Application for STEPHEN T. VESEY and CHERYL SCHLITT.
Variance to the Zoning Ordinance, Article IIIA, Section
100-30A.3 for the existing location of a deck addition "as
built." A portion of the deck encroaches in the side yard.
The accessory garage structure, which has existed, is also now
partly in a side yard area. Location of Property: 2105 Old
Orchard Road, East Marion, NY; County Tax Map Parcel No.
1000-37-3-6. Subject premises contains a lot area of 8,638+-
sq. ft. and is located in the R-40 Low-Density Residential Zone
District.
WHEREAS, a public hearing was held on February 2, 1994, at
which time those who desired to be heard were heard and their
testimony recorded (no opposition was received); and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, the present use and
building(s), and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is a parcel of land shown on the Map of Gardiners
Bay Estates as Lot Nos. 13 and 13A (Combined as one) with a
total lot area of 8,638 square feet, and two street frontages of
40.0 feet;
(b) is improved with'a single-family, one-story frame
dwelling structure with attachments as more particularly shown
on the survey amended December 23, 1993, prepared by Roderick
VanTuyl, P.C., which dwelling is shown to be set back six feet
from the northerly property line, 13 feet from the southerly
property line, 34 feet (exclusive of porch and step area) from
the front property line along Old Orchard Lane, and 110+- feet
from the easterly front property line along Sylvan Drive;

(c) is also improved with a garage building, built as
an accessory structure in the rear yard with a setback at l+-
feet from the southerly side property line. The deck area, now
extends "as built" into the side yard, which places a portion of
this accessory building in the side yard as well;
(d) is improved with a new deck area which is the
subject of this variance which extends "as built" into the side
yard with a setback at 11 feet from the side property line.
The new sideyards are 11 feet and 6 feet, rather than 13 feet
and 6 feet, for a reduction of two feet.
2. By this application, appellants have requested approval
for a reduction in the southerly yard setback by two feet, for
an ll-foot setback for the new deck area (instead of the
principal setback of 13 feet). The total setbacks, as built
with the new deck, are now 17 feet, rather than the 19 feet
previously existing.
3. The code requirement for a nonconforming parcel in this
R-40 Zone District is regulated by ~100-244 of the Zoning Code
as it pertains to less having less than 20,000 sq. ft. enacted
in January 1989 for minimum sideyards at 10 feet and 15 feet.
4. It is the position of the Board that the amount of
relief requested is not substantial in relation to the
requirement, being a variance of two feet for the new deck.
No other side yard would be reduced, and the garage has not been
moved and will remain in the present location.
5. In considering this application, the Board also finds:
(a) there is no valid public purpose which outweighs
the applicant's difficulties for a two-foot variance for the
southerly side, and two-foot variance for the total sideyards;
the size of the deviation is de minimus;
(b) a substantial change will not be produced in the
character of the neighborhood;
(c) the difficulty cannot be obviated by some method
feasible for the applicant to pursue other than another variance;
(d) in view of the manner in which the difficulty
arose and the fact that additional land area is not available,
the interest of justice will be served by allowing the
three-foot side yard reduction.

(e) the applicant's difficulties are self-created
since the deck was not built exactly to plans issued under the
Building Permit <#21755 dated 11/3/93>;
(f) the difficulties claimed are uniquely related to
the layout and general character, shape and size of this parcel
and are not unreasonable;
(g) in considering all of the above factors, the
interests of justice will be served by granting the reduction in
the sideyard, as requested.
Accordingly, on motion by Chairman Goehringer, seconded by
Member Wilton, it was
RESOLVED, to GRANT the requested reduction of two feet from
the southerly property line for the deck extension, "as built,"
with a setback at 11 feet, SUBJECT TO THE FOLLOWING CONDITION§:
1) There be no adverse lighting - all lighting must be
shielded to the ground to prevent annoyance or glare onto
neighboring properties.
2) That it remain unroofed, as applied.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Dinizio, Wilton and Villa. This resolution was duly adopted.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, that the following
public hearings will be held by the SOUTHOLD TOWN BOARD OF

and requesting approval of the substandard lot area, width and
depth for each of two proposed lots in this proposed subdivision
application. Subject premises is identified on the Suffolk
County Tax Maps as District 1000, Section 117, Block 9, Lot
19.1, containing a total lot area of 14,300+- sq. ft. Lot #1
is proposed at 7153+- sq. ft. in area, 101.41 feet of lot depth
and lot width (frontage) of 70.59 feet along the westerly side
Of Third Street. Lot #2 is proposed at 7147+- sq. ft. in area,
70.59 feet of lot depth and lot width (frontage) of 101.25 feet
along the northerly side of Jackson Street, New Suffolk, Town of
Southold. Each lot will contain a preexisting single-family
dwelling and accessory storage building, which buildings are
noted on the Pre-Existing Certificate of Occupancy No. Z-22830.
3. 7:40 p.m. Appl. No. 4161 - BARBARA KUJAWSKI. Request
for Special Exception approving an existing Accessory Apartment
in conjunction with the principal dwelling use and residency by
the owner (owner occupancy) and subject to the provisions of
Article III, Section 100-31B(14). Location of Property: House
No. 125 (per Town Records) at the north side of Sound Avenue
which parcel commences at a point approximately 51 feet east of
the Riverhead-Southold Town Boundary Line, extending 195.18 feet
along Sound Avenue, Mattituck, NY; County Tax Map Parcel No.
1000-120-1-2.2. This property consists of an area of 40,241

