SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 22, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Jan. 14, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP Coordinator states the reason: 1. the "deck" proposed to be replaced is located seaward of the Coastal Erosion Hazard Line and does not meet Policy 4. The inconsistency is mitigated by the issuance of a previous review of the LWRP, dated Feb. 7, 2007 recommending the renovation of the "deck" as Consistent with the LWRP and the Coastal Erosion Management Permit 6530C, dated Feb. 14, 2007, which permitted the renovation of the subject "deck". Furthermore, the incidental in-place replacement of the 21 square feet of first and second story decks and associated steps located within the C.E.H.A. is a reasonable and necessary action related to the proposed in-place demolition, renovation and expansion of the existing dwelling. Also the applicant proposes to covenant in perpetuity an existing 15 foot wide, 3,090 square-foot non-turf buffer adjacent to the bluff crest, which will help mitigate potential erosion to the bluff, all making the proposed action CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is waterfront to Long Island Sound, located in an R-80 zone district and is non-conforming with 70,459 square feet of which 29,791 square feet is buildable. The property is improved with a two story frame house with attached decks, an in-ground swimming pool and frame shed. It has 130.04 feet and 110.99 feet at the northern property line along the apparent high water mark of Long Island Sound, 439.36 feet and 75 feet along the westerly property lines, 163.55 feet, 219.5 feet and 116.06 feet along the easterly property lines and fronts Sound View Avenue Extension for 100 feet, all as shown on the Survey/Site Plan prepared by Nathan Taft Corwin III, L.S. dated April 9, 2014, last revised January 15, 2016 Revise Prop. Septic System. Page 2 of 3—March 3,2016 ZBA#6911—Haratunian SCTM#1000-50-2-13 BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116A (1) and the Building Inspector's November 5, 2015 Notice of Disapproval based on an application for building permit to demolish existing dwelling and construct a new single family dwelling, at; 1) less than the code required bluff setback of 100 feet. RELIEF REQUESTED: The applicant requests a variance to demolish an existing dwelling and construct a new single-family dwelling having a 34 foot setback to the top of the bluff as shown on the Survey/Site Plan prepared by Nathan Taft Corwin, L.S. dated April 9, 2014, last revised January 15, 2016—Revise Prop. Septic System and the architectural drawings prepared by Meryl Kramer, R.A., Sheets EX-100, A-100, A-101 and A-200 all dated 10/28/15. ADDITIONAL INFORMATION: A letter from Suffolk County Soil and Water technician Ann Marie Calabro was received by the Board on February 23, 2016. The bluff on the subject property was found to be in"fairly stable condition with dense overgrown vegetative cover." To prevent bluff destabilization, it was recommended that heavy machinery, equipment, and supplies be stored and/or used at a minimum of 25 feet from the bluff top edge. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This community is characterized by dwellings which are located substantially closer to the bluff than 100 feet. Furthermore, the proposed construction effectively results in the in-place replacement of the existing two-story dwelling and attached decks with a landward expansion only on the landward side of the house toward the road and not toward either adjoining properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling exists at a non-conforming top of bluff setback and cannot be relocated landward sufficiently enough to warrant complete demolition, removal and relocation of the dwelling and foundation due to the size and configuration of the property, the orientation of the bluff, and the existing location of the in-ground swimming pool and pool patio located immediately south/landward of the existing dwelling. Therefore a proposed reconstruction in-place will require a top of bluff setback variance. 3. Town Law•4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 66%relief from the code. However, the proposed reconstruction will have the same non-conforming top of bluff setback to what presently exists. In addition, the applicant proposes to covenant in perpetuity an existing 15 foot wide, 3,090 square-foot non-turf buffer adjacent to the bluff crest,which will help mitigate potential erosion to the bluff. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of demolishing an existing dwelling and constructing a new single family dwelling Page 3 of 3—March 3,2016 ZBA#6911—Haratunian SCTM#1000-50-2-13 in-place with a landward expansion, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the Survey/Site Plan prepared by Nathan Taft Corwin, L.S. dated April 9, 2014, last revised January 15, 2016 — Revise Prop. Septic System and the architectural drawings prepared by Meryl Kramer, R.A., Sheets EX-100, A-100, A-101 and A-200 all dated 10/28/15. Subject to the following conditions; CONDITIONS: 1. Relocate the existing 8.3'x12.3' frame shed to a code conforming location. 