SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without " further steps under SEQRA. SUFFOLK.COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Dec. 22, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Jan. 14, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 77,276 sq. ft. or 1.77 acre parcel in . the R40 zone district with 176.55 ft. of frontage along Peconic Bay Blvd to the north; 163.18 ft. along Peconic Bay to the south; 495.29 ft. along the easterly property line; and 467.75 ft. along the westerly property line. It is improved with a 2 story frame house and a frame garage, as shown on the survey by John C. Ehlers Land Surveyor last dated 10-20-2015. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15F and the Building Inspector's November 9, 2015 Notice of Disapproval based on an application for building permit for accessory in-ground swimming pool, at; 1) proposed in location other than the code required rear yard or front yard on waterfront property. RELIEF REQUESTED: The applicant requests a variance to locate an in-ground swimming pool in a side yard location, where the code requires a front yard or rear yard location on waterfront properties, as shown on the survey/site plan prepared by John C. Ehlers, L.S., dated 08-20-2015 and last revised 10-20-2015 to show proposed pool location. Page 2 of 3—March 3,2016 ZBA#6913—O'Toole SCTM#1000-145-2-6 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 22, 2016 submitted a plan increasing the side yard setback from 10.2 ft. To 16 ft. where the code requires a minimum of 20 ft. side yard setback while maintaining a proposed 84 ft. bulkhead setback,thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: A letter was received from the adjoining property owner to the west, most directly affected, in opposition to the proposed location. Through personal inspection of the neighborhood by the Board Members, it appears that the adjoining property to the west also has an in-ground swimming pool in a side yard location. Another letter was received from a property owner to the north stating that he has no objection to the relief sought. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are customary accessory structures to residential properties and the alternative relief for a minimum 16 foot setback from the side yard will create an adequate buffer. The adjoining property to the west also has an in-ground swimming pool located in a side yard and the side yard setback of the principal dwelling is 16 feet to the adjoining property line. 2. Town Law 267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could construct an in-ground swimming pool in a conforming front yard location on this waterfront parcel; however that would require the removal of many large mature trees whereas the location granted by alternative relief would require the removal of one mature tree and a few smaller ones.There is no location in the rear yard that would not require a bulkhead setback variance. 3. Town Law $267-b(3)(b)(3). The alternative relief variances granted herein for a side yard location and a 16 foot minimum side yard setback are both mathematically substantial, representing 100% relief and 20% relief from the code, respectively. However, the adjoining property to the west has an in-ground swimming pool located in a side yard and the principal dwelling has a 16+foot side yard setback at the adjoining property line. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an in-ground swimming pool in a side yard location,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to DENY as applied for, and GRANT THE RELIEF AS AMENDED as shown on the Survey/Site Plan prepared by John C. Ehlers, L.S. last revised 2/18/2016. Subject to the following conditions; Page 3 of 3—March 3,2016 ZBA#6913—O'Toole SCTM#1000-145-2-6 CONDITIONS: 1. Evergreen screening shall be installed along the westerly property line. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. Drywell for pool de-watering shall be installed per survey. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minims in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. Due to business commitments, I will not be in-town on Feb 4th to attend the Hearing. I contacted the O'Toole's representative,William Birkmie"r (Bill) of North Fork Pool and Service (and from whom the Notice letter came from) the week of Jan 18th to voice my concerns about the proposed location. Bill said that he would pass on my concerns to the O'Toole's and get back to me. After not hearing anything for over a week, I called Bill again yesterday (Saturday,Jan 30) to see What the status was. He informed me that after.leaving two voicemails during the week, he had not heard back from them. Possibly they are away for vacation, or the winter,we supposed? Bill said he would call them immediately after our conversation and leave my phone - number with them so they could call me directly and discuss my reasons for opposition, if they desired. I have still not heard back, so I presume they are simply unavailable or they would've contacted me. I and my wife, Marie Arturi, own and reside'at the property adjacent to the subject property on its Western boundary.The subject property is 700 Peconic Bay Blvd, Laurel, NY and was recently purchased by Richard and Kathleen O'Toole (to the best of my knowledge in Sept 2015). The O'Toole's have requested a Variance from Town Code so that they May build an accessory 20' by 40' in-ground pool,with a surrounding patio, in the side yard of their property. ' RECEIVED FEB 01 2016 (66(3 The proposed location is the western side yard of the O'Toole's approximaixliyIEMSOARD OF APPEALS acre lot and would actually abut my property line when taking into account the patio (one side of the pool itself is about ten feet from my property line). My concerns center around the close proximity of the proposed side yard location of the pool/patio to my side yard line and to the change in character,it will bring to the neighborhood. As with any pool during the summer months, it will be a center of activity, along with accompanying noise provided by those enjoying it, right on my property line in the side yard! Obviously, I have no,objection to the O'Toole's enjoying summer time at their pool, but there are permitted locations to place the proposed pool that do not conflict with neighbors quality-of-life, creating hardship for others. I will look out my living room window at the proposed pool and my son will look out his bedroom window directly at the proposed pool. Isn't the avoidance of this type of thing one of the reasons the Town Code prohibits side yard buildings/structures?And even side yard structures that are granted require twenty foot setbacks, to the best of my knowledge. I did major renovations to my home in 2009,which also included building a pool. Knowing that I could have also requested a variance to place my pool in the side or back (waterside) yard of my property,which I.recognize the O'Toole's certainly have the right to do, I took into account the quality-of-life effect of my neighbor to my west and decided against it. The neighborhood has two pools that I know of, and both are located in the front (street) side of their property, thereby not interfering with their neighbors in any way on the water side of their homes. In fact, both pools are actually behind the homes of the neighbors, relative to the water side. I don't see the hardship on the O'Toole's locating their proposed pool similarly to the two others in the neighborhood.
