we will certainly do that but I have to tell you, I think Planning Board's in general are a little bit more savvy than they were 20 years ago, you know, once bitten,twice shy. But, fair enough. We will convey our concerns. MR. DUNN: Like I said. It's never going to bother me.