2. The applicant shall formally covenant the maintenance in perpetuity of an existing 15 foot wide, 3,090 square-foot non-turf buffer adjacent to the bluff crest. 3. To prevent bluff destabilization, any heavy machinery, equipment, and supplies must be stored and/or used at a minimum of 25 feet from the bluff top edge. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. This evaluation of the property located at 1205 Soundview Avenue Extension in Southold was conducted on February 11, 2016. At the time of the visit, the ground was,covered with snow and a complete assessment of the ground for erosion concerns could not be determined. The bluff itself was found in fairly stable condition with dense overgrown,vegetative cover, including small trees, shrubs and vines with vegetative cover and the foreground (yard) leading to the bluff top is in turf grasses. The bluff face shows some slight erosion on the northeasterly corner of the property due to runoff that should be diverted within the plans for the new construction.The bluff top edge has a slight overhang. During construction, it is recommended that heavy machinery, equipment, or supplies be stored or used a minimum of a 25' setback from the bluff top edge. The heavy weight and vibrations from the machines may cause sloughing of the bluff. Due to the nature of the construction plans and the footprint for the construction, it is.necessary that every alternative to using heavy machinery be explored on the north side of the construction.. Thegeneral topography of the property is sloping away from the bluff face and the land itself is entirely vegetated with grasses, landscaping, shrubs and large trees. At the time of the visit, considering what could be assessed landward of the dwelling where the extension'is to be placed shows no obvious signs of instability. Construction of the extension according to the site plan is acceptable. Overall,the property was found to be suitable for its current proposal. Additions to dwellings in the neighborhood located substantially less than 100 feet from the bluff crest have also been granted relief by the Board, including that for the adjacent easterly property, 1305 Soundview Avenue Extension, whose deck addition located 47 feet from the bluff was approved pursuant to Case No. 5426 in December 2003; and for 435 Soundview Avenue Extension, located six properties to the west, whose deck addition located 42 feet from the bluff was approved pursuant to Case No. 4101 in June 1992. Although the applicants' "Notice of Disapproval" dated 5 November 2015 references a notably closer 34-foot bluff setback, it is important to recognize that this is not a newly proposed setback to the dwelling addition but rather the preexisting nonconforming setback that will be maintained—without diminishment— by the proposed project. Specifically, the attached first and second-story decks located at their nearest point 34 feet from the bluff are to be removed and reconstructed in-place in connection with the proposed renovation of the dwelling, which will be substantially renovated and partially reconstructed in-place and over the existing foundation, also without any further reduction of the dwelling's preexisting nonconforming bluff setback of 45 feet. The proposed dwelling and deck additions will actually be located farther from the bluff than those approved by the above cited variances, with minimum bluff setbacks of 56 feet to the nearest deck addition and 71 feet to the dwelling addition on the landward side of the existing dwelling. The relief, therefore, would also not result in a detriment to neighboring properties because the project effectively results in the in-place replacement of the existing two-story dwelling and attached decks with a landward expansion only on the landward side of the house and toward the road and subject swimming pool and not toward either of the adjoining properties. The benefit sought by the applicants is the expansion and improved functionality of the existing dwelling for year-round use by their growing family by increasing the habitable space and number of bathrooms; renovating the kitchen; and upgrading the dwelling's overall construction quality and energy efficiency. Achieving this benefit requires the in-place substantial renovation and partial reconstruction of the existing dwelling, which is located less than 100 feet from the bluff; and although the proposed dwelling expansion has been designed on the landward side of the house and as far from the bluff as possible, the existing dwelling location makes it impossible to locate the proposed construction more than 100 feet from the bluff. The benefits of renovating the dwelling in place and maintaining and reusing the first floor deck and foundation could only be outweighed by the benefits of increasing the bluff setback if the dwelling structure could be relocated landward sufficiently enough to warrant the cost and