determination rendered at our July 12, 1995 Regular Meetin~
conoa~nlng the above recent application for an accessory Bed
and Breakfast use in conjunction with your single-family
residence use.
For convenience purposes, copies of thi~ determination have
been forwarded to the Building Department for their permanent
records. You may wish to contact their office directly to
arrange for an appointment for a final inspection by the
Building Inspector pertaining to other conditions necessary for
fire safety laws, et cetera. {The visit previously made about
three weeks ago was by the Town (Enforcement) Investigator
Edward Forrester, who is located in a different department
{separate from the Department of the Building Inspectors.}

copy of the Zoning Code, Section 100-30B(14), subsections (a)
through (d). If you have any questions, please don't hesitate

(14) [Amended 3-14-1989 by L.L. No. 3-1989; 2-7-1995
by L.L. No. 3o19911] Bed-and-breakfasts which have
been issued a bed-and-breakfast permit by the
Building 'Inspector. Said permit shall be issued for a
term of one (1) year if the following conditions are
met:
(a) A smoke alarm shall be provided on each floor
and in every guest room.

(b) The dwelling shall have at least two (2) exits
and there shall be a window large enough for
emergency egress in each guest room.
(c) The identification sign shall be no larger than
two (2) square feet in areas zoned Residential-
Office or higher, but there shall be no exterior
signage identifying the use as a bed-and-
breakfast in residential areas.
(d) No accessory apartnaent, as authorized by
§ 100-31B(13) hereof, shall be permitted in or
on premises for wMch a bed-and-breakfast
facility is authorized or exists.
C. Accessory uses, limited to the following uses and subject
to the conditions listed in § 100-33 herein:
(1) Any customary structures or uses which are
customarily incidental to the principal use, except
those prohibited by this chapter.
(2) [Amended 4-9-1991 by L.L. No. 10-1991;
7-28-1992 by L.L. No. 14-1992] Home occupation,
including home professional office and home
business office. In permitting these uses, the Town
Board recognizes that the residents historically have

I am writing on behalf of John Czaartosieski who is before
your Board asking permission to open a Bed and Breakfast.
I have known John for atleast ten years and have worked with
him as a school coach. I am sure he will run his establish-
ment well and will more than meet the standards set.
~live next door to a B and B on Main Road and unfortunately~~
my house sits right on the property line. The houses are
too close yet I have found the Birkmiers to be even better
neighbors than they were before. Before the B and B he ran
chain saws and log splitters or lawn movers at very early
hours and had a stereo with large speakers~ounted on his barn
and blared music or ball games sometimes from dawn to dusk.~{
I never complained because ~hey were good neighbors otherwise.
.Now it's so quiet and even if there are no paying guests they
now are very considerate about noise. Before they were good
neighbors now they are the best! My experience has been the%
there are no negatives to having a B a~d B as a neighbor.

owner's bedroom at the rear of the second floor does not have access
from inside the dwelling. Tbi.q will require access from the
remainder of the dwelling. It is requested that you re-submit a
drawing show the doorway access from the hallway.

A. ~IDAL WETLANDS:
(1) All lands generally covered or intermittently coy-
ered with, or which border on, tidal waters, or lands
lying beneath tidal waters, which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet, including but not limited to banks,
bogs, salt marsh, swamps, meadows, fiats or other
low lying lands subject to tidal action;
(2)
All banks, bogs, meadows, fiats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following:, salt hay, black
grass, saltworts, sea lavender, tall cordgrass, high
bush, cattails, groundsel, marshmallow and low
march cordgrass; and/or
(3)
All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landward
edge of such a tidal xvetland.
B. FRESHWATER WETLANDS:
(1)
"Freshwater wetlands" as defined in Article 24, Ti-
tle 1, § 24-0107, Subdivisions l(a) to l(d) inclusive,
of the Environmental Conservation Law of the State
of New York: and
(2)
All land immediately adjacent to a "freshwater ~vet-
land," as defined in Subsection B(1) and lying with-
in seventy-five (75) feet landward of the most land-
ward edge of a "freshwater wetland."

(14) [Amended 3-14-1989 by L.L. No. 3-1989; 2-7-1995
by L.L. No. 3-1995] Bed-and-breakfasts which have
been issued a bed-and-breakfast permit by the
Building Inspector. Said permit shall be issued for a
term of one (1) year if the following conditions are
met:
(a) A smoke alarm shall be provided on each floor
and in every guest room.

(b) The dwelling shall have at least two (2) exits
and there shall be a window large enough for
emergency egress in each guest room.
(c) The identification sign shall be no larger than
two (2) square feet in areas zoned Residential-
Office or higher, but there shall be no exterior
signage identifying the use ss a bed-and-
breakfast in residential areas.
(d) No accessory apartment, as authorized by
§ 100-31B(13) hereof, shall be permitted in or
on premises for which a bed-and-breakfast
facility is authorized or exists.
C. Accessory uses, limited to the following uses and subject
to the conditions listed in § 100-33 herein:
(1) Any customary structures or uses which are
customarily incidental to the principal use, except
those prohibited by this chapter.

7-28-1992 by L.L. No. 14-1992] Home occupation,
including home professional office and home
business office. In permitting these uses, the Town
Board recognizes that the residents historically have
operated small businesses which provide services to
