GROUNDS OF REQUEST/ REFERRAL: Building Inspector Notice of Disapproval issued September 24, 1996 stating "...Under Article II, Section 100-25A(1) Merger, proposed construction for a dwelling on a non -conforming lot created prior to 1957 that has been held in common ownership with adjacent non -conforming lots sometime after July 1, 1983...." TYPE OF REQUEST: Waiver under Article Il, Section 100-26. REASONS FOR GRANT OF WAIVER: 1. Each of the three lots were created by separate deeds: by 9/1/1943 deed at 2314 p. 18; by 12/31/1946 deed at Liber 2665 p. 307; and by 6/4/1953 at L. 3533 p. 237. 2. Original established lots are virtually confirmed by current deeds. 3. Each has single tax bills since lot creation dates. 4. Zoning adopted by Town 4/23/57 (lot merger theory was strictly enforced since about 1981/1983 in the Town's zoning matters). 5. Each of the three lots are improved with single-family dwelling and separate water and septic systems. 6. Neighborhood consists of lots similar in size. 7. The land will not require a change or alteration in contours or slopes, or substantial filling of land. 8. There is no increase in density by this lot waiver since the properties have been improved with single-family dwelling construction. 9. Most lots in this development have been built upon. 10. The land will not require change or alteration in contours or slopes, or filling of land. 11. The use increase (density) created as a result of this particular waiver is zero, due to existing improvement of dwelling on each parcel. 12. The grant of this waiver does not set a precedent for other vacant lots due the unique circumstances and this case's land history. MOTION MADE BY J. Dinizio SECONDED BY S. William P. Scholl Jr die on November 26,1989 and the two sons, Franklin and William, were co-executors of the estate. SCTM# 1000-123-2-17.1: William P. Scholl Jr. purchased SCTM# 1000-123-2-17.1 on September 1, 1943, at Liber 2314 Page 18 for a 104 x 250 ft parcel, known as 1380 Bungalow Lane, Mattituck, lot #45 of Marratooka Park, Section "B". The lots in this subdivision were created during 12,500 s.f. zoning, a certificate of Occupancy was issued for a private one family dwelling dated May 31,1961 (attached). The Town has issued separate tax bills for this and adjacent properties. Upon William P. Scholl's death Lot #45, Franklin and William P. Scholl, Jr. III took title to the property and is presently under contract to sell the house to Scopelitis for $85,000. SCTM#1000-123-2-17.2: on or about 1946, William P. Scholl Jr. purchased the lot from Marjorie Wickham and built a summer cottage in 1946. Franklin lived in this house until 1980. His son, Franklin A. Scholl Jr. lived in the house. Franklin A. Scholl Jr. bought the house prior to grandfather's death , on September 14,1989 by Liber 10983 page 28. This parcel is approx. 104 x 250 ft . Franklin Scholl obtained a building permit to construct an addition to an existing dwelling known as 1340 Bungalow Lane, Mattituck. The property was mortgaged by Suffolk County National Bank. The property is described in meets and bounds, and is described in the attached survey dated May 3,1990 prepared by Peconic Land Surveyors. On August 30,1995 Franklin Scholl transferred his improved property to himself and his wife, as tenants by the entirety. SCTM#1000-123-2-18 By separate deed William P. Scholl, Jr. purchased SCTM#1000- 123-2-18, 600 Center Street, Mattituck on February 14,1989 which contained a mobil home , he obtained a Building Permit to construct a one family dwelling, the existing mobil home was demolished on or about March 13,1989. On September 14, 1989 the house was transferred to another grandson, Philip Scholl by separate deed at liber 10983 page 30. Philip continues to live in this home. Attached is a survey redated August 9, 1990 with a Health Department seal dated February 15, 1991 showing a single family home. All three parcels were issued building permits, houses were built with individual septic and water and Certificates of Occupancy was issued to each house. All three parcels were intended to be separate lots. When father, William P. Scholl Jr. died the estate transferred the one property, 1260 Bungalow Lane, 17.1, to the heirs. The other parcels were transferred prior to death. Prior to the November 28, 1995 legislation, these properties were recognized as buildable parcels because the were lots on the Marratooka Park subdivision. The merger of these improved parcels is directly contrary to zoning by creating a greater nonconformity, a parcel with more than one single family residence. The building department would never have issued a building permit for more than one single family residence on each lot.