site disturbance associated with the complete demolition, removal, and relocation of the dwelling and foundation. However, the dwelling cannot be relocated sufficiently landward due to the size and configuration of the property; the orientation of the bluff; and the presence of the swimming pool located south of the dwelling, which was permitted and constructed between 2007 and 2009. Specifically, because the bluff crest bends landward on the east and west sides of the property, the dwelling cannot be relocated landward nearer to the sides of the property without actually moving closer to the bluff; and it cannot be moved sufficiently southward without impinging on and/or requiring the removal of the swimming pool and patio, for which there are no feasible alternative locations. Therefore, the proposed layout requiring the requested bluff setback relief is the most feasible and reasonable alternative for the applicants to achieve their goals. 3. The 66 feet of relief required to maintain the preexisting nonconforming bluff setback is mathematically substantial but involves no change to the location of the dwelling structure that dates back to 1970. The setback relief required for the proposed expansion is significantly less, including 44 feet of relief required for the nearest deck expansion and 29 feet for the nearest point of the dwelling expansion. 4. The proposed project will not have an adverse effect on the physical or environmental conditions of the neighborhood, as there will be no reduction of the preexisting nonconforming bluff setbacks; and the dwelling expansion is proposed on the landward side of the house with a minimum bluff setback 26 feet greater than the existing dwelling (71 versus 45 feet) and a deck expansion having a minimum bluff setback 22 feet greater than the existing decks (56 versus 34 feet). The fronting bluff is heavily vegetated and in stable condition, and there is no evidence that the existing dwelling, which has been in its present location for 45 years, has had any adverse effects on the condition of the bluff. Moreover, the project will provide additional protection of the bluff and other improvements to the environmental .1•� Ro a E. Specifically, the project would establish a 15' wide, approximately 3,090 square-foot non-turf buffer adjacent to the bluff crest, which will help to capture and absorb surface water runoff before it reaches the bluff, thus helping to mitigate potential top-down erosion of the bluff. The non-turf buffer will also provide the benefits of acting as a sink for potential contaminants (e.g., lawn fertilizers and pesticides) contained in surface water runoff; enhancing the natural character of the top of the bluff; and providing foraging area for wildlife. The project would also remove the existing sanitary system located less than 100 feet from the bluff and replace it with a new, upgraded, SCDHS-conforming sanitary system located more than 100 feet from the bluff and more than 200 feet from the surface waters of Long Island Sound. A temporary project limiting siltation fence would be set in place to control and contain site disturbance during construction, and a drainage system of leaders, gutters, and drywells would be installed to permanently collect and recharge roof runoff. Together, these mitigation measures will result in a potentially significant improvement to both groundwater and surface water quality through increased setbacks and improved treatment of effluent before it reaches the groundwater table; a reduction in potential roof runoff through capture and recharge by the proposed drainage system; and improved capture and filtering of surface water runoff by the non-turf buffer before it reaches the bluff, which protects against potential top-down bluff erosion. 5. The difficulty with meeting the required bluff setback is not self-created because the existing, permitted, dwelling structure a) was constructed 45 years ago and thus legally pre-dates the bluff setback required by Section 280-116(A)(1) of the Southold Town Code; and b) cannot be relocated landward sufficiently enough to warrant complete demolition, removal, and relocation of the dwelling and foundation due to the size and configuration of the property, the orientation of the bluff, and the presence of the permitted swimming pool and pool patio located immediately south of the existing dwelling. ,/ Robert E. SOUTHOLD,NY SCTM#1000-50-2-13 Policy 6 The proposed project and mitigation measures have been designed to protect and restore the quality and function of the surrounding ecosystem so that the project will not adversely affect the environmental conditions of the property, including the adjacent bluff and tidal waters of Long Island Sound. Specifically, the dwelling will remain in the same location well more than 100 feet from surface waters; and the dwelling expansion is proposed on the landward side of the house with a minimum bluff setback 26 feet greater than the existing dwelling. The fronting bluff is heavily vegetated and in stable condition, and there is no evidence