BASIS OF APPEAL: August 21, 1996 Action of Disapproval by the Building
Inspector, Article IIIA, Section 100-30A.3.
RELIEF REQUESTED: (1) Request for approval of proposed Lot #1 and #2, each
with insufficient lot width (frontage) to the new proposed division line, and
(2) request for insufficient sideyard setbacks from existing dwellings to the
new division Line; all as more particularly shown on survey map dated July 19,
1989. amended Aug. 26, 1996 for G. Sanders Nowell Estate, c/o Donna Wexler.

ACTION/R.ESOLtJTION ADOPTED: Approved as applied (with notation that the
Suf'ok County Water Authority will be purchasing the farm and forest land for
the supply of water in these areas).
REASONS/FINDINGS:
1. 'total lot area of each parcel will meet (or exceed) code requirements.
2. Lot width and setback variances are the minimum necessary.
3. No physical change in the location of the buildings will be necessary by the
placement of this "division line" between the two dwellings.
4. There is no alternative available for appellants to pursue.
5- The difficulties are related to the layout of the land, and arc not personal
to the landowners.
6. The character of the neighborhood will remain significantly unaffected by
the minimum variances.
7. No adverse physical or environmental effects will be produced on adjacent
properties since the plan will continue to be in conformity with the zoning code.

Monday, October 21, 1996:
The final public hearing which was held at 7:30 p.m., was closed.
The following resolution was adopted:
WHEREAS, Donna Wexler is the owner of the property known and designated as
SCTM# 1000-31-2-32.1, located on the north side of Main Rd. and the east side of
Rocky Point Rd. in East Marion; and
WHEREAS, this proposed minor subdivision, to be known as G. Sanders Nowell
Estate, is for 3 lots on 18.165 acres; and
WHEREAS, approval was granted by the Zoning Board of Appeals on September 19,
1996 (Appl. #4414) for insufficient lot width and insufficient side yard setbacks; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a

Town Hall, Southold, New York on October 21, 1996; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the surveys dated September 13, 1996, and authorize the Chairman to endorse the
final surveys subject to fulfillment of the following condition. All conditions must be
met within six (6) months of the date of this resolution:
1. The submission of final maps (2 mylars and 5 paper prints) all containing
a current stamp of Health Department approval.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The action is consistent with existing land use in the area. No increase in
demand for community services is anticipated. There are no significant sensitive
environmental resources on the subject site that would warrant preservation and
no adverse impacts are expected.
There has not been any correspondence received from the Department of Health
Service in the allotted time. Therefore, it is assumed that there are no comments
or objections from that agency.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections
from that agency.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk

T FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may he significant is not always easy to answer. Frequent-
ly, there are aspects or a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge or the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method wherebv applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic Project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It orovides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially -
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially -large, then Part 3 is used to evaluate whether or not the
impact is actually important.

On this day of Aug. 20`s 1996, I would like to apply beg and plead, for a very very small change
in the Discription of Action dated Jan. 29, 1996 and The Declaration of Covenants & Restrictions: TO
READ AS FOLLOWS: If it's ok with the board. Please.........
This is a three lot minor clustered subdivision of 40,000 sq. ft..(1 ac.) for lot # 2&3 and
16.1 acres for lot 1. This would be beneficial for 2 reasons:
1. The Suffolk County Water Authority is interested in purchasing the 16. lac. For the purpose of
using the test well that was drilled on the northern end of our property which will supply water to the
Eastern tip of the North Fork (Orient). The Water Authority also will allow the existing farmers to farm
the acres surrounding the well area, as long as a perimeter of 250 feet is keep from the well site, and no
dangerous chemicals are used on the farm. The two 1 ac. Or 40,000 sq. ft. parcels will be used as a
residences.
2. The proposed residential lots of 40,000 sq. ft. each (1 ac. each) will better suit the 2
existing houses which are now located on the existing property. The division of the two
homes creating two separate lots will allow and afford two separate families to reside in East
Marion.
3. The formal and natural existing landscaping plus the farmed fields will remain in tact and
allow for maximizing the natural lay of the land which will best preserve the original and
existing flora and fauna.

Both parcels are non -conforming parcels. Thus the smaller non -conforming
parcel will become more conforming. The change requires a Zoning Board of
Appeals decision. The change will not result in a more intensive use of the land.

This is to certify to certain findings relative
to the Nowell Estate/Iglesias-Wexler property located
on the northerly side of Main Road, East Marion, pur-
suant to reUarch of several deeds concerning these
premises.
First of all, we believe that the County/Town
tax personnel have inadvertently (?) superimposed tax
parcel 1000-31-2-32 in an erroneous location on the
tax map of that area of East Marion. The description of
that parcel refers to the store tract formerly of G.S.
Nowell, located some 600 feet easterly of the so-called
tax parcel 32, shown on the tax map as 1000-31-3-16, now
owned by.an Orestes Angel. We think that this situation
has led to the confusion concerning the proposal of Mrs.
Wexler to divide her property, setting off one house par-
cel from the other. As a result we feel that there no
longer exists a tax parcel 32. This is further corroborated
by descriptions ma& for deeds recorded both in 1985 (Liber
9733 P 110, L. Tuthill to G. Iglesias) and in 1990, G.
Iglesias to D. Iglesias, each reciting an 18 -acre tract
which would encompass the entire Nowell Estate holdings;
