THIS INDENTURE, made the 10th flay of
January, nineteen hundred and forty-seven, between =_

Parkohester, 62, Borough of the Bronx, New York, party
of the first part, and DAWN ESTATES INC., a corporation
of the State of New York, with principal business at

to Irving I. Bohn by deed dated July 19, 1946, recorded
in the oflloe of the Ulerk of the County of Suffolk
in Liber of Conveyances, at page ; running
thence along said lands conveyed to Kahn South 6
degrees, 20 minutes East 314.91 feet to the southwesterly
corner of said lands conveyed to Kahn which is the north-
westerly corner of lands conveyed by Marion H. Smith
to John Weiss and Mary Weiss by deed dated September 23,
1946, and recorded Inthe office of the Clerk of the
County of Suffolk in Liter of Conveyances, at
page , running thence along the westerly line of said
lands conveyed to Weiss South 6 degrees, 20 minutes East
and parallel with the westerly side of Luther's Road,

PARCEL II. CONRAENCING at a monument
set in the easterly side of Luther's Road at a point lying
approximately east from the southeast corner of lends of

on a curve to the left as plotted on said curvey by Otto
� W. Ven Tuyl,dat ed April 30, 1930, of which the first chord
runs South 81 degrees, 56 minutes, 50 seconds East 306.48
feet, and the second chord runs North 81 degrees, 31
minutes, 50 seconds East, 361.39 feet to a corner in
said land of .Vichert; running thence still along said

lands of W'ichert North 21 degrees, 33 minutes West,
to the waters of Mattituck Inlet, of which the mean
high water line in October, 1920, was at a distance of
428.49 feet on the last course; running thence along
the waters of Mattituck Inlet to the easterly side of
other lands now or formerly of J. H. Wiehert,which
point of intersection of said easterly side with the
mean high water line in October, 1920, was South 81
degrees, 16 minutes, 40 seconds West,237.50 feet from
j the terminus of the last course on that date; running
from the mean high water mark of Mattituck Inlet along
! said last mentioned lands of Wichert to the easterly
side Of Luther's Road at a monument set at a point which
iwas South 65 degrees, 54 minutes and 10 seconds Wast
from the intersection of the mean high water mark of
� Mattituck Inlet as it existed in October, 1920, with the
easterly side of said land of WSchert, and distant 310.74

of the party of the first part in and to any land lying

Inlet lying in front of and adjacent to the premises de- ,
scribed, and any right, title or interest of the party of -
the first part in and to the foreshore and lends under
Water adjacent to the same.
TOGETHER with-the anpurt enenaes and e11 the
estate and rights of the party of the first part in and
to said premises.
TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, its successors and
assigns forever.
AND the party of the first part, in compliance
with rection 15 of the Lien Law, covenants that she will
receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the
improvement and that she will apply the same first to the
payment of the cost of the improvement before using any
part of the total of the same for any other purpose.
AND the said MARION H. SMITH covenants ea
follows:-FIRST: That said b;ARION H. SMITH is seized of
said premises in fee simple, and has good right to convey
the same•
SECOND: That the party of the second pert shall
quietly enjoy the said premises.
THIRD: That the said premises are free from
encumbrances, except as aforesaid.
FOURTH: That the party of the first part will
execute or procure any further necessary assurance of
the title to said premises.
