Property Location: 15155 Main Road, East Marion; Parcel 23A-4. BASIS OF APPLICATION: Building Department's February 20, 2002 Amended Notice of Disapproval for the reason that applicants' proposed new deck at less than 20 feet from the side property line, reference Sections 100-242A and 100-32 of the Zoning Code. AREA VARIANCE RELIEF: The new deck is proposed extending north of the dwelling 8.2 ft., with 11.2+- ft. variable at the west end, for a total length of approximately 49 feet. The proposed 3' x 11' +- stairway will be added at the west side of the new deck, leaving a side yard clearance of 12 feet at its closest point. The remaining side yard distance with the new deck addition will be leave an easterly side yard of more than 39.9 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is a 3.09 acre parcel located on the north side of Main Road in East Marion. The lot is improved with an existing 1-1/2 story framed house located as shown on the November 12, 1997 survey prepared by Peconic Surveyors, revised October 31, 1999, and May 21, 2002. The house as exists is shown at 15 feet from the westerly side line, 39.9 feet from the east side line, 73.2+- feet from the bank and the edge of the wetlands to the north (and south of the AE Flood Zone line). An accessory garage structure is shown north of the house adjacent to the concrete sea wall. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in3own Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by,such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The house had existed in its present nonconforming location for years, and there is no alternative. The requested location of a deck is reasonable in light of the existing conditions at the property; the deck is proposed landward(south)of the existing garage area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The location of the existing buildings are nonconforming, and the applicant wishes to take advantage of the view of the Long Island Sound (north). The deck will maintain the existing 15 ft. side setback on the west side, and the 3' x I I'+- stairway from the ground to the raised deck is not greater than a three (3) ft. protrusion into the side yard. The total area of nonconformance is 108+-sq. ft. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that this variance will have any adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy e benefit of a deck addition, w i e preserving and protecting the character o e neig-bortioo and health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Chairman Goehringer, and duly carried,to GRANT the variance,as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
