A regular meeting of the Southold Town Board of Appeals
was held Thursday, September 3, 1959~ 7:30 P.M.~ at the Town
Clerk's Office, Main Road~ Southold, New York.
There were present: Messrs. Robert W. Gillispie, Jr.,
Chairmau, Robert Bergen~ Herbert Rosenberg, and Charles
Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howard M. Terry~ Building Inspector.
The Chairman opened the meeting by reading the letter
which was forwarded to Mr. Helmut Hass on date of August 31,
19~9 advising that his ~ppeals No._ 208, 209,.210, 211 and 212
would be continued to this date (September ~) and askirg that
a representative of the Southold Town Beach Motel be present
to discuss locations of the proposed signs with the Board.
The Chairman then read the following application! legal
notice o2 hearing and affidavit attesting to its publication
in the official newspaper: 7:40 P.M. (E.D.S.T.)~ upon appli-
cation of Helmut Hass, for SoutholdTown Beach Motel, North

Road~ Southold~ New York~for a special exception in accord-
ance with the Zoning Ordinance, Article IV~ Section $08~ for
permission to erect and maintain a directional advertising sign
on the property of Richard E. Schiefer~ east side Bowery Lane
and south side North Road~ Southold~ New York. Fee paid $15.00.
CHAIRMAN: Mr. Hass, there is a great problem where signs
are concerned because of the great many people against signs.
It is necessary to have the exact location where you wish to
place signs and then it would be up to the Board to determine
what is reasonable and what ~s unreasonable. There should not
be a sign on a persohs front lawn, that is not a good idea.
Also it is felt signs should be in locations where they will
do the most good. We have had as many as four and five hundred
people against a single sign.
We will now take this application to place a sign on the
Schiefer property.
Mr. Hass introduced Mr. Ernest Eisen, Southold, New York.
Mr. Eisen painted the signs in question for Mr. Hass.
CHAIRMAN: Is there anyone present who wishes to speak
for this application?
.M~.. HELMUT HASS, Southold Town Beach Motel: We need the
directional sign to direct people to the motel. Most people
ask~how do we get there~ We are having circulars printed
which will be sent to the people telling them to turn right
at Mattituck and following the signs down to the motel. We
particularly need a sign at Mattituck directing them to the
North Road because once on the North Road they are O.k.
CHAIRMAN: How many signs do you have on Route 2~?
MR. HASS: None.
CHAIRMAN: None west of the motel?
MR. HASS: None.
CHAIR}LAN: East of themotel?
MR. HASS: There are none east either.
CHAI~,~: Is there anyone else present ~ho wishes to
speak 2or this application? Is there anyone present who wishes
to speak against this application? Are there any questions
members of the Board would like to ask?
MR. BERGEN: How long will the signs be up?

(Mr. Hass explained the size and type of ~gns to be
erected.)
MR. ROSENBERG: Why do people need a sign on that corner~
Schiefer property~ to tell them to stay on the road, when the

MR. EISEN: A lot of traffic goes through there. Wha~they
read the sign they know that they are near the motel.
MR. HAGS: That sign at Schiefers we sneaked up for two
weeks without a permit and I can show you inthe books that it
increased business.
MR. R0$EI~BE~G: You were advertising the motel at that
point.
MR. HASS: They saw my sign though.
MR. ROSENBERG: There is a difference between an advertising
sign and a directional sign.
CHAIR~iAN: Do you expect to put another sign between this
location and themotel?
~q. EISEN$ I hate a lot of signs. Cluttering the road
with signs looks terrible. This should have been taken aare
of years ago. However, two or three signs is all that is
needed. Mr. Hass is in the process of building up his business
and it needs to be built up.
CHAIRMAN: How many circulars do you plan to send out?
MR. HASS: 6000 to 7000 circulars to prospective customers.
CHAIF~AN: How many people can you accomodate?
MR. HAS$: I have 36 units.
(Mr. Rosenberg explained that the number of directional
signs to be permitted should be placed in strategic places.)
ReEolution was offered by Mr. Bergen, seconded by Mr.
Grigonis and carried, WHEREA~ application of Helmut Hass, for
Southold Town Beach Motel, having been considered at Public
Hearing No. 208 on August 27, 19~9 and continued to September
3, 19~9, and the Board finding that the public convenience and

