PROVISIONS APPEALED FROM: Article XXIV, Sections 100-244A & B.
RELIEF REQUESTED: Map as amended the date of the hearing, with a front
setback proposed at 35 feet instead of the required 60 feet, from the
applicant's westerly property line which is located within the boundaries of a
traveled private right-of-way (the edge of the right-of-way is shown by the
surveyor to be 7.5 feet inside the boundaries of this parcel. The remaining
yards are shown to be in conformity with the Code at 90 (rear yard) feet, 20
(side yard) feet, and 312+- feet (front yard) from the proposed house to the
southerly property line along the Main Road.
REASONS/FINDINGS: Official Town records show that a front yard interpreta-
tion of yards fronting private rights-of-way have continued with this
interpretation for more than 25 years, which designates some lots to be corner
lots, and others with one front yard (being on a private right-of-way rather
than a town road) . (No change in this procedure was offered at this time.)
The Board of Appeals has recognized the need for relief when a private
right-of-way is shown on a map, having considered many different scenarios -
depending on the neighborhood and configuration of the lots. This vacant
parcel, a corner lot, has frontage along the north side of the Main Road and
the easterly side of a private vehicular right-of-way. A dwelling is being
proposed with setbacks approximately 312 feet from the Main Road, 90 feet from
the northerly property line, 20 feet from the easterly (side) property line,
and 35 feet from the westerly (front) property line. The west -east width of
the house, including attached two -car garage, is shown to be 70 feet, and the
north -south depth at 41'3". Due to the nature of this long, narrow lot, motion
was offered by Member Dinizio as follows.

is requested for the reason that the subject preexisting nonconforming lot is
considered by the building department to be a "corner lot". We request
that the Zoning Board clarify and/or interpret Southold Town Code
Section 100-13 "corner -lot" where a right-of=way is considered a street
necessitating two front yard setbacks. In the alternative, that the
applicant be granted a variance from the 60 foot front yard setback for
the side yard of a "corner lot".

surveyor to be 7.5 feet inside the boundaries of this parcel. The remaining
yards are shown to be in conformity with the Code at 90 (rear yard) feet, 20
(side yard) feet, and 312+- feet (front yard) from the proposed house to the
southerly property line along the Main Road.
REASONS/ FINDINGS: Official Town records show that a front yard interpreta-
tion of yards fronting private rights-of-way have continued with this
interpretation for more than 25 years, which designates some lots to be corner
lots, and others with one front yard (being on a private right-of-way rather
than a town road). (No change in this procedure was offered at this time.)
The Board of Appeals has recognized the need for relief when a private
right-of-way is shown on a map, having considered many different scenarios -
depending on the neighborhood and configuration of the lots. This vacant
parcel, a corner lot, has frontage along the north side of the Main Road and
the easterly side of a private vehicular right-of-way. A dwelling is being
proposed with setbacks approximately 312 feet from the Main Road, 90 feet from
the northerly property line, 20 feet from the easterly (side) property line,
and 35 feet from the westerly (front) property line. The west -east width of
the house, including attached two -car garage, is shown to be 70 feet, and the
north -south depth at 41'3". Due to the nature of this long, narrow lot, motion

After investigation and inspection the Board finds that the
applicant requests permission to build now. one family dwelling
with insuffiafent frontyard setback located on private right-of-
woff north side of Main (state) toad (on proposed minor
soldivision map), East Marion, New York, The findings of the
Board are that Lot #5 slopes sharply from the northerly boundary
for a distance of approximately 50 feet dowin the center and the
slope becomes gradual towards the southern edge which is several
Peet below the level of the Main Road. If a house is built in
accordance with the Zoning Ordinance, 50 feet from the northern
boundary, there will be a greater possibility of its having a
wet basement during storm periods; there will be a *a- lots,
loss of view of Long Island Round and a greatly curtailed view
of orient Harbor. The other late in this subdivision have a
generally higher elevation than the greater part of. Lot # 5•
The lot to considered a corner lot with respect to the right-of-
way running along its eastern and northern boundaries. The
proposed house would be located at.a.distanoo no further from
the Main Road than existing houses in the immediate area. The
Board agrees with the reasoning of the applicant.
The Board finds that striat application of the Ordinance
will produce practical diffioulties.or unnecessary hardship; the
hardship created is unique and would be shared by all properties
alike .in the immediate vicinity of .this property and in the
same use district; and the variance does abearve the spirit of
the Ordinance and will not change the character of the district.

parcel, a corner lot, has frontage along the north side of the Main Road and
the easterly side of a private vehicular right-of-way. A dwelling is being
proposed with setbacks approximately 312 feet from the Main Road, 90 feet from
the northerly property line, 20 feet from the easterly (side) property line,
and 35 feet from the westerly (front) property line. The west -east width of
the house, including attached two -car garage, is shown to be 70 feet, and the
north -south depth at 41'311. Due to the nature of this long, narrow lot, motion

