XXIII, Sec. 100-239.4E and Article III, Section 100-33C. Request Herein Variance based upon October 10, 1996 Action of Disapproval of the Building Inspector. Applicant wishes to proceed in obtaining a new building permit for deck addition within 75 feet of existing bulkhead, and for accessory shed location with an insufficient front yard setback (as located/built),at 7+- feet from the side line at its closest point and 4+- feet from the northerly front property line. BOARD ACTION: Motion by Member Dinizio, seconded by Member Goehringer, it was RESOLVED, to CONDITIONALLY GRANT the relief requested at this time based upon the circumstances existing at this time, subject to the following condition: Should the accessory storage shed be proposed to be enlarged or reconstructed, it must be relocated and moved to a conforming yard location under either today's code requirement (40 ft. from the front property line) or the code in effect at the time it may need reconstruction. (Note: The zoning code allows painting, and by permit minor repairs of portions of a building. Minor repairs may not include any portion of reconstruction.) REASONS: When building permit #15772 was issued in March 1987, it appeared that the setback approved was measured from the highwater mark at the rear line, rather than the bulkhead line. There are lots with similar setbacks in the immediate neighbor (ref: 1000-90- 1-25, and others). Also see full testimony received and discussed at the hearing held on 11/14/96 for this application. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( X) A Variance to the Zoning Ordinance is requested for the reason that applicant seeks a variance for a deck addition as built on a lot upon which a bulkhead exists for a distance of less than 75feet from the bulkhead. Applicant also seeks a variance to maintain a storage shed "as built" approximately 4 feet from the front yard line. Form ZB1 (Continue'on other side) 1, REASON FOR APPEAL Continued • 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant obtained a building permit #15772Z dated March 17, 1987 to replace a deck on a existing house. Due to a misreading of the scale on a survey prepared by Van Tuyl & Son., applicant and applicant's builder were under the impression the deck could be seg at least 75 feet from the bulkhead. The misreading of the survey was caused by the fact that two scales were reflected on the survey. One scale at the bottom of the survey indicated that 100' = 1" and the detail scale indicated 50' = 1". The deck was constructed less than 75feet from the bulkhead back in 1987 and a Certificate of Occupancy was never applied for. The applicant is presently under contract to sell the subject premises and it was at this point that the applicant realized there was still an open building permit for which no CO was issued. In making application for a CO for the deck it was realized that the closest portion of the deck is approximately 50 feet from the bulkhead and not 75 feet thus requiring this variance application. On February 18, 1965 the applicant applied for a building permit to construct a dwelling, which building permit was issued as #2748Z. On the application it was noted that the existing frame building would be -moved to the front yard. Said frame building is the shed in question and it was moved to its present location in the front yard approximately 4 feet from the front yard line in 1965. On the building permit for the house there was a notation that the accessory building location on the application was to be approved by the Zoning Board of Appeals which never took place. (continued on rider) 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because both the deck and shed are already built and have been on the property for some time. Because of the misunderstanding of the Van Tuyl survey it would be physically impossible to locate any deck within 75 feet of the bulkhead since the house itself is 751`feet from the bulkhead and any additional structure attached to the house on the water side of the house by necessity would require a variance. The shed "as built" has-been in its present location for 31 years without any requests from neighbors,to move same. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE, CHARACTER OF THE DISTRICT because the deck "as built" has been on the property since 1987 and the shed as been in its location since 1965. As indicated in this application the applicant is under contract .to sell the subject premises and must provide Certificates of Occupancy to the purchaser for all structures and improvements. It is respectively submitted that no undesirable change will be produced in the character of the neighborhood, nor a detriment to hearby.properties if granted. The benefit sought by the applicant cannot be achieved by any feasible method other than applying for an area variance. It is respectively submitted that the area variance being sought should not be substantial and will have no adverse effect or impact on the physical or environmental conditions in the neighborhood. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant obtained a building permiL //15772Z dated March 17, 1987 to replace a deck on a existing house. Due to a misreading of the scale on a survey prepared by Van fuyl & Son., apQblicant and applicant's builder were under- the impression the deck could be se(, at least 75 feet from the bulkhead. The misreading of the survey was caused by the fact that two scales were reflected on Lite survey. One scale at the bottom of the survey indicated that 100' = 1" and Lite detail scale indicated 50' = 1". The deck was constructed less than 75feet from the bulkhead back in 1987 and a Certificate of Occupancy was never applied for'. The applicant is presently under contract to sell the subject premises and it was at this point that the applicant realized there was still an often building permit for which no CO was issued. In making application for a CO for the deck it was realized that the closest portion of the deck is approximately 50 feet from the bulkhead and (lot 75 feet thus requiring this variance application. On February 18, 1965 the applicant applied for a building permit to construct a dwelling, which building permit was issued as //27482. On the application it was noted that the existing frame building would be -moved to the front yard. Said frame building is the shed in question and it was moved to its present location in Lite front yard approximately 4 feet from Lite front yard line in 1965. On the building permit for the house there was a notation that the accessory building location on the application was to be approved by the Zoning Board of Appeals which never took place. (continued on rider) 7. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because both the deck and shed are already built and have been on Lite property for some time. Because of the misunderstanding of Lite Van Tuyl survey it would be physically impossible to locate any deck within 75 feet of the bulkhead since the house itself is 75ifeet from the bulkhead and any additional structure attached to the house on the water side of the house by necessity would require a variance. The stied "as built" has been in its present location for 31 years without any requests from neighbors to move same. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE, CIIARACTER OF THE DISTRICT because the deck "as built" has been on the property since 1987 and the shed as been in its location since 1965. As indicated in this application the applicant is under contract .to sell the subject premises and must provide Certificates of Occupancy to the purchaser for all structures and improvements. It is respectively submitted that no undesirable change will be produced in the character of the neighborhood, nor a detriment to nearby. properties if granted. The benefit sought by the applicant cannot be achieved by any feasible method other than ai)plying for an area variance. It is respectively submitted that Lite area variance being sought should not be substantial and will have no adverse effect or impact on the physical or environmental conditions in the neighborhood.