welfare and justice will be served and the legally established
or permitted use of neighborhood property will not be substantially
or permanently injured and the spirit of the Ordinance would be
observed, therefore be it
RESOLVED that the application be granted providing sign is
located at least 30 ft. from the Schiefer property line at the
intersection of Bowery Lane and North Road and three feet from
other property lines.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
Rosenberg, and Mr. Grigonis.
The Chairman then read Appeal No. 209 which is as follows:
7:~0 P~M. (E.D.S.T.), upon application of Helmut Hass, for
Southold Town Beach Motel, North Road, Southold, New York, for
a special exception in accordance wi~h the Zoning Ordinance,
Article III, Section 300, Subsection ll, for permission to
erect and maintain a directional advertising sign on the property
of Ernest C. Tuthill. south side Middle Road~ Mattituck, New
York. Fee paid $15.00.
cHAIp~MAN: Is there anyone present who wishes to spe~ for
this application?
MR. EA~S: I wish to say the same as before, to direct
people going to the motel.
CHAIRMAN: How many directional signs do you think you need
on the North Road?
MR. HASS: We have to get known and have to have signs for
people to get acquainted with the ~ocation of the motel. FrOm
Mattituck to the motel I would ]_ike to get five or six signs.
They will only be up for the season, fram ~out April to December.
CHAIRMAN: In the matter of the sign on the property of
Ernest Tuthill we will continue the hearing for four weeks,
which will be October 1st. '~
Resolution was offered by ¥2. Bergen, seconded by Mr.
Rosenberg and carried~ continuing this hearing until October
l, 19~9.

Southold Town Beach ~tel~ ~o_th Road, ~outhold, New York, for
a special exception in accor~e with the Zoning Ordinance~
Article III~ Section ~O0~ Sub, eot±on ll, for permission to
erect and maintain a directio~~ ~dvertising sign on the prop-
erty of Mary Pylko, soubh sid~ 3~d Avenue~ Mattituck~ New
York. Fee paid $15.00.
CHAIR~N: Is there anyonc present who wishes to speak
for this application?
MR. HASS: ~ really need that one at the Pylko property.
I want to get them on to 27A.
MR. R~ ENBERG: Don't you think that is a poor place.
Don't you thi~k the signsho~uld be before the Pappish building~
before you co~e to the turn? The sign could read "straight
ahead~ bear left."
(The above suggestion was discussed at length and Mr. Hass
decided he would place the sign closer to the Pappish building,
at the most westerly end of the Pylk8 property.)
Resolution was offered by Mr. Rosenberg~ seconded by ~.

Southold Town Beach Motel~ having been considered at public
Hearing No. 210 on August 27, 19~9, and continued to September
~ 1959~ and the Board finding that the public convenience and
welfare and justice will be served and the legally established
or permitted use of neighborhood property will not be substantially
or permanently injured and the spirit of the Ordinance would be
observed~ therefore be it
RESOLVED~ that permission is granted for location of the
sign on the Pylko property~ restricting location to an area
within 100 ft. of the easterly line of land of Papish, and not
closer than three feet to any property line.
Vote of the Beard: Ayes:- Mr. Gillispie~ Mr. Bergen~
Mr. Rosenberg~ and ~. Grigonts.
The Chairman read Appeal No. 211 which is as follows:

for a speczal e~ception in accordance with the ~oning 0rdin-
ance~ Article IV~ ~ection ~O8~ for permission to erect and

maintain a directional advertising sign on the property of the
Shell Service Station, Ted Wells, Proprietor, north side Hamilton
Avenue amd west side Wickham Avenue~ Mattituck, New Yor~. Fee
paid $15.00.
CHAIRMAN: The owner of the propertyhas advised that he
does not wish a sign erected there.
MR. HASS: I will try to get another location near there.
Resolution was offered by Mr. Grigonis, seconded by Mr.
Rosenberg and carried, WHEREAS application of Helmut Hass, for
Southold Town Beach Mote~ having been considered at Public
Hearing No. 211 on August 2~, 1959, and continued to September
3, 19~9, and the Board findi~g that the public convenience and
welfare and justice will not be served and the legally estab-
lished or permitted use of neighborhood property will be sub-
stantially or permanently injured and the spirit of the Ordinance
will not be observed, therefore be it
RESOLVED, that permission is denied.
Vote of the Board: AyesJ- Mr. Gillispie, Mr. Bergen,

