RELIEF REQUESTED: 12' deck extension at ~ear of dwelling with a
setback of 45 feet from the bulkhead and 19'3" from the closest boat
slip alcove. Lot coverage requested at 27% of total lot.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that
proposed deck construction will be less than 75' from existing
bulkhead and project will not meet lot coverage requirements.

I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
applicant would be denied the same use of his property as has been
afforded the majority of the parcels located along the Dawn Lagoon
shoreline. Additionally, applicant would encounter a practical
difficult y in locating the accessory structure anywhere within his
rear yard as the dwelling is situated 31' from the bulkhead.
2. The hardship created is UNIQUE and is not shared by al properties alike in the immediate
vicinity' of this property and in this use district because
dwellings outside the Dawn Lagoon vicinity encompass large enough
setbacks' from the shoreline/bulkhead lines to meet the 75' standard,
As stated previously, the'majority of the dwellings located along the
bulkhead canal 'contai~ improvements within the 75' setback distance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
there are many other residences adjacent to the subject property
that are improved with various accessory structures which are located
less than 75' frc~ the bulkhead line. Therefore, the subject deck
which is located 15.3' from the bulkhead line, would conforat to the
character of the district.

Dear Ms. Lachenmeyer:
We have received the documents you left in our office concerning
the above project and find that the application is incomplete
for the following reasons, therefore, it must be returned at
this time for resubmission:
1. Affidavit of mailing and post marked certified mail
receipts must be provided to show notice within the last
five days.
2. A copy of the Town Trustees waiver or other action
will be necessary under the Wet~and ordinance regulations.
3. The filing fee is $300.00 (The $150.00 check is
enclosed with this letter).
4. When the DEC has acted upon the application, or if you
receive any notification as to the status of this permanent
application, please provide us with a copy.
5. Please provide us with five 5) copies of the
construction diagrams which must show the height of the
total structure from ground level, whether any roofing
is proposed, and the setback of the proposed steps between
the deck and existing bulkhead.
6. Please provide us with calculations for all the
structures, the percentage of lot coverage as exists and
proposed lot coverage.

implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

MR. CHAIRMAN: Request for Variance regarding addition which
is to be within 75 feet of the bulkhead and with lot coverage at
approximately 27% for all building and construction. 330 Snug Harbor
Road, Cleaves Point Section III, Greenport. I have a copy of the
survey from Roderick Van Tuyl P.C., dated June 22, 1983,
updated February 23, 1993 and amended January 8, 1985, indicating a
two story frame house, approximately centrally located on the lot 35
feet from Snug Harbor Road. The nature of this application is a
deck, a variable 10 and 12 feet wide, running the majority of the
house on the west side facing Dawn Lagoon and I have a copy of the
Suffolk County Tax Map indicating this and surrounding properties in
the area. Is there somebody that like to be heard? How are you
tonight Sir? Would you state your name for the record.
CHUCK BOWMAN: Sure, Chuck Bowman, President, Land Use
Environmental, representing Joseph Duggan. First of all I have an
affidavit of Posting.
MR. CHAIRMAN: Thank you.
CHUCK BOWMAN: Dawn Lagoon is a dug canal, a private dug canal.
We do have a waiver from the Board of Trustees, the Town of
Southold permitting this deck to be installed. We also have a permit
from the New York State Department of Environmental Conservation.
The house in question, Mr. Duggan's house, preexists the 75 foot
setback requirement and is a preexisting non-conforming lot. As far

as the size of the lot it's 12,000 sq. ft. plus or minus. There's a
practical difficulty in that Mr. Duggan cannot place a deck and
this is a moderately size deck 10 ft. wide to 12 ft. wide and
anywhere else behind this property to produce the amount of variance
that is required. If you refer to the survey you'll see that the
majority of the deck varies between 51 and 45 ft. from the
bulkhead. It's only the north easterly section of it where a boat
slip comes into the property that it reaches the maximum of 19 feet
from the bulkhead. All the area seaward of the house between the
bulkhead and the house is ornamentally landscaped at the moment.
There is really no impact to the creek or per se and I can say there
is a numerous decks in any area

is owned by the Bunger Family and that house is about 37-1/2 feet
from the bulkhead, one which I'm very familiar with is Mr. Collins's
house which is on the opposite side of Dawn Lagoon and I
represented Mr. Collins and the permit was, a variance was granted
for that bulkhead which is about 47 feet from the existing bulkhead,
a third one is the Simkin house which is, we didn't get to measure
it but I would, judging from the photograph it's actually about 15 to
20 feet from the edge of the bulkhead and the last one was the
Lichten house, and that's about 37 feet from the bulkhead and
again you know these houses were all constructed prior to that 75
foot setback requirement so they have various ar.cas as a backyard as