1/5/94 - Building Inspector's Office confirmed that the reason
the deck was permitted in the first place was because it was
shown to be at grade and not elevated. When the deck was built
and subsequently inspected, the deck was found to be above
ground level (raised). Placement of a raised deck extension
(as enlarged to extend into the side yard) does also place the
existing garage in the side yard area.

are under contract to sell and close as soon as the purchasers
received a mortgage commitment, etc. - probably in February)>.

CHAIR~AN: There are several pictures in the file, a copy
of the survey produced by Roderick VanTuyl, P.C. dated Decem-
ber 14, 1993 indicating the deck and/or decks in the rear of the
property and the garage which is now attached to the deck which
is approximately one foot from the property line on the
southerly side - southeasterly side. And I have a copy of the
Suffolk County Tax Map indicating this and surrounding

MR. VESEY: I'm Steve Vesey; I'm the applicant. And this is
Cheryl Schlitt also applicant. And we feel the application is
Self-explanatory. And hope the Board will give us a favorable
ruling and are hear to answer any questions the Board might have
regarding the variance.
CHAIRMAN: Ok. At no time in the future you anticipate
closing this?
MR. VESEY: No.

variance in the area, and I believe I had seen it at that time.

MR. VESEY: One of the reasons the deck was created is we
have a lot of downspouts from off the roof, and the area gets
very wet. So it's a ground-level deck. It helps us to get
above the water, and the mud.

MEMBER DOYEN: No.
CHAIRMAN: Bob ?
MEMBER VILLA: No, I don't.

Upon application of JOHN AND CONSTANCE CRONIN.
Request for Variance to the Zoning Ordinance, Article IIIA,
Section 100-30A.3 for approval of deck with insufficient rear
and side yards and in excess of lot coverage limitation.
Location of Property: 1055 Old Orchard Lane, East Marion, NY;
County Tax Map Parcel No. 1000-37-3-7.
WHEREAS, a public hearing was held and concluded qn
June 22, 1993; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. This application is an appeal of the May 6, 1993 Notice
of Disapproval issued by the Building Inspector for an existing
open, unroofed deck addition extending 16 feet off the rear wall
and having a width of 22 feet, and an attached open walkway six
feet off the southwesterly (side) wall of the dwelling, all as
shown on the sketch submitted with the application.
2. The property in question is known as Lot No. 14 on the
Map of Gardiners Bay Estates, Section Two, filed, with the
Suffolk County Clerk on September 23, 1927 (prior to the
enactment of zoning). This lot is further identified on the
Suffolk County Tax Maps as District 1000, Section 037, Block 03,
Lot 007, and consists of an area of 4,638 square feet and lot
width of 40 feet along Old Orchard Road, East Marion.
3. The portion of the deck construction necessitating
relief as to rear yard location is shown by applicant to be at a
setback of 20 feet from the rear line (instead of the required
35 feet). Also, the open wooden walkway at the southwest side

is shown by applicant to have a setback at 1.7 feet (or slightly
more) from the side property line, which is closer than
established nonconforming sideyard of the dwelling at 6.6 feet.
The lot coverage is calculated at not more than 32 percent of
the land area, (although the figure furnished by the applicant's
attorney is 1,472+- sq. ft. which is slightly less).
4. It is the position of this Board in considering this
application that:
(a) the circumstances are unique to the substandard
size of layout of this property and are not personal to the
landowners;

(b) the relief requested is not substantial - and
area of the dwelling as exists is 792 sq. ft. which is
today's minimum requirement of 850 sq. ft.;
(c) the relief requested will not alter the essential
character and is in harmony with the intent of zoning;
(d) there is no other method feasible for appellants
to pursue other than a variance - the land area is very small
and cannot be increased in size;
(e) the benefit to applicant is minimal and will not
cause an undesirable change in the character of the neighborhood
ora detriment to nearby properties by the grant of the
variance;
(f) the proposed variance Will not have an adverse
effect or impact on the physical or environmental conditions in
the neighborhood or district;
(g) the deck and attached walkway which is the
subject of this application is existing, and although the
difficulties claimed may be considered in some respect as
"self-created," this Board finds that this does not preclude the
granting of the relief - in light of all of the above findings.
Accordingly, on motion by Member Wilton, seconded by Member
Dinizio, it was
RESOLVED to GRANT the relief requested (and described in
the above findings) for an open, unroofed deck with side
walkway, as exists, subject to the following CONDITIONS:
1) This relief is limited to an open, unroofed, unenclosed
deck and side walkway, as requested;

2) There shall be no expansion or extension of the deck
and walkway - unless further consideration, after formal
application, is obtained;
