Tortora hogUFFO(,coG o y N Z 1 • BOARD OF APPEALS TOWN OF SOUTHOLD Appl. 44.114 ACTION OF THE BOARD OF APPEALS APPLICANT: DONNA IGLESIAS-WEXLER (ref: Map of Prop Estate of G. Sanders Nowell under consideration) Southold Town Hall 53095 Main Road P.O. Box 1179 Southold, New York 11971 Fax (516) 765-1823 Telephone (516) 765-1809 9/19/96 for the PROPIsRTY LOCATION: 8335 Main Road, East Marion. 1000-31-2-32.1 (formerly 14 and 32, as combined). BASIS OF APPEAL: August 21, 1996 Action of Disapproval by the Building Inspector, Article IIIA, Section 100-30A.3. RELIEF REQUESTED: (1) Request for approval of proposed Lot #1 and #2, each with insufficient lot width (frontage) to the new proposed division line, and (2) request for insufficient sideyard setbacks from existing dwellings to the new division Line; all as more particularly shown on survey map dated July 19, 1989. amended Aug. 26, 1996 for G. Sanders Nowell Estate, c/o Donna Wexler. MO'T'ION MADE BY: L. Tortora SECONDED BY: S. Doyen. ACTION/R.ESOLtJTION ADOPTED: Approved as applied (with notation that the Suf'ok County Water Authority will be purchasing the farm and forest land for the supply of water in these areas). REASONS/FINDINGS: 1. 'total lot area of each parcel will meet (or exceed) code requirements. 2. Lot width and setback variances are the minimum necessary. 3. No physical change in the location of the buildings will be necessary by the placement of this "division line" between the two dwellings. 4. There is no alternative available for appellants to pursue. 5- The difficulties are related to the layout of the land, and arc not personal to the landowners. 6. The character of the neighborhood will remain significantly unaffected by the minimum variances. 7. No adverse physical or environmental effects will be produced on adjacent properties since the plan will continue to be in conformity with the zoning code. VOTE OF TILE BOARD: Ayes: S. Doyen, R. Villa, L. Tortora, G. Goehringer. (Member Dinizio abstained from voting on this project.) This resolution was duly adopted (4-0). ZBA:lk i N/v / ✓/ / GERARD P. The question of whether an action may he significant is not always easy to answer. Frequent- ly, there are aspects or a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge or the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method wherebv applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic Project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It orovides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially - large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially -large, then Part 3 is used to evaluate whether or not the impact is actually important. DETERMINATION OF SIGNIFICANCE—Type 1 and Unlisted Actions Identify the Portions of EAF completed for this project: ❑ Part 1 U Part 2 ❑Part 3 Upon review or the information recorded on this EAF (Parts 1 and 2 and 3 if appropriate), and any other supporting information, and considering both the magitude and importance of each impact, it is reasonably determined by the lead agency that: A. The project will not result in any large and important impact(s) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be g p prepared. ❑ B. Although the project could have a significant effect on the environment, there will not be a significant effect for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore a CONDITIONED negative declaration will be prepared.* ❑ C. The project may result in one or more large and important impacts that may have a significant impact on the environment, therefore a positive declaration will be prepared. A Conditioned Negative Declaration is only valid for Unlisted Actions Name of Action Name of Lead Agency Print or Type Name of Responsible Officer in Lead Agency Title of Responsible Officer Signature of Responsible Officer in Lead Ae—icy. Signature or Preparer(If different rrom responsible orricer) Date WART 1—PROJECT INFORMAT•a Prepared by Project Sponsor NOTICE: This document is designed to assist in determining whether the action proposed may have a significant effect on the environment. Please complete the entire form, Parts A through E. Answers to these questions will be considered. as part of the application for approval and may be subject to further verification and public review. Provide any adciitionai'>t information you believe will be needed to complete Parts 2 and 3. It is expected that completion of the full E.AF will be dependent on information currently available and will not involve new studies, research or investigation. Please......... This is a three lot minor clustered subdivision of 40,000 sq. ft..(1 ac.) for lot # 2&3 and 16.1 acres for lot 1. This would be beneficial for 2 reasons: 1. The Suffolk County Water Authority is interested in purchasing the 16. lac. For the purpose of using the test well that was drilled on the northern end of our property which will supply water to the Eastern tip of the North Fork (Orient). The Water Authority also will allow the existing farmers to farm the acres surrounding the well area, as long as a perimeter of 250 feet is keep from the well site, and no dangerous chemicals are used on the farm. The two 1 ac. Or 40,000 sq. ft. parcels will be used as a residences. 2. The proposed residential lots of 40,000 sq. ft. each (1 ac. each) will better suit the 2 existing houses which are now located on the existing property. The division of the two homes creating two separate lots will allow and afford two separate families to reside in East Marion. 3. The formal and natural existing landscaping plus the farmed fields will remain in tact and allow for maximizing the natural lay of the land which will best preserve the original and existing flora and fauna. The Southold Town Planning Board, as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared. Name of Action: Proposed lot line change for George J. and Carole J. Bambrick and Brian and Brendan Bambrick SCTM#: 1000- 59-5-7 & 8 Location: 155 Lake Court, Southold SEAR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration: Yes ( ) No (X) Description of Action: This lot line change is to subtract 7,096 square feet from a 23,700 square foot parcel and add it to a 7,000 square foot parcel Page 2 SEQR Negative Declaration - Proposed lot line change for Bambrick August 26, 1996 Reasons Supporting This Determination: This project involves a lot line change that will result in the transfer of 7,096 square feet from a 23,700 square foot parcel; to a 7,000 square foot parcel. Both parcels are non -conforming parcels. Thus the smaller non -conforming parcel will become more conforming. The change requires a Zoning Board of Appeals decision. The change will not result in a more intensive use of the land. An Environmental Assessment Form has been submitted and reviewed, - and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Limned Lend Summon 218 FRONT STREET GREENPORT, NEW YORK 11944 A (518) 477-0170 TO WHOM IT MAY CONCERN: May 31, 1996 This is to certify to certain findings relative to the Nowell Estate/Iglesias-Wexler property located on the northerly side of Main Road, East Marion, pur- suant to reUarch of several deeds concerning these premises. First of all, we believe that the County/Town tax personnel have inadvertently (?) superimposed tax parcel 1000-31-2-32 in an erroneous location on the tax map of that area of East Marion. The description of that parcel refers to the store tract formerly of G.S. Nowell, located some 600 feet easterly of the so-called tax parcel 32, shown on the tax map as 1000-31-3-16, now owned by.an Orestes Angel. We think that this situation has led to the confusion concerning the proposal of Mrs. Wexler to divide her property, setting off one house par- cel from the other. As a result we feel that there no longer exists a tax parcel 32. This is further corroborated by descriptions ma& for deeds recorded both in 1985 (Liber 9733 P 110, L. Tuthill to G. Iglesias) and in 1990, G. Iglesias to D. Iglesias, each reciting an 18 -acre tract which would encompass the entire Nowell Estate holdings; See L. 11187 P 443. There .,must be a prior deed or two N from George, Edith, Elizabeth Nowell intoTuthill, in order for him to be able to convey, the to the Iglesias family. As an aside, there seem to be many in the more recent deeds, ions, others reversed, etc prepare deed. While there were several deeds covering the three separate parcels previously comprising the entire Nowell 18 -acre tract, these seem no longer to be relevant, although one of the deeds may describe a proposeidivision line for a set-off of one house parcel.