that the existing dwelling, which has been in its present location for 45 years, has had any adverse effects on the condition of the bluff Moreover, the project will provide additional protection of the bluff and other improvements to the environmental condition of the property as a result of the incorporated mitigation measures. For example, the project would establish a 15' wide, approximately 3,090 square-foot non-turf buffer adjacent to the bluff crest, which will help to capture and absorb surface water runoff before it reaches the bluff, thus helping to mitigate potential top-down erosion of the bluff The non-turf buffer will also provide the benefits of increasing lawn setbacks; acting as a sink for potential contaminants (e.g., lawn fertilizers and pesticides) contained in surface water runoff; enhancing the natural character of the top of the bluff; and providing foraging area for wildlife. The project would also remove the existing sanitary system located less than 100 feet from the bluff and replace it with a new, upgraded, SCDHS- conforming sanitary system located more than 100 feet from the bluff and more than 200 feet from the surface waters of Long Island Sound, thus improving septic setbacks and treatment of effluent before it reaches the groundwater table. A temporary project limiting siltation fence would be set in place to control and contain site disturbance during construction; and a drainage system of leaders, gutters, and drywells would be installed to permanently collect and recharge roof runoff, thus resulting in a reduction in potential roof runoff through increased capture and recharge. Together, these mitigation measures will ensure that the project is consistent with Policy 6 and with the standards of Chapter 275. Due to its location landward of the bluff crest, the project is exempt from the NYSDEC's permitting requirements pursuant to Article 25 of the New York State Tidal Wetlands Land Use Regulations. Box 1179 Southold,NY 11971 Re: Stephen and Arda Haratunian,Case No.6911 Dear Ms.Toth: I am in receipt of the memorandum from the Town LWRP Coordinator,which recommends that the proposed project be deemed"inconsistent"with the LWRP because the existing first and story decks to be reconstructed(in- place)are located within the Coastal Erosion Hazard Area. However,only 21 square feet of the deck footprint is located within the Coastal Erosion Hazard Area,and none of the deck footprint is located within the"bluff'area as defined by Chapter 111 of the Town Code. Moreover,these decks are legally permitted structures pursuant to Chapter 111,the Town of Southold Coastal Erosion Hazard Area Law,as in 2007 they were the subject of Coastal Erosion Management Permit 6530C,which permitted the decks and associated stairway to be renovated with new hardwood floor boards,stair treads,and railings. And at that time the LWRP Coordinator recommended that the proposed renovation of the decks located within the Coastal Erosion Hazard Area be deemed"consistent"with the LWRP. It should also be noted that realistically,although the second floor deck will unavoidably need to be completely removed and reconstructed as proposed,the intent is to protect and maintain the existing first floor deck to the maximum extent possible so that it does not need to be reconstructed,and the above noted hardwood decking will be stockpiled and reused as much as possible. But rather than risking underrepresenting the possible scope of construction,we are potentially overstating the project scope with respect to the deck reconstruction so as not to risk misleading the Board and having the work exceed the scope of any variance approval granted. Furthermore,pursuant to the permit requirements set forth in Section 111-9 of the Town Code,the incidental,in- place replacement of the 21 square feet of first and second story decks and associated steps located within the Coastal Erosion Hazard Area is a reasonable and necessary action related to the proposed in-place renovation and expansion of the existing dwelling,which will neither cause nor otherwise affect erosion at the proposed site or adjoining properties. And potential adverse effects on the functions and protective values of the bluff will be protected against by 1)limiting the work proposed within the Coastal Erosion Hazard Area to the in-place replacement of this minimal,21 square-foot area of deck and associated easterly steps without expansion or further encroachment or impact on the bluff(approximately 32 square feet of existing steps associated with the westerly section of deck will also be permanently removed);2)the formal establishment of what will become a covenanted 15' wide,3,090 square-foot non-turf buffer adjacent to the bluff crest,which will help to capture and absorb surface water runoff before it reaches the bluff and thus help to mitigate potential top-down erosion of the bluff;and 3) erection of a temporary project limiting siltation fence located more than 15 feet landward of the bluff crest during construction to control and contain site disturbance.
