No. 4440 ACTION OF THE BOARD OF APPEALS December 12, 1996 APPLICANT: ADLYN J. SYVERSON Southold Town Hall 53095 Main Road P.O. Box 1179 Southold, New York 11971 Fax(516)765-1823 Telephone (516) 765-1809 LOCATION OF PROPERTY: 420 Private Road 17, Mattituck. COUNTY TAX MAP DISTRICT 1000, SECTION 123, BLOCK 6, LOT 17.1. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated October 7, 1996 due to "Insufficient side and total side yard setbacks for this 27,029 sf. lot." (Code requires minimum of 15 ft. and 20 for each side, plus a total of t. for both sides.) PROVISIONS APPEALED FROM: Article XXIV, Section 100-244. RELIEF REQUESTED: Addition squaring off the northwesterly corner of existing one-story frame house, which slighting reduces the side yard setback to the west to 14'7", while maintaining the present conforming sideyard at 17 feet at the southwesterly corner of the existing house. The reduction is less than a foot based upon the present code requirement (15 ft.), and a total of 2417" for both sides, instead of the required 35 ft. REASONS/ FINDINGS: Variance is not substantial. Difficulty is due to the location of the dwelling at an "off center" point on the property and the westerly property line, as located. MOTION MADE BY: James Dinizio, Jr. SECONDED BY: S. Doyen ACTION/ RESOLUTION ADOPTED: APPROVED proposed northwesterly corner addition as applied, squaring off the dwelling, leaving a setback at approximately 20-21 feet from the closest northerly property line, 147" from the closest westerly side property line, and a total 247" for both side yards. VOTE OF THE BOARD: Ayes: Serge J. Doyen, James Dinizio Jr., Robert A. Villa, Lydia A. Tortora, and Gerard P. Goehringer. This resolution was unanimously adopted (5-0). BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated October 7, 1996 due to "Insufficient side and total side yard setbacks for this 27,029 sf. lot." (Code requires minimum of 15 ft. and 20 ft. for each side, plus a total of 35 ft. for both sides.) PROVISIONS APPEALED FROM: Article XXIV, Section 100-244. RELIEF REQUESTED: Addition squaring off the northwesterly corner of existing one-story frame house, which slighting reduces the side yard setback to the west to 141711, while maintaining the present conforming sideyard at 17 feet at the southwesterly corner of the existing house. The reduction is less than a foot based upon the present code requirement (20 ft.), and a total of 247" for both sides, instead of the required 35 ft. REASONS/FINDINGS: Variance is not substantial. Difficulty is due to the location of the dwelling at an "off center" point on the property and the westerly property line, as located. MOTION MADE BY: James Dinizio, Jr. SECONDED BY: S. No. 4440 - Variance for Adlyn Syverson Property: ROW off Camp Mineola Road, Mattituck Dear Mr. West: Please find enclosed a copy of the December 12, 1996 determination rendered by the Board of Appeals in the above matter. A copy of this determination has been transmitted to the Town Building Department pertaining to the owner's pending building permit application request. However, it may still be necessary for you to contact the Building Department (765-1802) to be sure your application request is in complete form and returned to the shelf for re -activation and processing.. As you know, construction activities are not permitted until all other permits have been issued and received. Also, due to the proximity of this project within 500 feet of a waterway, State or County Road, the Suffolk County Department of Planning is conducting a county review, which is expected to be left for local (Town) determination without further steps on your part. If you have any questions, please feel free to call.