The Chairman then read Appeal No. 212 which is as follows:

exception in accordance with the Zoning Ordinance~ Article III~
Section 300~ Subsection ll~.for permission to erect and maintain

o~~N~rth Road, S~uth~ld, New York. Fee paid $1~.00.
CHAIRMAN: The oWner of the property has reconsidered and
does not wish a sign erected on his front law~.

not believed to be in the best interests of the Town of Southold
to locate a directional advertising sign on residential property
such as that of Mr. Joseph Sawicki.

The Board of Appeals discussed and approved the following
recommended procedure upon application for special exceptions
for signs:
The following resolution was offered by Mr. Bergen, seconded
by Mr. Grigonis and carried:
RECOMMENDED PROCEDURE:
Due to increase in motel and restaurant enterpris'es the
following requirements should be met by applicants seeking
directional signs:
An accttrate sketch of property showing
highway and adjoining properties to nearest
intersection with exact location of proposed
sign, with sketch, size, wording. Written
permission by owner of property for erection
of directional sign as well as completed
application for sign permit together with
fees.
This "guidance" supersedes former suggested procedure as
notedin minutes of May 22, 19~8. Directional signs for places
of amusement will no longer be permitted.

On motion of Mr. Bergen, seconded by Mr. Rosenberg, and
carried, it was RESOLV~D that time and place be set for hearing
upon application of Louis Zarzecki, Orchard Street, Orient, New'
York, for a variance in accordance with the Zoning Or~inance~
Article III, Section 303, and Article X, Section lOOOa~ for
permission to reduce frontage and use as a single lot~ proper
located on the west side Oyster Ponds Lane, Orient, New York

and bounded north by N. A. Luce~ east by Oyster Ponds Lane,
south by Fernando Jiminez, and west by Annie Wysocki. Time
and place being set for 7:30 P.M.~ (E.D.S.T.)~ Thursday~
September 17, 1959, Town Clerk's 0ffice~ Main Road, Southold,
New York.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and ~. Grigonis.
By resolution offered by Mr. Grigonis, seconded by Mr.
Bergen and carried, 7:~ P.M, (E.D.S:T.)~ was set on Thursday,
September 17~ 19~9, Town Clerk's Office, Main Road! Southold,
New York~ for time and place for hearing upon applzcation of
Victor Lessard~ Wickh~m Avenue~ a/c Mary O. MacNish, Westphalia
Road, Mattituc~, New York, for a variance in accordance wit~
the Zoning Ordinance~ Article III, Section 307, for permisszon
to reduce side yard on property located at east side Westphalia
Road~ Mattituck~ New Zork~ ~d.bounded north bY Fred Olmstead~ east
by Mattituck Creek~ south by William Satterly, and west by
Westphalia Road. .
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and ~. Grigonis.
On motion of Mr. Rosenberg~ seconded by Mr. Grigonis and
carried, Thursday~ September 17, 19~9~ 8:00 P.M., (E.D.S.T.),
at the Town Clerk's Office~ Main Road~ $outhold~ New York, wa~
set for hearing upon application of Helmut Hass~ Main Road~
Greenport~ New York, for a variance in accordance with the
Zoning Ordinance, Article IV~ Section ~0~ for permission to
reduce front yard setback from established setback line. Lo-
cation of property, south side North Road, Southold~ New York,
bounded north by North Road, east by other lands of the ap. pli-
cant, south by other lands of the applicant, and west by Henry
Wenzelo
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.

The application of Lewis N. Griffin~ Bay Avenue, Mattituck~
N~w York was received. Mr. Griffin's application applied for a
special exception under Article IB, Section ~00, Subsection 9
which reads as follows: "Public garages or automobile service

stations when approved as a special exception by the Board of
Appeals as hereinafter provided." Mr. Griffin wishes to have
a public garage and automobile service state, on, therefore it
was
RESOLVED by lv~. Rosenberg, seconded by Mr. Bergen and
carried, that application be ordered published in the official
newspaper excluding "two gasoline pumps" on line two, and ,,sale
of fuel wo~ld be incidental to this operation" paragraph three,
line two~ as not complying with the Ordinance.
