Woychuk Land Surveying, PLLC, last dated October 28, 2015. Pursuant to §111-8 and §275-3(C)(5), respectively, the proposed work is located beyond the jurisdiction of the Board of Trustees because all proposed structures will be located both landward of .the Coastal Erosion Hazard Area Boundary and more than 100 feet landward of Orient Harbor tidal wetlands to the west. Therefore, I am writing to respectfully request that you issue a "non jurisdiction letter" stating that no permits are required for the project pursuant to Chapters 111 or 275 of the Southold Town Code. In support of our request, I have enclosed two (2) copies of the above referenced survey/site plan; recent site photographs; and letters signed by the property owner providing authorization for En-Consultants to act on his behalf and for the Trustees to access his property. Woychuk Land Surveying, PLLC, last dated October 28, 2015, and determined that the proposed swimming pool and associated pool equipment and pool enclosure fencing is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top-of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions_are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