Good. When I built the house in 1985, actually
when I put the bulkhead in 1982, I lost approximately 12 feet of
property because I have a, I had an egress in front of the house and
what they did if you take a look at those photographs you can see on
one of them you can see the setback where the bulkhead was pulled
back 12 feet. OK, so at that point what I had was I had a bulkhead
and then I had an egress and they weren't sure whether they were
going to give me a drift for a floating dock so they told me that I
could have a boat slip. So, that's how I ended having a boat slip
OK. It wasn't even something that I wanted, OK.
MR. CHAIRMAN: You have no intentions of incorporating this deck
into your house as opposed to moving it or any of that nature?
JOSEPH DUGGAN: Not at all, I just want to have a place like you
know right now we put a picnic table outside and it's all mud and
dirt you know. Half the people sit there so I just want to have a
place where I can put a table and chairs and stuff like that.
MR. CHAIRMAN: Does anybody have any questions of either the
applicant or the consultant?

JOSEPH DUGGAN: Well, the grass under the deck will just stay
there. It's not going to survive under the deck.
MEMBER VILLA: And you're not going to rip up the rest of the
grass?
JOSEPH DUGGAN: That's correct.
MEMBER VILLA: Now, your survey here is going dimensions but
that's basically to the house, that's not counting the deck, right?
You're showing 45 feet plus or minus but, the deck is coming out
another 10 feet.
JOSEPH DUGGAN: No, the 45 feet is to the deck and is different

the setback?
CHUCK BOWMAN: The setback would vary between 35 feet, 41 feet
and the closest being ]9, 43 feet.

could maintain like a minimum of 25 feet?
CHUCK BOWMAN: We went through this with DEC and also with one

closest point if you will to the bulkhead.
MEMBER VILLA: Now, we had another one with the boat slip and I
think we stayed with 25 feet from the nearest edge.
CHUCK BOWMAN: Well, I can say you know, my familiarity with that
Dawn Lagoon which is a you know a dug canal, it's not a natural
waterway it seems that the whole shoreline is highly developed by
Mr. ~Duggan has a landscaping and native landscaping if you will
further go down in front of the bulkhead. Many of the homes have
lawn and turf areas that are greater that slope right into the
lagoon. So, I think already we're starting at a point that is better
than many of the other properties. I believe that's the point of the
75 foot setback. You know you want to keep activities away from the
waterfront because they may infringe or adverse the flex of the water
quality and in this case you know we have already taken care of that
through DEC previous DEC purpose that have required the
establishment of that landscaped area the retaining walls that
contain in a storm water.
BOB VILLA: You're saying that it doesn't slope down to that
bulkhead?
CHUCK BOWMAN: No, I'm saying that the vegetation is ther~ and
the way the retaining wails having been setup are to intercept any

overland flow of water before they get there. You'll see the natural
vegetation that's there in ( ) if you will before it gets down
to the bulkhead.
MEMBER VILLA: It still slopes that way though.
CHUCK BOWMAN: Oh! Absolutely. The point I'm trying to make is
that the storm water is interceptive as oppose to some of the other
homes. Mr. Collins for instance you know just slopes directly his
lawn and then flows over the bulkhead.
MR. CHAIRMAN: While you're still there just let me ask if anybody
has, anybody else like to speak in favor of this application?
I guess that's about it.

CHUCK BOWMAN: Thank you.
JOSEPH DUGGAN: Can I just say one more thing? See, the area
where the, where the deck is close to the bulkhead happens to be
right off my dining room, OK. If that had been the other end of the
house I would have, I'd have no problem. I could move it, it would
be easy to do. But, to have a deck to have it come out of your
living room doesn't do you any good when your living room is on the
other end of your house.
MR. CHAIRMAN: Right.
JOSEPH DUGGAN: You see it may not ) in the house off the
dining room otherwise I'd be more than willing to move it you know.
MR. CHAIRMAN: The dining room is back of the garage?
JOSEPH DUGGAN: Yeah, the dining room is there and the garage
is over to the right, OK, that, that's the only reason I, you know ---

JOSEPH DUGGAN: Yeah, that part, you know, I mean, I mean at
that point the deck is only going to be 12 feet wide so it just about
gives me the 12 feet, I don't think, just, just about enough room to
have a table and chairs, OK. I mean if I could do it and make it a
little bit smaller if that would help any, I, I would but, I don't
know if I can get a table and chairs on then, you know, OK.

