The lot has two front yards facing the two streets. The property is located in the LI Light Industrial Zone District, and is improved with an office and warehouse buildings as shown on the site plan prepared January 3, 2002, making reference to information shown on a survey made by Peconic Surveyors dated November 14, 2001. BASIS OF APPEAL: Building Department's Notice of Disapproval dated February 12, 2002, denying an application for a permit to build additions and alterations to existing industrial buildings a commercial buildings, for the following reasons: (1) Article XXIV, Section 100-242A concerning a proposal that creates a new nonconformance or increase of nonconformance or new nonconformance, relative to setbacks, lot coverage, and linear building footage greater than 60 ft. facing one street, and (2) Article XIV, Section 100- 143C for the reason that the new construction is setback less than 100 feet from the right-of-way, and the structure will have 480 ft. of linear frontage; and (3) Section 100-142 concerning rear yard,setbacks at 8 ft. and 11.7 feet, side yard of zero feet instead of 20 feet, and total sides of 25 feet instead of 40!feet;, and (4) Section 100-142 and Bulk Schedule concerning additional lot coverage of 2400 sq. ft., increasing the lot coverage from the existing 48+-percent to 53 percent. RELIEF REQUESTED: Applicant requests multiple variances as noted above and more particularly detailed on site map dated January 3, 2002, and elevation plan SK-1 dated May 31, 2002. REASONS FOR BOARD ACTION: Please also see hearing and record in its entirety. The property is adjacent to residences on the north side of Corwin St. and dwelling units on the west side of Ninth Street. The Long Island Railroad (MTA) is located on the south of this property,there is no other land area available. There is little or no area available to improve circulation on the site or to increase fire safety. The small amount of open area left is necessary for clearance between buildings, circulation on the site, and fire and safety. The Town records concerning this site indicate many variances which allowed substantial relief from the codes. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than by way of area variances. There is no other land area available. The proposed construction will result in one building with 480 feet of linear frontage. - Furthermore, the proposed construction is not permitted pursuant to Article XIV, Section 100-142, which states; "No building or premises shall be used and no building or part thereof shall be erected or altered in the LI Light Industrial District unless the same conforms to the Bulk Schedule and ' Parking and Loading Schedules incorporated into this chapter by reference,with the same force and effect as if such regulations were set forth herein in full." Bulk schedule requires a rear yard setback of 70 feet, a single side yard setback of 20, and a total side �� \ yard setback of 40 feet. The lot has two ont yar.s acing t e two streets. e property is located in the LI Light Industrial Zone District, and is improved with an office and warehouse buildings as shown on the site plan prepared January 3, 2002, making reference to information shown on a survey made by Peconic Surveyors dated November 14, 2001. BASIS OF APPEAL: Building Department's Notice of Disapproval dated February 12, 2002, denying an application for a permit to build additions and alterations to existing industrial buildings a commercial buildings, for the following reasons: (1) Article XXIV, Section 100-242A concerning a proposal that creates a new nonconformance or increase of nonconformance or new nonconformance, relative to setbacks, lot coverage, and linear building footage greater than 60 ft. facing one street, and (2) Article XIV, Section 100- 143C for the reason that the new construction is setback less than 100 feet from the right-of-way, and the structure will have 480 ft. of linear frontage; and (3) Section 100-142 concerning rear yard setbacks at 8 ft. and 11.7 feet, side yard of zero feet instead of 20 feet, and total sides of 25 feet instead of 40 feet; and (4) Section 100-142 and Bulk Schedule concerning additional lot coverage of 2400 sq. ft., increasing the lot coverage from the existing 48+-percent to 53 percent. RELIEF REQUESTED_ Applicant requests multiple variances as noted above and more particularly detailed on site map dated January 3, 2002, and elevation plan SK-1 dated May 31, 2002. REASONS FOR BOARD ACTION: Please also see hearing and record in its entirety. The property is adjacent to residences on the north side of Corwin St. and dwelling units on the west side of Ninth Street. The Long Island Railroad (MTA) is located on the south of this property, there is no other land area available. There is little or no area available to improve circulation on the site or to increase fire safety. The small amount of open area left is necessary for clearance between buildings, circulation on the site, and fire and safety. - The Town records concerning this site indicate many variances which allowed substantial relief from the codes. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than by way of area variances. There is no other land area available. The existing building area maximizes the use of the property with coverage by buildings, and limited parking and fire access lane areas. While we are aware of the need for this company to continue to grow, and the importance of the jobs created by the expansion, the fact remains that this company maybe approaching the limits of the site with regard to parking, fire safety, and overall circulation on the site. The Planning Board notes that there may be as little as 8 ft. clearance in the rear yard, adjacent to the LIRR tracks. While the building is sprinklered, the building as very long and may require access by emergency equipment. The site is tight on parking, and while the proposed parking layout satisfies the parking requirements of the Code, operationally the Planning Board has asked that the parking stalls, and the entrance to the site be clearly marked, and that the parking be clearly defined from the street, which now merges into the subject lots. Additional landscape elements may also be required, as the Site Plan is further developed. A formal review of the Site Plan cannot begin until an application and the correct fees are submitted. In view of the constraints facing continued expansion of this site, The Planning Board would recommend that if the proposed variances were granted, that no'future floor area be allowed beyond what is now proposed. At the conclusion of this meeting, the Board indicated that philosophically they could not be in favor of increased lot area over that which is allowed by zoning, but that this aspect is a zoning issue. However,they are sympathetic to the fact that failure to receive the relief requested from your board could force the existing business to relocate out of the area,thereby having a negative impact with regard loss of employment and a vacant building. There was also a comment with regard to the fact that the sought increase in lot coverage is minimal. Another concern is access for firefighting equipment on the south side of the building, which may be mitigated by the fact that the entire existing building is sprinklered. The side on which they have chosen to build is the side With the least amount of land and it comes within six feet of my property. THE CHAIRMAN: What is the area of the property on the south side? MR. ABLF'RS: I think it is over 25 feet,. TEE CEAIREAN: The size of the carport .is 8 ,feet. MR. AMRS: We want to add an additioi.,to the carport and we want to add a bedroom. We intend to add on both sides. The carport will remain a carport but it will be enlarged. THE CEAIRMAN: Is the present carport a _part of the house? It. AHLERS: It is all one roof line. THS' 0&UB : In the original Ordinance ..the thought was that the, flrdina*ee provided for undersized lots. It was recognized that not all -lots, have 25 feet in sideyarda and that, in some cases, the sideyards were considerably under that. An,indiidual was 'permitted to Come in here without requiring a variance and ,obtain a building permit from the Building Inspector where the-sideyard was reduced not more than 50% of the existing sideyard. ,If -it went below 5 feet then a variance would be required. This has been a practice in the Tam of Southold for some time. The reason Pk. Ahlers is here is that this Is an undersized lot overall. There would have been no difficulty in obtaining a building permit from the Building Inspector prior to passage of the new Ordinance- which jumped from 12,500 sq. ft. to 4.0,©00 sq. ft. None of the. lots in this area would conform. I .am explaini i , this situation because I think the Board should grant this application. MR. LAWRENCE PRESBY: I wonder if they could go to the rear? MR. AHLER$: We considered that but the general layout of the house doesn't permit it. If you take the ball away (which you need to go to the rear of the house) this would leave.such a small room that it would not be practical. Your house is ever quite a bit to your northerly propeety line. MR. PRESBY: We have present plans to build in that direction but not to the point where we would need a variance.