The building department has determined that the subject parcel
is a "corner lot". A corner lot is defined at Southold Town Code
Section 100-13 as "A lot at the junction of and abutting on two (2)
or more intersecting streets..." However "street" is defined as "A
street, improved to the satisfaction of the Planning Board, which
is one (1) of the following: (1) An existing town, county or state
highway or street. (2) A street shown on an approved subdivision
final plat. (3) A street shown on a map filed with the County
Clerk 4(in accordance with section 280-a of the Town Law) prior to
Planning Board authorization to review subdivisions." The right-
of-way that encumbers this parcel is not a "street" as defined in
the Southold Town Code, therefore this parcel is not a "corner
lot". We ask that the Zoning Board clarify and/or interpret this
provision of the Southold Town Code.
If this lot is not a "corner lot" the applicant can comply with
the side yard setbacks from the real property lines for
nonconforming lots set forth at Southold Town Code Section 100-
250 (B).
In the event a variance is required Town Law section 267b-3 sets
forth the standard to be applied by this board. The Southold Town
Zoning Board of Appeals is to analyze and asses the personal
benefits anticipated by the applicant against the potentially
deleterious effects that a grant of the relief requested would have
on the health, safety and welfare of the effected neighborhood or
community. In performing this balancing test, the Zoning Board is
charged with the responsibility to consider the five factors
enumerated in Town Law Section 267b -3(b). The variance should be
granted for the following reasons:
1. No undesirable change will be produced in the character of the
neighborhood or a detriment to nearby properties,if the variance
is granted. The property is long (over 455 feet) and narrow (over
132 feet) and similarly sized to the adjoining properties.
The residence is located on the parcel inorder to benefit from the
extraordinary view of Orient Harbor. The,, owner would be
significantly adversely impacted if the house were to be located
in such a way as to meet the "corner lot" set back of 60 feet. The
right-of-way runs along the westerly property line a width of 7.5
feet and is to serve as a common driveway. The proposed variance
will have minimal impact on the use of the right-of-way.
2. The benefit sought by the applicant can not be achieved by some
method, feasible for the applicant to pursue, other than an area
variance. Due to the topography and nonconforming width of the lot
the lot can not be developed with a traditionally designed home

which blends with the architectual character of Orient other than
by the granting of this variance.
3. The area variance is substantial, however in the application
of the balancing test the variance should be granted. If this lot
were not a "corner lot" the side yard setbacks could be met.

4. The variance will have no adverse effect or impact on the
physical or environmental conditions in the neighborhood or
district. The properties in this neighborhood are similarly
developed, the purpose of this appeal is to develop this lot in
conformity with the character of the neighborhood.
5. The alleged difficulty was not self-created.
6. The variance requested is the minimum variance practicable
given the personal benefits anticipated by the applicant.

is granted. The property is long (over 455 feet) and narrow (over
132 feet) and similarly sized to the adjoining properties.
The residence is located on the parcel inorder to benefit from the
extraordinary view of Orient Harbor. The owner would be
significantly adversely impacted if the house were to be located
in such a way as to meet the "corner lot" set back of 60 feet. The
right-of-way runs along the westerly property line a width of 7.5
feet and is to serve as a common driveway. The proposed variance
will have minimal impact on the use of the right-of-way.
2. The benefit sought by the applicant can not be achieved by some
method, feasible for the applicant to pursue, other than an area
variance. Due to the topography and nonconforming width of the lot
the lot can not be developed with a traditionally designed home

3. The area variance is substantial, however in the application

district. The properties in this neighborhood are similarly
developed, the purpose of this appeal is to develop this lot in

6. The variance requested is the minimum variance practicable
given the personal benefits anticipated by the applicant.

PROVISIONS APPEALED FROM: Article XXIV, Sections 100-244A & B.
RELIEF REQUESTED: Map as amended the date of the hearing, with a front
setback proposed at 35 feet instead of the required 60 feet, from the
applicant's westerly property line which is located within the boundaries of a
traveled private right-of-way (the edge of the right-of-way is shown by the
surveyor to be 7.5 feet inside the boundaries of this parcel. The remaining
yards are shown to be in conformity with the Code at 90 (rear yard) feet, 20
(side yard) feet, and 312+- feet (front yard) from the proposed house to the
southerly property line along the Main Road.
REASONS/ FINDINGS: Official Town records show that a front yard interpreta-
tion of yards fronting private rights-of-way have continued with this
interpretation for more than 25 years, which designates some lots to be corner
lots, and others with one front yard (being on a private right-of-way rather
than a town road) . (No change in this procedure was offered at this time.)
The Board of Appeals has recognized the need for relief when a private
right-of-way is shown on a map, having considered many different scenarios -
depending on the neighborhood and configuration of the lots. This vacant
parcel, a corner lot, has frontage along the north side of the Main Road and
the easterly side of a private vehicular right-of-way. A dwelling is being
proposed with setbacks approximately 312 feet from the Main Road, 90 feet from
the northerly property line, 20 feet from the easterly (side) property line,
and 35 feet from the westerly (front) property line. The west -east width of
the house, including attached two -car garage, is shown to be 70 feet, and the
north -south depth at 41'3". Due to the nature of this long, narrow lot, motion
was offered by Member Dinizio as follows.
