THIS INDENTURE, made the 18th day of November, two thousand fifteen
BETWEEN EUGENE T. HART a/k/a EUGENE I. HART AND ANNA MARIE HART,
HIS WIFE, residing at 1 Gateway Drive, Bay Shore, New York 11706, party of the first
part, and
CLAUDIA S. CEBADA MORA, residing at 13 Warner Court, Baiting Hollow, New York
11933, party of the second part,
WITNESSETH, that the party of the first part, in consideration of One Dollar paid by the
party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and
State of New York, known and designated as and by the Plots Nos. 1, 2, 3, 4, 5 and 6 on
a certain map entitled "Map of Goose Bay Estates", in the Town of Southold, Suffolk
County, New York, said map being made by Lewis N. Waters, L.W. of Oyster Bay, L.I.,
N.Y., dated Sept. 12, 1934 and filed in Office of the Clerk of Suffolk County on
November 13, 1934, as and by the Map No. 1176, and a described parcel which when
taken together are bounded and described as follows:
BEGINNING at the corner formed by the intersection of the easterly side of Pine Avenue
and the northerly side of Hickory Avenue;
THENCE North 19 degrees 19 minutes 30 seconds East along the easterly side of Pine
Avenue 120.00 feet to a pipe and land now or formerly of Sirico;
THENCE along the last mentioned land of Sirico the following 2 courses and distances:
1) South 70 degrees 40 minutes 30 seconds East, 125.00 feet to a pipe;
2) South 72 degrees 25 minutes 30 seconds East, 157.64 feet to a pipe on the
westerly side of a Private Road (not open);
THENCE South 17 degrees 34 minutes 30 seconds West, 98.29 feet to land now or
formerly of Hilary;
THENCE along the last mentioned land the following 2 courses and distances:
1)North 73 degrees 01 minute 10 seconds West, 160.71 feet to a point;
2) South 19 degrees 19 minutes 30 seconds West, 20.00 feet to the northerly side
of Hickory Avenue;
THENCE North 70 degrees 40 minutes 30 seconds West along the northerly side of
Hickory Avenue, 125.00 feet to the easterly side of Pine Avenue and the point or place
of BEGINNING.

SAID premises also known as 70 Pine Avenue and/or 125 Private Road #31, Southold,
New York
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed from Viola Manarel dated March 9, 1970, and recorded in the Office of the
Clerk of the County of Suffolk, in Liber 6715 at page 411, on March 11, 1970, and by
correction deed from Viola Manarel dated September 24, 1974, and recorded in the
Office of the Clerk of the County of Suffolk, in Liber 7726 at page 474, on October 7,
1974. By scrivener's error, Eugene I. Hart was not corrected to Eugene T. Hart.
TOGETHER with the right to use for all reasonable purposes all that portion of the land
lying in front of Plots Nos. 53 to 58, both inclusive, and Plots Nos. 277 to 310, both
inclusive, said right to be in common with other plot owners on said map, or owners who
may hereafter acquire said plots on said map, subject to such reasonable rules and
regulations with respect to the use thereof as the Oliver Bros. Building and Construction
Corp. may from time to time put into effect, it being understood that should the owner or
owners of plots facing Goose Creek desire to erect a dock on said land, he may do so
providing said dock does not prevent other owners of plots on said map passing over and
reasonably using the land herein referred to, and providing proper legal provisions are
complied with, and the consent of the Oliver Bros. is secured.
SUBJECT to any state of facts an accurate survey may show.
SUBJECT to covenants, restrictions, agreements and public utility easements of record.
TOGETHER with all right, title and interest, if any of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day
and year first above written.