The following action was taken by the Board of Trustees at their
regular meeting of November 17, 1994:
RESOLVED that the Southold Town Board of Trustees grant a waiver
to construct a 10' X 62' deck to attach to an existing single
family dwelling. Said deck will be located a minimum of 19'3"
on the north end and 51 1/2' on the south end from the existing
bulkhead. Application also includes a 15' wide buffer planting
area seaward of the proposed deck as required by NYSDEC.

Inspect ions
1. The permitted site or facility, including relevant records, is subject to in-
inspection at reasonable hours and intervals by an authorized representative of
the DeparITmnt of Enviro~ental Conservation (the Department) to determine
v~ether the permittee is cuqJlying with this permit and the ECL. Such represen-
tat ive n-ay order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A
copy of this permit, including all referenced maps, drivings and special
conditions, n'ust be available for inspection by the Deparb~unt at all times at
the project site. Failure to produce a copy of the permit upon request by a
Deparb~unt representative is a violation of this permit.
Pen~it Changes and Renemals
2. The Department reserves the right to rredify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
t ions i s found;
b) the permit v~s obtained by misrepresentation or failure to disclose
re levant facts;
c) nevvrraterial infomution is discovered; or
d) environ~untal conditions, relevant technology, or applicable le~v or
regulation have material ly changed since the permit v~s issued.
3. The permittee rrust sub-nit a separate written application to the Depar~unt for
renewal, rrodification or transfer of this permit. Such application n~st include
any fOnTS, fees or supple~untal infom'~tion the Deparlr~'unt requires. Any
renewal, rredification or transfer granted by the Deparh~unt n'ust be in writing.

a) 180 days before expiration of permits for State Pollutant Discharge

not rmdify, supersede or rescind any order or determination previously issued by
the Department or any of the tem'~, conditions or requi re"rants contained in such
order or determination.

The permittee has accepted expressly, by the execut ion of the application, the
full legal responsibility for all da~uges, direct or indirect, of v~atever
nature and by vVn~uver suffered, arising out of the project described in this

This permit does not convey to the permittee any right to trespass upon th~
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the ir~paimunt of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands
ease~unts and rights-of-v~y that tray be required for this project.

9 That if future operations by the State of New York require an al-
t~rat.~on in the position of the structure or work herein authorized, or
if, in the opinion of the Department of Environmental Conservation 13
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navisable
and flood capacity of the watercourse No claim shall be made asainst
the State of New York on account of any such removal or alteration

by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and

SPECIAL CONDITIONS
The permittee shall install a drywell in the front (road) or
side yard a maximum of 45 feet west of the eastern property
boundary. Roof runoff from the house shall be directed to
the drywell for on-site recharge.
Prior to the ultimate expiration of this permit the
permittee will cause all fill and exposed faces to be
vegetated to prevent erosion.
There shall be no disturbance to vegetated tidal wetlands as
a result of the permitted activity.
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands.

SCENIC, and i~ECREATION~L RIVERS PERMITS:
A copy of this permit, including all conditions and approved
plans, shall be available at the project site whenever
authorized work is in progress. The permit sign enclosed
with the permit shall be protected from the weather and
posted in a conspicuous location at the work site until all
authorized work has been completed.
The permittee shall require that any contractor, project
engineer, or other person responsible for the overall
supervision of this'project reeds, u~derstands, and complies
with this permit and all its general, special, and
supplementary special conditions. A~y fail~re to comply
precisely with all of the ter::s and conditions of this
permit, unless authorized in w~iting, shall be treated as a
violation of the Environmental Conservation Law. If any of
the permit conditions are unclear, the permittee shall
contact the Division of Regulatory Affairs at the address on
page one or telephone (516) 444-0365.
If project design modifications become necessary after
permit issuance, ~he permittee shall submit the appropriate
plan changes for approval by the Regional Permit
Aa~inistrator prior to underts3cing any such modifications.
The permittse is advised ~hat substantial modification may
require submission of a new application for permit.
At least 48 hours prior to co~encement of the project, the
permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that
they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of
the permitted work, the bottom portion of that form shall
also be signed and returned, along with photographs of the
completed work and, if required, a survey.
For projects involving activities to be undertaken in phases
over a period of more than one year, the permittee shall
notify the Regional Permit Administrator in writing at least
48 hours prior to recommencing work in subsequent years
The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, office of General Se~¢ices, Tower Building,
